. >>> joining me right now is attorney sara azari for more on this.ink he's covered by executive privilege and it's continued to come down to executive privilege in the bounds of that presidential power. what do you think of the trump team's legal argument here that it's executive privilege or if they allow it they should go document by document? >> i mean, kate, i think at this point i just shake my head and chuckle because they're on repeat, these arguments have failed. at some point an appeal becomes a lost cause. this was a lost cause from the beginning. number one, former president trump does not have the executive privilege. it belongs to biden. biden has clearly said that there's no reason to invoke it. secondly, no privilege is unlimited under our constitution. every privilege has its limits, and the crime exception is one that i think that applies here. we've never had an insurrection. this heinous crime against our democracy, which frankly trumps any kind of interest that, you know, trump might be alleging here. but we have to remember that

as we're watching this, jim, i believe we have sara azari with us, defense attorney, and anne bremnerwell. it's always interesting, right, when a defendant takes the stand as a witness. we have three defendants here. we have different legal teams at the same time for the defense. sara, i'm curious, do you think based on what we're seeing with travis mcmichael, grekry mcmichael, and william bryan will also take the stand? >> not necessarily, erica. you know, i think the fact that the defense put up travis mcmichael first, he was the shooter. he was the one that shot and killed arbery. and he was the critical witness to establish self-defense. so even though they're all apparently claiming self-defense, to the extent that the evidence will tell the story, i think it's best not to put your client on the stand because look at what had happened, you know, in the course of this cross-examination. it's a very big risk to put your client on the stand, but of course with self-defense, sometimes that's the only way you can tell the story, and of course you also want to humanize your client. so

we have judge glenda hatchette and sara azari with us. there's a statute in the state that allows a 16- or 17-year-old to carry a long gun in public. prosecution says it should only be for hunting. this count now, judge, was dismissed. just walk us through what we just heard and why this is so important. >> yeah. it's very interesting to follow that because at the end of the day, we still have to remember that kyle was not licensed to carry that gun regardless of the barrel. so you heard them talk about the length of the barrel because they're referring to the statute and count six being dismissed. but really what the prosecution really had to be able to show -- and i think is going to be confusing for the jury -- is that still, this is a kid who came across state lines, was under age, should not have had the weapon in the first place and should not have been in possession and that his possession in itself was illegal. so it will be interesting to see how that plays out with the other jury instructions that are going to be given. >> sara,
