i but i want to get to cnn's sara sidner also in the crowd. sara update us if you will. >> reporter: yeah, we're here on west north avenue and pennsylvania. i want to give you a look at this. you've got a large group of folks here. it really feels more like a block party. people are out here. they've all got a message, but the message has been one of peace. and we did haefr some of the protesters talking to one another, when someone came up and started talking about going to jail tonight and all these different things another protester said no that's not what we're doing. too many black people have gone to jail and tonight when that curfew comes at 10:00, that everybody should go home. there are messages being given here but i want to give you an idea about how many people are out here. there are hundreds of people that are still out here. they're out here dancing talking to one another sharing a message. their frustrations they say are finally being heard, and people feel vindicated with what has happened with the charges that these officers a

sara sidner has got the latest on that. sara when you think about what happens when you get on an amtrak from washington new york. you probably take off your shoes, take out your laptop put your bags in the compartment above. there's a lot of stuff flying around through that train. >> reporter: right. you're not wearing a seat belt. sometimes, people are able to lie down across the seats comfortably, you know, an evening trip. you know we heard from some of the folks inside some of the passengers inside just how they were feeling during all of this and what they felt as they were coming around the curve. and i want to give you a look. we've made it on to the tracks. and we're standing right next to the tracks where this train was traveling. you can see the train is still there. you can see the last car there leaning way over to its right. you can also see the curve there. we heard from some of the passengers that they felt themselves going around that curve. and that's when things seemed to go all wrong. passengers talking a

we have more from sara sidner. >> reporter: the clean up continues along the beaches. we still smell crude oil. there is still plenty to do and it will take a week before they begin to open the beaches here. we should talk about what is happening with the company in the past. they have a checkered record when it comes to dealing with their pipelines. about ten years ago they had between 2004 and 2007, they had a series of ten spills in states across the country. kansas texas and louisiana. those spills culminated in a settlement with the government and justice department. they settled for $41 million. that $41 million was supposed to go toward paying to upgrade about 10,000 miles of crude oil pipeline. the company says it did that and safety is a priority. certainly we're seeing again a problem here with that same company. we asked a lot of questions, but did not get answers when it came to their record. john christine. >> sara sidner more questions and more answers coming on that for sure. >>> emergency officials in north texas urging people who live in wichita falls

thank you sara sidner. it is 33 minutes after midnight on the east coast and we are dealing with the awful news coming from philadelphia. basically they are saying it was pretty routine and then all of the sudden chaos, all hell broke loose. >> it's not a story that the passengers haven't told before. it's extraordinary to me how composed all three of them were and how well they handled what was clearly, you know, just a terrible situation. i'm always impressed with that. you know, i think we have discussed -- we're going to look at speed. there is an event recorder on the train. it will record how fast it was going. it will record whether the engineer applied brakes. they will match it up against the speed limit for the area. if it was crossing switching areas, they will look at whether there was any malfunctions on the switches. they will see that. that's a pretty easy determination to make. i think that the team will have something important to say by tomorrow night or the next day afterwards. when these

. >> of course, sara sidner is live in philadelphia. it's been three hours and 17 minutes since this accident happened. what is going on there just after 1:00 in the morning? >> reporter: we have been watching investigators walk up and down the track, particularly where there is a curve in the track and then right beyond that curve you can see the last car that is on its side derailed. we also understand that one of those cars is split in half almost. a really awful scene and we now know according to the mayor, five people have died in this accident. there were 238 people on board including crew members. about 50 people hurt in total. many people did walk away from the crash. i want to give you an idea of what the scene looks like from our vantage point. we are standing next to the tracks where normally this train would be commuting from washington d.c. to new york. this particular train was headed to new york city when it derailed. it crashed in what is known as the port richmond neighborhood. there is a lot of vehicles that are all st

i want to go now to my colleague, sara sidner. you and i were out on the corner of north and penn last night as the curfew hit, and some people refused to abide by it. we saw some arrests. we're now learning 46 arrests last night. what's the expectation tonight now that the curfew has been lifted? >> reporter: look the expectation is you won't have as many people out in numbers and if they are out in numbers, that they will be very similar to what they were like during the block party. nobody really knows until nightfall, right? want to show you where we are. this is the same area where we were yesterday, north and pennsylvania. see the cvs that sustained damage and loots inging. since then in this neighborhood there has been a lot of peaceful protesting most of it peaceful. there were arrests last night because when the curfew came the police warned several times and started taking people in and sometimes forcibly. i want to let you hear from a resident who's from here who lives just down the street from this very intersection. l

sara sidner joins us from baltimore. and so the motion for the recusal of mosby, what is the latest on it? >> reporter: it spells out five conflicts of interest and things that the lawyers see as a conflict of interests. we've heard from them from the police union. i'll let you know what they are. this is a 109 page motion so there is a lot in there. it talks about mosby and her husband, nick mosby, a council member who is in charge of the district where freddie gray was killed. the motion is basically that she is giving him a political advantage and getting political gain all of the fact that he charged people because people in his district were chanting that and wanting the charges to go forward against the officers and that she has a personal relationship with potential witnesses that her office also took part in investigating the case against the six officers. and there is also this pending civil lawsuit against her department and her office that was talked about. and lastly there is -- and this came up again before

let's get more from sara sidner. >> reporter: the clean up continues on the beaches of santa barbara.they open the beaches here. we should talk about what has happened with the company in the past. they have a checkered record when it comes to dealing with their pipelines. about ten years ago, they had between 2004 and 2007 they had a series of ten different spills in states across the country. including kansas texas and louisiana. those spills culminated with the settlement with the government and epa and justice department. they settled for $41 million. that $41 million was supposed to go toward paying to upgrade about 10,000 miles of crude oil pipeline. the company says it did that and safety is a priority. certainly, we are seeing a problem here with that same company. we asked a lot of questions, but we did not get very many answers when it came to their record. >>> sara thank you. this is a 24-inch rupture in the pipe. they are investigating what happened here. the oil is flowing into the protected state beach. it is so sad. the company has had settlements and fines in the past.

sara sidner is outfront tonight. how serious are the charges against the prosecutor? >> reporter: well the defense certainly think theys they're serious. if you talk to some people they say those will get thrown out. we'll have to wait and see what the court does. i want to go down through a fuf of the things that are listed. this is a lengthy document. some the things mentioned we knew about, the husband that's a councilman mr. mosby is a councilman in the same district where they live and where gray was killed. a lot saying hey, this is a conflict because she could give personal or political gain to her husband because she did the charges, that the community there wanted. also that she knows some of the witnesses, has a relationship with the witnesses. that is one of the charges. that these defense attorneys are making. that she has this personal relationship with the gray family attorney. that being a big one that she would not be able to separate trying to please this attorney because of their personal relationship. her husband also of course having a personal rel

sara sidner is at a rally planned for tomorrow. what more do you know about it? >> reporter: look they are supposed to have this ready and calling it a freedom of speech rally round two, because it is the second time they've done this. but before the rally outside of the islamic community center and mosque they are going to have another drawing contest of the prophet muhammad a car toob drawing -- a cartoon drawing contest and after the cartoons are drawn and the depictions are made they are to bring them out here and they will use those in the rally. they are encouraging people to do that. they are encouraging people to do that and they say something on their facebook page something different they said last time. let me read to you what they are telling people. they are saying it is peaceful but to utilize the second amendment right at the event just in case the first amendment comes under the much anticipated attack the second amendment, the right to bear arms and the second the freedom of speech and they are encouraging people to bring arms with them in case t

sara sidner is out front from santa barbara. dead animals, wildlife drenched in oil are incredibly disturbing, hard to watch. are they going to be able to save any of them? this is just horrible looking at this pelican. are they going to be able to save any of them? >> reporter: yes. they have five right now that they've rescued, pelicans that they say are very stressed out as you might imagine, they are covered in oil but they're trying to get them cleaned up. they also have a young sea lion that they have taken into a refuge that they are saying is about 35% of its body covered in oil. they're going to try to clean that animal up as well. we also noticed just earlier today there was a dolphin out there swimming in the area where there is still an oil slick. so obviously there's going to be a lot of animals who are affected by this and never mind the flauroura and fauna, we can see oil around the coast. you can see it spotted all along the rocks. it is a big task but they're definitely going to be able to save some of these ani

sara sidner goes inside the gangs for us. >> it's definitely on now. >> reporter: this man is in a position to know just how dangerous biker gangs can be. cloaked in darkness he agreed to speak with us. he said he spend five years infiltrating three gangs for the dea. how would you describe how they operate? >> highly -- >> are they different in the way they operate? >> they're very similar. very sophisticated, structured like the military. a lot of members are ex-military. so they're highly trained for combat. they're much better than your average street gang at conducting war. >> when you talk about war, who are they warring with? is it just other gangs? or is it society at large? >> i'd say it's society at large and mostly other motorcycle gangs. >> that's terrifying. >> yeah. when i did one infiltration half my chapter was ex-marines. so they're highly skilled, highly trained killers. >> charles falco now consults for law enforcement on biker gangs, and said just a month ago he was asked to go to waco because of growing tensions between two gangs. the bandidos and the cossacks. >> the b

let's head back to philadelphia right now and check in with sara sidner covering this accident for us. you've been talking -- rene marsh will join us as well. i want to start with you, sara. you have been talking to people in the surrounding area. what are they telling you? >> reporter: they talk about the light that came from the initial crash. they could hear it as much as that light was very visible to them. there were several blasts of light that came off this. i'm going to move out of the way of this camera and let you get a glimpse of what is going on right now. they are really trying to put one of the trains onnen the track. there is a crane there that was cles to close to it. there is a tractor that showed up on the scene as well. you see the investigators some on top and some on bottom checking out these tracks. i think they were checking them out to make sure that particular train that has the crane on it could actually go on part of the track because right after that curve where it is sitting you will see the train itself. interesting to note it seems that it is still not a

i want to go to sara sidner joining us from the area of the city on north and penn where there have beeno many protests and where violence happened earlier this week. sara the city has lifted the curfew. there is no curfew tonight. what are people there telling you they're expecting? >> reporter: you can certainly see what's happening here. i mean, there are no crowds. i want to give you a look around just of the area. this is pennsylvania going here and north going this way. and you can see, i mean this was absolutely jam packed with people. there was no traffic here at all yesterday around this time. there were hundreds upon hundreds of people who had converged in this area and stayed until the curfew. most people leaving at curfew time and then some issues after curfew when police went to arrest those who were still out. i also want to let you talk to a community member here who lives just up the street. she's been here for 51 years. her entire life. her name is yvonne thomas. thank you so much for being with me today. you and i were standing just down the street as this entire area w

we want to get to the ground where our sara sidner was right in the middle. >> reporter: this is thesed but what some didn't expect there would be two different sides on this rally, you've got the side 0 my right which we'll visit in a moment. but this side, the majority of people, holding signs "love your neighbor as yourself" quoting matthew. of and lots of folks are here isn't support of religious tolerance with the folks of these mosque. the other side of this police line which has just built up, the other side professing something different. i want to show you -- excuse me, sir -- i want to show you what is happening with the group that got all this together, that organized this, they are hear, holding american flags. movie of them being quiet. but there's a different message here. that message, right here, this gentleman holding the sign here, he is saying that islam must be stopped. and they have been yelling back and forth across the police line here. they have their love signs out and they are here to try to show people that america is about tolerance. that's the scene right

sara sidner is at the track. same city but a very different situation. so was there ever a feeling or has there been a feeling that today's running of the preakness is a turning point for baltimore? >> reporter: i don't know if it's a turning point, but it's certainly bringing a different kind of energy to the ske. we talked to some of the folks who lived around here. we're in northwest baltimore, a ways away from where the major unrest happened. but in talking to some of the residents, there are going to be protests today. not here but downtown. there's a planned protest in half an hour. a lot of folks around here say, look we need to get back and bring baltimore together and this whole initiative called one baltimore. this is kind of what this is all about. i'm going to give you a 360 look at what is going on here. there are thousands and thousands and thousands of people here. lots of folks from all over the place who are here. some folks here to bet, a lot of folks here to wear their fancy hats and great outfi

sara sidner is in baltimore with the latest.know that the police association has called for this. now the attorneys for the six officers charged in the case of the death of freddie gray are now asking and filing a motion to try and get marilyn mosby's office to recuse itself or remove itself from this case. the motion is a lengthy motion it cites several different things including a conflict of interest, a conflict with her husband, who is a councilman and represents the district in which gray was killed. saying that could give her political gain or at least him political gain because that's is what his constituents want to see, a charge against the officers and a conflict because they both very well know the attorney representing freddie gray. this is happening as the doj announces it's going to investigate the baltimore police department. >> the probe announced by the justice department will look into the baltimore police department's practices and procedures. >> the investigation will begin immediately. and will focus on alle
