my amendment numbered 3808 which i have crafted with senators schumer and nelson would finally encourage competition and accuracy in an industry that has little of either. to stop the jockeying by raiders to get repeat business, my amendment would create a clearinghouse, a clearinghouse to sign a rating agency to a product issuer for the purpose of an initial rating. the clearinghouse which will be a self-regulatory agency called the credit rating agency board, will set up its own rules on how this assignment will work. it could be random, it could be formula based, just as long as the issuer doesn't choose which agency rates its product. this will eliminate the incentive for the rater to give an inflated rating in the hopes of getting that repeat business. the credit rating agency board would be compromised of industry experts, investors, issuers, raters and, of course, independents. the majority of its members would be investors, including institutional investors who have experienced managing pension funds and university endowments. they have -- they would have a vested interest in acc

this morning senator chuck schumer says he is worried about what happens to energy policy now because part of the compromise involved allowing drilling and now there will be great concern over this. what do you see happening moving forward with energy policy and the attempts to get climate change legislation done? >> let me point out that that one well in the gulf of mexico if it produces what we think it could which would be 50,000-barrels a day is worth 10,000 oil wells producing in onshore texas where the average production is five thousand barrels a day. we do not need to stop drilling for oil and natural gas in the deep gulf. we do need to make sure that the technology is the best that it can be, that the procedures are the best that they can be, and that our federal and state regulators maintain vigilance to make sure that those technologies and procedures are used as they should be. but we should not stop drilling in the outer continental shelf. it is the single biggest natural gas and oil resources, not natural gas resource, oil resource that we still have in the united states

my amendment, which i am introducing with senator schumer and nelson, would finally encourage competition and, get this, accuracy in an industry that has little of either. specifically my amendment creates a credit rating agency board, a self-regulatory organization tasked with developing a system in which the board assigns a rating agency to provide a product's initial rating. requiring an initial rating by an agency not of the issuer's choosing will put a check on the accuracy of ratings. simple. my amendment leaves flexibility to the board to determine the assignment process. but the board will be inclined to make the process one that incentivizes accuracy because the representatives of the investor community will make up a majority of the board. for example, pension fund managers and endowment directors. folks that have a vested interest in the aaa bonds they selected actually performing as aaa bonds. the board gets to design the assignment process it sees fit. it can be rand remove. it can be -- random. it can be based on a formula just as long as the issuer doesn't get to choose the

senator schumer, along with 17 co-sponsors, has proposed a similar bill in the senate, senate bill 3166, which i also support. however, these bills need certain changes to strengthen them. with respect to the house bill there is a 10-year carryback for theft losses. under existing laws, taxpayers can utilize the theft laws for 20 years going forward. however, elderly investors who have lost all of their savings and don't work have no ability to utilize a theft loss going forward, thus giving these people a 10-year carryback is only fair. the senate bill proposes a six-year carryback which is insufficient. both the house and the senate bills give a theft loss for i.r.a. investors. however the house bill is more generous than the senate bill, providing for a theft loss of up to $2 million whereas the senate bill limits the loss to $1.5 million. we have been infinitely generous to wall street, so it is long overdue to be fair to main street. finally, both bills are deficient because they preclude a theft law for investors whose retirement savings were in the 401-k plan or defined benefit p

harkin: i come to speak about an amendment i have filed, along with senators schumer and sanders, 3812. the purpose of the amendment is very simple -- to protect consumers from being charged unreasonable fees by a.t.m. machines. how often have you gone to an a.t.m. machine to access your own cash from your own credit union or your own bank and they charge you a couple bucks? $2.50, $2.25, $3, $4, we have seen as high as $5 in parts of the country. well, mr. president, i want to talk a little about that, how unfair it is. in recent years, congress has acted to protect consumers by setting appropriate limits on the types of fees that financial institutions can charge consumers in areas like credit cards and spurred by a good proposal by chairman dodd, the federal reserve is now considering rules regarding overdraft fees. one area that remains unregulated is the fees that consumers pay to use a.t.m.'s. by now, mr. president, there is no limit on the fee that an operator of an a.t.m. can charge a consumer for using that machine. currently, the only regulation in this area -- clearly insuff
