in a moment i'll speak with sarah's aunt.l speak with chris o'connell live outside the philly hospital. chris, good news after some pretty difficult days. >> reporter: yes, sean. 10-year-old sarah murnaghan has new lungs tonight. the little girl who captured the hearts of many around the world is now in a recovery room here at the sixth floor at the children's hospital in philadelphia. her family members say the double lung transplant was a success. her family members came out about 8:30 eastern time tonight telling us the transplant was success. she is in a recovery room. she's in the intensive care unit. it was a double lung trance plant after the life-saving call came about 10:30 last night. having sarah and her family rush to the hospital to receive those lungs and a six-hour surgery today. the little girl from outside philadelphia suffers from cystic fibrosis. she really fuelled the debate over transplant rules for children. she was a very sick little girl. he family says she had about a week to live without this transpl

soon after this video is taken, sarah's condition worsens. a tube is inserted through her mouth to help her breathe. >> i'm not going to tell her she's dying. >> reporter: an emergency meeting takes place and the board grants a one-year change, allows all children to be placed on the same waiting list as adults. the family then gets a call they've been waiting for. wednesday, one week after being placed on the same list as adults, sarah undergoes a lengthy surgery for a new set of adult donor lungs. >> that donor is her hero. our hero of this story. but she wouldn't have had access to that hero if it weren't for the change. >> reporter: sarah's mother said at the start that she was going to fight for the next person's kid. as it turns out another child from sarah's hospital javier acosta was also wait for lungs. his family followed in the murn what nan's footsteps and filed their own lawsuit. he too a waits lungs on the list. >>> a pastor in georgia gives a local boy scout troop the boot. but find out what a snabing boy scouts did in response

so now that people like sarah, children like sarah, another young man there as well, a little boy is1 years old in the same situation, from now on these children will all at least for the next year have access to adult lungs based on meeting certain criteria. it is a huge, huge step for the family. last week they had a huge legal step, today a huge medical step. now sarah heads into surgery now that she has received a donated lung. >> jason, such an emotional issue, such a complicated issue for so many people. i think obviously 30 minutes before she heads into surgery, everyone's thoughts are with her and her family. i know you just spoke to them. do you know if it was a child's lung or was it an adult lung that is the donated lung? >> reporter: good question, we're just getting this information now. no indication of who the donor was, but what we can tell you is that obviously when you get a donation like this, it is from someone who has recently been deceased. don't know if it was an adult or a child. just getting the information that she received the word last night at 10:30. they

we wish sarah and her family the best.he was a very sick little girl and has a challenging road ahead. our chief medical correspondent sanjay gupta joins us now. a lung transplant, how difficult and complex of a surgery is that and how difficult is the recovery? >> the operation can depend, as you just heard from her mom there. this was what's known as a low bar transplant. so instead of transplanting the whole adult lung, they took specific lobes of the lung. this is usually just because of a size issue. so you take particular lobes of the lung and size them and make them fit, and you heard in the statement there that that part of the operation went pretty smoothly. from sort of beginning of the operation to the end, it was about six hours so that's pretty typical, in terms of the length of these operations. so it sounds like that one is straightforward. her recovery over the next couple days, she'll have the breathing tube in. over the longer run, this is a girl who still has cystic fibrosis and will need medication to s

i know that sarah clearly is very seriously ill. so much so that her parents at her bedside tonight. and the condition is very serious. how important is it to the family that you've managed to have this legal success? >> it is incredible for the family. this is the thing that could save sarah's life and allow her to live a long life. ten days is hopefully enough time for her to get lungs. she is very ill and it should put her at the top or near the top of the list to get lungs and so we're overjoyed. >> for those who have not been following this, explain to me exactly the dilemma you found yourselves in. >> yeah, it's pretty simple, oddly. they have a list of people waiting for lung transplants and they put all of the adults in the front of the list and the children in the back of the list. and what we asked for is the children to be in the same line with the adults, and to receive lungs based on how sick they are, just like the adults do. so we asked for equality for children. >> and the way they assess this is everybody gets a rat

never. >> reporter: sarah's parents also are not quitting.ment refused to intervene. >> somebody needs to stand up and say this isn't right. this is a human issue. this isn't politics. this is a human issue. >> reporter: even though sarah's at the top of the child's transplant list in her region and has been waiting for 18 months, federal guidelines disqualify her for an adult lung until she's 12, unless every other adult on the waiting list turns down a donor lung. in an e-mail obtained by cnn, health and human services secretary kathleen sebelius told sarah's parents, she's not authorized to intervene, but is ordering a transplant policy review, adding, quote, i know this is not the answer you were hoping to receive. my prayers are with you. >> she says i'm so sorry, i know this isn't what you wanted to hear. it is in her legal authority. we're going to let a kid die over red tape. >> reporter: it's a battle sarah shares with other children, comparing her lungs disease with cf to a boat filling with sand. >> close your eyes and pretend that

now young sarah is recovering.ous questions remain like, what does this case mean for all the other sarahs out there? that's what we're going to discuss. in is a tough case in many ways, from a policy perspective, even though it's an easy question from the heart perspective. you look at someone who needs help. they should get the help they need. the rules, however, have been built partly with a lot of input from the medical community saying we have to make tough decisions all the time. and adults fare better under this procedure. i have two big thoughts. one is that while i don't impugn secretary sebelius or the people operating under what is clearly an imperfect framework, i think we ought to have maximum flexibility between doctor and patient. and so in reading up on the case in the segment, i came across a lot of medical research about why this rule exists. but i would say it shouldn't be a zero tolerance rule. it seems to me it should be deference rule up. might defer to the judgment these kind of younger trans
