chuck schumer, already a powerful member of the democratic caucus.r this, but tell us about this power shift where he's really in a position to take the leadership role. >> he's right behind harry reid. he has eclipsed dick durbin. charles schumer has a job that will put him in charge of scheduling, policy and communication. not much left. >> office space. >> all right. before you think, well, this is a blow to harry reid, it's actually a strategic move that reid is engineering himself. said look, reid won his re-election. he's a person of strength and also a person who knows his limitations. and these 21 democrats and two independents who caucused with democrats are going to need a more reliable, predictable flow of policy, legislation and sound bites to prepare for a re-election of the president in 2012. only ten republicans are up. one of those seats, republican seats viewed as vulnerable. democrats have a lot of seats to protect. that's why charles is in charge. >> and we are familiar with his incredibly aggressive media shop. will he also be in

schumer has one out there for $1 million or less. other things that would be tied to temporary extension. where do you think we are on the possibility? >> two lines of argument that are current. one is you know what? you've got to have the tax cut in place to boost the economy. if you boost the economy, you do so at the expense of the economy. that's the line from the white house. contrary position from the republicans at this point, you need to stabilize the tax rate. it's predictable for businesses going forward. >> bret: keep it where it has been. >> yeah. that's the argument. previously the republican argument had been everybody should be the tax cut. no reason to do away with it. their argument shifted to the business ability stabilizing. it looks to me that they are going to win, republicans will win on extending the tax cut. schumer's effort to try to eliminate it to people making $1 million or less is attractive, but i think t counterargument about the need for stability and just lever it in place is going to carry the day. >

do both sides gain a little something if they go with the chuck schumer proposal? >> i think pat lays out an excellent program for them to actually consider. the question here is temporary versus permanent. i don't see how the white house and the democrats go for a permanent extension when the president and democrats argued throughout the campaign that to do so would mean that the government would have to borrow $700 billion in order to give tax cuts to the wealthy. >> let's not forget that the bush tax cuts can't pass without democratic support. it's not as if the democrats don't hold any cards here, right? >> the democrats will go, the house can do pretty much what it wants, it's still pelosi's house. what the democrats have to do they really want the rich, one way or another. >> however they define it. >> if they don't sun set those tax cuts now, they may never get it done because the new congress is going to be far more republican. so, i think their best bet is to get it done now. >> what is the risk in that? i mean, what did the american people send them here

senator chuck schumer from new york says it's not going to happen in new york last week. what does happen now? >> well, that looks -- i mean, it looks like schumer is right on this and that khalid sheikh mohammed probably will remain indefinitefully military detention here. this is obviously a huge blow to the obama administration. it's also a huge blow to eric holder. you wonder now if the clock on his time at the justice department is ticking in that, you know, here is our administration in the middle of all sorts of changes. internally at the white house, but you wonder if this gives them a chance to really turn the page from a lot of setbacks that they have had over the past years. >> bret: what does the left do to all of this? calling for the civilian trials? calling for guantanamo bay to be closed? >> well, i mean this will be -- i mean this will really confirm the right position which said this is a real danger to put these guys in civilian courts and really afford them some of the laws and protections that americans have. but i mean i think even the left has in so
