here to discusses is misty maris and scott casha. misty, explain why the charges from last year were dropped and is it an issue of new evidence to help bring this new indictment? >> yeah, fred, so here's the path that this case was on and this has been going on for a while. so last year, the charges were dropped when a special prosecutor came into the case and you had fresh eyes on the investigation and all of the evidence that had been collected. at that time, they dropped the charges without prejudice. that means they could be revived at any time. central to that edition was whether or not the gun alec baldwin was holding had been manipulated or altared prior to the time it was onset. the prosecutor said we have to investigate this. now in the fall, it came to light that there was a forensic expert report generated by the prosecution that found it could have only discharged if he pulled the trigger. fast forward, this case goes to grand jury and this case is viable again. so that's the path this case took. >> okay. so then what wil

how would this help prove scott peterson is innocent? >> my eyes went directly to that as well because there's long-standing defense theory in the case presented at the trial that laci peterson witnessed a burglary on the night that she was killed and she was kidnapped and killed by the burglars. that van, under the defense theory, is in connection with the burglary and there was a mattress with blood on it. the innocence project is looking to dna test that mattress. dna testing technology has increased tremendously over the past 20 years to see if there is any indication that laci peterson's dna is on the mattress so that is how it fits into the theory. if it is, that is an alternative theory the defense can raise about who could have done this. on the other hand, there was dna evidence tested at the time but because of the exponential difference in technology, they want to retest. something interesting is they say there's a lot missing from the trial records, the innocent project is looking for that as well. they are taking the approac
