nbc bay area's scott budman has new details from fremont. >> reporter: allegations that sparked a protest outside patterson elementary school in fremont this morning. claims that on april 28th, a third grade teacher slapped 9-year-old julian rivera after the student asked a question about a math test. >> i think it was more slaps in the face, from what everybody else says in the class. but they're trying to make it go away and let this teacher come back and move my son out of a school that he's been a part of and that i went to and my mom went to. >> reporter: julian's father joe organized the protest outside patterson after hearing that the teacher would be coming back to school today. that didn't happen. the fremont unified school district said he is on extended administrative leave as police investigate the incident. the riveras now have an attorney. we went to the home of the teacher in question to see if we could get his side of the story. he did not answer his door or our phone calls. >>> a nbc bay area follow-up, the pilot of a vintage plane told investigators he was passing a cess

. >> i'm scott budman. tesla dealing with dmantd issues by hoping up two new showrooms in the bay area. >>> new tonight at 6:00, some mixed news for tssla. shares of the pal os sprks alto company, stocks dragged down by more than 11% by investors who wanted more shares and challenges that tssla is facing. >> well, raj, one of the reasons investors sold today is that while tssla is selling more cars each quarter, the demand is higher than the output. in other words, they could be making more money. we got some answers today. >> reporter: the new cars are already getting looks, but tsslas are used to the attention by now. demand for the cars grows faster than they can be made. the company's stock price has quadrupled. >>> there are spoeed bumps. states like ohio, texas and new jersey who say tssla should sell to franchise dealerships rather than directly to buyers. >> this year, we will deliver 35,000 vehicles. pretty small compared to mo dealerships around the world. tssla says it has no plans to franchise.

scott budman joins us from casino matrix. what's at stake here for the city of san jose if the accusations are true? >> reporter: well, by some estimates, san jose makes as much as $15 million a year from casino related tax revenue. but now the city is accusing casino matrix of hiding some of its profits and there by denying the city its fair share. casino matrix is being accused of hiding its cards, or more specifically, its money, and now the city of san jose is calling. >> the message is pay up or shut down. >> reporter: san jose city counc councilman and mayoral candidate claims the casino is hiding as much as $60 million in revenue. >> they are endwanling in a fraud length pattern of conceal being money. >> reporter: we spoke to a casino matrix spokesperson who says that's not true. >> their accusations are unfounded, and we think that they will come out to be proven untrue. >> reporter: in addition to tax revenues, part, around 5% of casino matrix' profits go to a group that helps fight problem gambling. it says it's wo
