savannah guthrie, good to see you as always. thanks for stopping by with that. >>> overseas tonight in great britain, a turn of events that came as a huge shock in a story we told you about just last night. a scandal involving a newspaper, the nation's leading sunday tabloid newspaper, and allegations that they hacked into people's phones, all kinds of people. the outrage has been huge, all the way to parliament and the prime minister's office and today the media empire run by rupert murdock announced it is shutting down the newspaper for good. but that's not going to make this go away. nbc's mike tiabbi with us tonight from london with more. mike, good evening. >> good evening, brian. even among media watchers who have been transfixed by this story, there was one reaction i heard several times today, we didn't see this coming. the news of the world, the lynch pin of rupert murdock's media empire, gone as of sunday. >> reporter: the latest allegation that may have been the breaking point that grieving relatives of british solder

. >> our colleague savannah guthrie joins us from new york. savannah an attorney and our legal correspondent. tell us about the weight of all of this given if they come back with a first-degree conviction on either of those counts that we're talking about a capital offense and a second phase of the trial. >> sorry, andrea, i didn't catch that you were talking to me. that is correct. if it's a first-degree murder conviction then we have the penalty phase of the trial. it's almost like another trial again. the only issue being whether or not she gets the death penalty. there would be opening statements, there would be witnesses, there would be closing arguments. it would really feel like a second trial. it would be the same jury and i believe the alternates, there were alternates in this case they probably would be kept along as well just in case they were needed. the jury deliberating about ten hours. i have to say i don't know what your other guests have said, i just sat down here, i'm kind of surprised at how quickly this verdict has come back

and let me bring in our savannah guthrie who of course has beenle following the cases and the nuances back and forth and this has been explosive with the prosecutor and the defense team go at literally before the cameras and the judge having to pull the people over, but in the final days here, the closing arguments that we heard were powerful many say from the prosecutor who said, listen, you don't make an accident look like a murder. how do we explain this duct tape and three pieces of duct tape that ended up on this child's face? >> and the prosecutor said, who was connected to every piece of evidence in this case. it is one person, the defendant, casey anthony. another effective line i thought from the prosecutor is when she said, look, the defendant wants you to believe everyone else in this case is a liar except for the one person who is the proven liar in this case which again is casey anthony. so i thought that the prosecutors did a good job of streamlining the case, and telling essentially a compelling story of guilt. they had to pull together all of the various strands. on th

. >> bring in nbc's chief legal analyst savannah guthrie. savannah, so good to have you, because i know you so well and know how well you understand these things as an attorney and as a correspondent at the big level. this is a case that has fascinated a lot of people, including me. what did you think? as a reporter, can you even say that you were stunned? >> i have to say, i was surprised. the reason i was surprised is because how quickly the jurors came back with this verdict and the fact it was a wholesale rejection of the prosecution's case. i mean, the jurors had an array of charges to consider. everything from the top charge of first-degree death penalty eligible murder all wait down to just a straight charge of child abuse, and even though anyone watching this case could see the problems of proof the prosecutors were dealt. the fact we don't know when caylee died, or exactly how caylee died although prosecutors had theories that were consistent with the evidence, but the evident wasn't dispositive of those theories. at the end of the d

. >>> we're joined here in the studio by our friend from "today on nbc" savannah guthrie, former white house correspondent for us and long-time lawyer as someone that's covered a lot of these trials and you made a point with me earlier today about the law that i found so interesting. it applies directly to what we witnessed. >> so many people are disappointed and think -- how could the jury come back with "not guilty" verdict. i made the point that in the law. a not guilty verdict is not the same as a guilty verdict. as saying that casey anthony is innocent. we haven't heard from the jurors. but they may have been deeply suspicious of her. they may not like casey anthony. but at the end of the day they know the law requires them to have proof beyond a reasonable doubt. they go back to the jury room with thick instructions on the law from the judge. they have too find every element of the crimes charged beyond a reasonable doubt and at the end of the day it's clear they didn't think they had sufficient proof. >> and in court we never heard the means of this murder proven. >> at the end

simpson trial, author of "guilt by association," star jones and savannah guthrie, good morning.annah we've been talking the last couple days, you're walking around doing calculations in your head all the time. >> trying to do calculations. >> how did they reach the final time line for the release? >> the department of corrections knows how exactly they got from this four-year sentence. calculated about three years' time served, added in good time and what's called in florida gain time behavior of about ten days a month. but actually no matter how you crunch the numbers, it is hard to get exactly the math that they apparently got. and it is evidenced by the fact they've changed the date overnight, instead of being released wednesday she'll be released the following sunday. it shows there's a little bit of mystery to exactly how they did this calculation. the bottom line is she served three years of a sentence and did get good time behavior. >> marcia, take us into the jury room as we learn additional details about what that deliberation was like. jurors have now come out publicly

bring in nbc's legal correspondent savannah guthrie and jamey floyd. welcome, ladies. let me start with you, savannah. i must be the last man in america not following this case closely. were you surprised? >> well, you know, i think a lot of us thought the jurors would convict on something. everyone could see that the prosecution had some weaknesses in the evidence that was presented, because there were these fundamental questions about when she died. how she died. and for a lot of -- >> seems pretty basic. >> it does. one could see how that could lead to reasonable doubt. there were an ray of charges. seven counts. everything from first-degree, murder down to the basic child of child abuse. so for the jurors to not convict on anything, i think i was surprised to see that. because while there were questions in terms of the forensics, how the child died, there were powerful pieces of evidence. in particular, the fact that casey anthony said her daughter died june 16th and she did not report it for 31 days is absolutely no grief, no remorse, carried on, gallivanted around

savannah guthrie is today's legal correspondent. . >> good morning. >> the accuser in this case speaks out saying she wants to protect her side of the story. her lawyer gave a 20-minute news conference, talking about the events of that day. and some have started to question whether he has acted ethically at this stage of the case. there's a code of conduct for lawyers. rule 3.6a says a lawyer shall not make extra judicial statement or an extrajudicial statement that the lawyer knows or reasonably should know will have a substantial likelihood of materially prejudicing and adjudicative proceeding in the matter. basically you should not speak out and negatively influence a case at this stage. did he break that ethical rule? >> defense lawyers for dominique strauss-kahn came out and said this breach's lawyer's ethics, the rule you just read. it's always a gray area because defense lawyer is permitted to speak out on behalf of his client. and, in fact, that same rule you cite has what you could call a safe harbor provision, that says a l

we're going to break down the decision in a moment with savannah guthrie and star jones. we'll also hear from the anthonys' attorney as well, but first right to kerry sanders outside the courtroom. he's been covering the case from the beginning. kerry, good morning. >> reporter: ann, instead she could leave. i think she could leave today. that's because of the way the system has worked with gain time and good behavior time. an inmate gets five days a month for good behavior, and then another five days a month for working. now, she was not given the opportunity to go out like other inmates and pick litter, but she's still given that opportunity to get those five days if she is in the jail and not causing problems. the judge will be an expert on this, and he will return his word in about an hour, but it looks like they're working right now though determine how many days action if any, she'll go back to the jail and spend time in there. it's important to note for a period of time they closed the road here in front of the courthouse. the real question is, how do you release h

savannah guthrie is here with details on this. >> good morning to you, matt.the simple solution is the best one. two inmates tried to break out of prison through the front door. they attacked and overpowered a group of guards allowing one of the prisoners to briefly walk free. >> reporter: it was around 3:00 a.m. when two inmates were using the phones in an area just outside the jail's booking office. when a guard opened the door, mccluskey and archie rushed and tried o fight their way to freedom. mccluskey who is serving blor burglary and parole was quickly subdued. but archie ran out of the facility. he spent three days on the run. the walker county jail was built in 1980 and does not meet today's building standards according to the commission. 70 to 85 times a day officers use this door to enter the inmate area. in a facility built today, they would be separated by two secured doors can. though he showed some ingenuity in his escape, when captured 70 miles from the jailhouse, archie ran out of ideas. the escaped convict's mother was also arrested. >> what i

savannah guthrie is "today's" legal correspondent.good morning. >> good morning. >> it's hard to imagine a 6-year-old child being called to testify. can it happen? >> actually i have called children to testify. i had a murder case in brooklyn when i was in the homicide division and all of my witnesses were kids under 12 years old. one of them was a 7-year-old, as a matter of fact. the only question is to whether or not the child is swearable, meaning understands the difference between the truth and a lie and the ramification. how far, in an extradition hearing, the defense -- the fugitive, if you will, does not have a right to call witnesses. so we don't even know if she'll get to the stand. >> so the real question then is what will the point be that the judge will make his decision on? >> yes. >> and but how much does how crucial the defense sees her testimony because clearly as we just saw, the defense said it's crucial. how much does that play in his decision? >> it's not a trial. it's not meant to be a mini-trial other wise that w
