sanjay gupta. >> it's interesting. you have many states as you mentioned, many people.e one thing they all had in common was they had vaped recently. and now the next part of the investigation is what exactly were they vaping and what was in those -- the substance that were in that vaping device. so this is where they're sort of zeroing in. in new york state, they found that the samples in the people who subsequently got sick, when they tested those samples, they found something known as vitamin e acetate. right? that's a supplement people are familiar with. you can ingest it, take it as a pill. you can put it on your skin. the concern seems to be when you heat this you vaporize it. it decomposes into maybe other chemicals. gets into your lungs. then because it's a grease oily-like substance, it may start to recongeal in the lungs. it's a tough image to consider, but that's where the investigation is sort of headed. these are the symptoms. you see them on the screen. most people are not getting sick and ending up in the icu but they do develop sometimes significant symp

sanjay gupta and the former fda commissioner dr. david kessler. re's where i start. what exactly is the trump administration going to do and can they do it by edict? >> it sounds like they can. the way that this typically works is before you sell a product like that you've got to get a pre-market approval. you have to basically say here's what we're trying to do and get approval to actually market it and sell it this way. the fda has been kicking the can down the road on this issue for some time saying we'll get to it. we'll get to it in 2020 was the latest that we heard and they're basically saying, no, we're going to enforce this and it sounds like if someone applies for approval for these flavorings, they're not going to get it. so in effect, that would be clearing the flavoring. >> so dr. kessler, to some it seemed so obvious and it's a huge problem and everyone at this point knows about it, right? they see it and i don't know, at least for me everyone knows you don't make fruit-flavored, you know, e-cigarettes unless you're trying to market to

sanjay gupta. a criminal probe? what is this? >> the fda has this authority. it's a division of the fda, an arm of the fda that can start looking into this from a criminal standpoint. the reason being that the numbers going in the wrong direction. let me quickly show you on the map what we're talking about here. some 39 states now affected. the virgin islands affected. you have 530 people who have gotten sick. and by the way, when we say gotten sick, we mean seriously ill. they go in. they have breathing problems. they get a c.a.t. scan. it shows abnormalities in their lungs. they prove that this is not an infection, that this is something else. people are quite sick and as you mentioned now an eighth person has died. started vaping in may. hospitalized in august. transferred to another hospital in september and we know died shortly thereafter. these are all the states. we know this eighth gentleman was someone in his mid-40s. had started vaping for pain. that was something that an important clue because it also is quite likely that he was not vaping just nico
