today, the san mateo county board of supervisors voted unanimously to invest 12 million dollars.nd 47 homes for low-income farmworkers. the homes will be built at stone pine road about a mile from downtown half moon bay out of the 47 homes. 19 of them will be for families displaced by the mass shooting last year. 7 farmworkers were killed. and since that shooting, san mateo county has been focusing on creating proper housing for the farm workers. as for the mushroom farms involved in that deadly shooting, they will be paying nearly half a million dollars in damages to employees over labor violations. federal investigators say concord farms and california terra gardens house workers in, quote, sickening conditions where they slept on dirty mattresses and were exposed to insects, trash and mold. investigators say the farm's owners also deducted money from the workers paychecks for the substandard housing and failed to pay workers for overtime. memorial day weekend is almost here. many people are planning to hit the roads. of course. >> according to triple a 38 million people expect

nbc bay area's ian cull joins us live now from the san mateo county courthouse. ian you've been out there all day. what is the latest? reporter yeah, well, audrey, this ruling just coming down in the past 20 minutes, the judge saying that the defense has failed to prove why it needed to do new dna testing on this old evidence. in fact, she ruled that they could only test or retest one of the 14 items they wanted to. now, this is the biggest day in this case since the la innocence project took over. scott peterson's case. peterson appeared virtually in the san mateo county court from a prison in the central valley. among the items they wanted to test clothes and duct tape found on laci peterson's body, there was also a tarp and a bag found at the scene that day. the major focus today was on what the defense described as a bloody mattress found inside a burned out orange van. it was found in modesto, near the peterson home the day after laci disappeared. they say its existence could be key to proving someone else killed laci, but the only thing the judge allowed to

evan low gained one more vote today as san mateo county issued its final tally. this is district 16, which covers san mateo and santa clara counties, combining the two counties. evan low wins the race for second place over joe simitian by five votes, five in all, 182,000 ballots were recounted. the process took two and a half weeks. the final part of it took place today in san mateo county, where voting officials decided that seven of the 16 challenged ballots met the conditions to be counted. this means joe simitian finished third and is eliminated from the race. evan low says he's excited to move on to the general election, and sees this as a reminder that every single vote counts. well, i'm excited about the opportunity to continue the legacy of congresswoman anna eshoo. when you look at the results of the primary election, only about 38% of voters actually cast a ballot, whereas we expect in a presidential general election, close to 80. and this is an opportunity to build the type of support from a wide variety of different voters, including that of younger vo

san mateo county plans to build affordable housing for coastal farm workers. e county board of supervisors today unanimously approved spending nearly $6 million for the project. it will prioritize families displaced by that mass shooting that killed seven people last year. the plan calls for buying and installing 47 manufactured homes for farm workers and their families. the homes will be located on five acres right near downtown half moon bay. cinco de mayo celebrations in san jose over the weekend were largely successful, but police say there were still a few problems. the department says it received more than 2100 calls from friday through sunday, and while celebrating, were taking place across the city. most of the disruptive behavior they say, was not related to any organized events. officers responded to several misdemeanors, felonies, reckless driving incidents and illegal sideshows. one resulted in an officer being injured. we had officers who were getting bottles thrown at their vehicles and at them we had officers who had been assaulted. >> we had peo

now, the second place tie could be broken on wednesday after san mateo county reviews 16 ballots in its recount. >> the likelihood of different outcomes has now changed. but really, what has happened overall is that everyone of their vote. >> a recount was requested on april 9th by former sam liccardo staffer jonathan padilla. any voter can request a recount, and santa clara county says , and tr says human error miscalculation by machine operators. melissa michaelson is a political science professor at menlo college. i think this really just opens up a huge pandora's box of folks thinking, well, maybe those election results are wrong and making people question election results and wanting to know more about whose votes were counted and whose votes weren't counted. the santa clara county registrar of voters says 45 uncounted ballots were challenged. of those 45 ballots,ed or subtracted to theta, and the remaining ballots were not accepted becausere either received too late. the signatures didn't match registration cards, or they lacked citizenship certifications. >> the whole thing is ve

the recount found no change in san mateo county, so for now, low is ahead by four votes., if this stands low, will face former san jose mayor sam liccardo in november. but it's not over yet. there are 16 ballots still in their envelopes in san mateo county that have never been counted. those votes are still being challenged. ballots arrived after the deadline, and both the county and postal service are investigating the postmarks on those envelopes to decide if they should be admitted. what what they have to look for right now is there a full postmark, are there may be two, which sometimes can happen. is one, what about a postmark that isn't fully stamped? only partially. what do you do with that? what do you do about the ballot without a postcard? in which case you have to go back and you can trace it. the post office can trace these things as to where they came from. the recount was requested by a former liccardo campaign staffer. after weeks of steering clear of questions, liccardo issued a statement today saying, quote, i did not request this recount. neither i or nor

two years ago, the san mateo county district attorney's office says 35 year old miguel ontiveros was on duty with a partner in december 2022. they were dispatched to a nursing home in colma to transport a 76 year old woman who had fallen well. investigators say during that drive, ontivero sexually assaulted the woman in the back of the ambulance while his partner drove the vehicle. now, they say his partner didn't see anything happen, but discovered his partner dressing when they arrived. ontiveros is also accused of a similar assault against an 80 year old patient about six months before that, we're told he's now pleading no contest to sexual assault and battery charges. is currently in jail and is likely to stay there because bail is set at $3 million. a new plan of action to tackle the big money mess of the san francisco unified school district. the state education department is temporarily taking control of distric spending, and last night that team presented to the school board at overall declining enrollment and millions of dollars in lost state and federal funding are to blame
