sara murray back with us outside the courthouse. what have you learned so far?eporter: well, the judge has kicked off today's proceeding, encouraged everyone to maintain decorum and acknowledged a number of the letters she received before sentencing, which is customary before. she acknowledged letters from friends and family of roger stone who asked the judge for leniency. she also acknowledged other letters she received, the judge received a number of letters posted of people who asked for a harder sentence. jackson said i have read and appreciate all of the letters. she also noted for those of you who woke up last week and decided sentencing guidelines are harsh, she said, you know, courts and defense lawyers have been acknowledging this for some time. we have seen the president out there talking about how the idea that roger stone could go to jail for seven to nine years or at all would be too harsh. we have seen fox news commentators making the same point. the judge seems to be offering a wake-up call to all of them. >> there's that. sa sara, thank you very

cnn political correspondent sara murray is outside that courthouse in d.c. ere roger stone is asking for a new trial, and sara, i can't imagine this is helpful. >> reporter: yeah, i don't think it's going to be super helpful, and you know, the president is traveling back from india, and it's unclear if he's getting news of what's happening inside of court right now, but he did, he tweeted that there's rarely been a juror so tainted as the forewoman in the roger stone case. he alleged that the juror is biased. he alleged that the judge is biased. he's peddling more falsehoods like roger stone didn't even work on my campaign. that is a lie. this is all happening truly moments after the judge was citing the president's tweets and citing segments on fox news attacking this jury and the foreperson specifically. that's part of the reason that the rest of this hearing that she's holding today we can only hear the audio of. we can't see any visuals of. it's possible that the judge is going to have jurors in there testifying. we are not going to see them. she's banned

cnn political correspondent sara murray joins us now. here and i hate to ask the question, but i imagine a pardon is always on the table. >> well, look, jim, that's not an unreasonable question to be asking at this point. i think seven to nine years would be a stiff sentence for roger stone. he certainly doesn't have great relationship with the judge who is overseeing this and who will be overseeing his sentencing next week. prosecutors are asking, you know, for a stiff sentence here. that is not what roger stone or his attorneys believed he deserves in their memo to the judge. they asked he serve no jail time, that he just get probation, so these are the two things the judge is going to have to weigh as well as all of the letters that roger stone received on his behalf. one of the interesting factors here is that prosecutors take this witness tampering charge very seriously. this is one of the reasons they asked for such a stiff sentence. the man at the center of this has written a letter to the judge saying he doesn't think roger stone

cnn's sara murray joins us from washington. what's going on? >> reporter: this is extremely awkward. a senior justice department official is talking to our colleague at the justice department saying they were shocked to see the sentencing recommendation from roger stone from the u.s. attorney's office, asking them to put roger stone behind bars for seven to nine years. a senior dmj official saying it's extreme and excessive and grossly disproportionate to san antonio's offenses. they say they're going to clarify what they believe his sentence should be with the court later today. the senior doj official says the department felt this way long before the president's tweet last night where he defended roger stone, where he said this was a miscarriage of justice. you look at the timing of this, how awkward it is, to have the justice department coming up gonzales the d.c.u.s. attorney's office and a lot of people will walk away with this is bill barr, the president's justice department weighing in to benefit the president's long-time political advis

we have our sara murray and evan perez outside the courthouse here in washington, and evan, i want to start with you. the attorney general said ultimately the decision lies with the judge here, judge amy berman jackson. just break down this decision for us on the seven counts and how she explained her sentencing decision. >> reporter: well, brianna, one of the things she said was she wasn't going to listen to the prosecution's memos, the memos that became so controversial. you'll remember the first one recommended seven to nine years. the second one said we leave it up to the judge. the judge says, i wasn't going to go with seven to nine years. she ended up at 40 months, which is about three and a half years in prison. and she said that's where she was going to go all along. but she did have the prosecutors talk a little bit about what happened behind the scenes. they said it was a miscommunication. she assured the judge that there was no political interference that played any role in the decision to seek a more lenient sentence, and then she really laid into roger stone, describing w

let's start with sara murray. she's in washington. that stunning news is coming as cnn, sara, has learned that there could be more resignations in the department after this whole stone controversy. tell me more about that. >> reporter: that's right. i think when you look at our colleagues reporting here and then the "new york times" reporting, you really get a sense of this uneasiness and this unhappiness that is spreading among justice department officials and prosecutors in particular. you know, our colleagues here at the justice department are reporting that other officials are weighing whether or not to resign after what we saw happen with roger stone's case, which is that main justice decided to intervene. they asked for a more lenient sentence for roger stone and the four prosecutors who were working nowor working on that case withdrew themselves from the case. there's concern about the political retribution playing out. we see that jessie liu resigned. and her position was yanked from underneath her basically because of her role

senior justice department correspondent evan perez with us along with cnn political correspondent sara murray and former federal prosecutor elliott williams and senior department of justice official, evan, says the department was shocked by the sentencing recommendation. tell us about this. >> this is incredible. this never happens. the fact that the justice department is disavowing and sharply criticizing a recommendation, a decision made by the justice department, it just never happens. what we have to unpack is what's going on behind the scenes. clearly bill barr, the attorney general, did not realize this recommendation for seven to nine years which was made by the u.s. attorney's off sfis here in washington, that that was the recommendation being made and clearly the president's tweets are an issue here. it makes it very unusual. the justice department officials are telling us the president's tweet had nothing to do with this, but it's really hard for us to sort of divorce the two things, right? i'll read you a little bit of what the senior justice department official is saying. she says

with me is cnn correspondent sara murray and also chen, and tell us what you know about how unusual this> it is very unusual to go in to review and he is effectively taking the case away. >> and what do you make of the barr's declaration to tell the president to stop tweeting, and trump is reportedly angry about andrew mccabe not being sentenced? >> well, with 20/20 hindsight, it is camouflage for what he doing. i have had doubts a of the sincerity at the time, but what he is saying of trump is that i don't want to be independent of you, but he is saying, don't worry, i am asserting control over your cases, and that is all he is saying. >> and andrew mccabe not being charged. and so he saying that that he was not involved in the case, but overlooking the sentencing within his purview of the attorney general. >> it is not unusual to have the disputes, but it is after the prosecutors have submitted the memo with the judge and then out publicly to say we don't belief in this and the initial statements from top doj officials on the background were critical of what the prosecutors had done. a

i want to bring in our sara murray to discuss this. te tell us what you're hearing about that. are there going to be more resignations, sara? >> it's certainly possible. there's a lot of unhappiness and uneasy at the justice department right now over the way that this roger stone case was handled. as you pointed out, there were four prosecutors who pulled themselves from the stone case. one who resigned from the justice department entirely. and people are looking at that situation very warily. we could see some additionresig. they're looking at what bill barr did and concerned about main justice intervening in politically sensitive cases. that's part of what's fueling this. we're also learning about other resignations that are going on in the trump administration right now. jessie lew resigned. she was at the treasury department. she had moved over and she had been nominated for a top job at the justice department and that was yanked because her former office oversaw the roger stone case. you know, with that nomination no longer on the table, she opted to resign. i think we're b

let's go to our political correspondent sara murray who joins me. they will have a conference call with the doj, with the defense for roger stone. this as the president calls for a completely new trial. >> reporter: well, the president is not just calling for a new trial, roger stone has filed a motion with the judge, under seal, asking for a new trial. we don't know exactly what his reasoning is there. and this is the first time that amy roman jackson will have a chance to talk to both after the four prosecutors who were originally on this case withdrew. it is supposed to be a scheduling call, so you would think they would have a discussion about the sentencing, that is set for thursday and whether it is possible for every party to move forward on that time frame. but she is the judge, overseeing this case. she can ask the parties on the call whatever she wants about what transpired in the last couple of weeks. >> threat's that, we'll see what happens there. on top of this, there is a group of more than a thousand federal judges now calling an emer

cnn sarah murray is joining me. now, sara, some of the jurors may have to testify?ing on? >> yes, some of them already are. and looking at the twitter attacks and the judge warned about if ten shall harm for jurors if they are identify and pointing to the president's twitter feed, and he tweeted after she said this, rarely so much a juror to be so taied as in the roger stone case. and she was totally biased as is the j.j., and the president is insisting this is a miscarriage of justice, and what the judge is trying to do to get to the bottom of the request for a new trial by stone. this is based on the allegation of juror misconduct. it is like the television reveal, but we could not see it, but we could hear it. and so she said i have 11 members of the jury that i have called today. and dr. amy berman is asking how they reached the conclusions, how did you pick the foreman for the panel, and now she is moving on to find out if any of the four-person journey is biased and it has been dramatic as far as court days go. >>> and now, just saying that representative schi
