let's check in with scott budman outside of that courthouse. what are you learning, scott? >> yeah, it's what you said, laura and kris. the note that came back from the jury told the judge, we are unable ms. holme is accused of. we don't know which three the jury is hung up on. now as far as the very latest, we know the judge has instructed the jury to essentially go back and keep working. what we don't know, in addition to what three charges they are hung up on is what the status of the other eight charges are. they haven't come back with a note saying, hey, we've got eight completely unanimous. we're all in agreement. but on three we are in disagreement. all we know is that they haven't reached a unanimous agreement on three of the charges. now it's been 6 1/2 days. they're in day seven of deliberation so the assumption is that they have reached unanimous decision on several of the counts, if not eight. but they didn't say that. again, all they said was we are unable to reach a unanimous verdict on three of the counts. so without naming what those three counts are, the ju

today, scott budman has more on what is next. >> reporter: a dramatic picture as elizabeth holmes and her family walked past cameras and gauntlet, and her head down not commenting at all after getting what had to be pretty bad news for her. there were four counts she was found not guilty on and four counts she was guilty on and three counts they could not decide on. prosecuting attorneys had this to say about the outcome. >> the guilty verdicts in this case shows holmes' culpability. >> now i want to take you back in the courtroom where elizabeth holmes sat still and stared silently for most of the time when we heard the charges read back, and four found guilty and four not guilty and three deadlocked. holmes was able to turn around and hug individual members of her family before she and they were escorted out of the courtroom as was each member of the jury. the jurors were thanked by the judge for their service, and then they left the courtroom. as for sentencing, we hear it will happen sometime in the next two months. to wrap it up again, four counts where elizabeth holmes was found

let's bring in our business and tech reporter, scott budman, and scott, that line between exaggeration and truth being looked at very closely now in silicon valley. >> yeah, it's true. and it will be interesting to see if it shakes things up. now, first things first there, is still plenty of money flowing through silicon valley, but also a continuation of a trend we have seen here in the valley for years now. some skepticism among certain investors when it comes to funding female founded companies. in an area where the percentage of venture capital funding has already been low for female entrepreneurs, many here are telling us they're worried the failure of theranos will reflect not just on elizabeth holmes but on other start-ups with female founders. a study out of santa clara university showing that female founders are already passed over more frequently than their male counterparts, no surprise there. but a bay area venture capitalist who purposely seeks out female founders tells me she fears backlash because of the holmes verdict. >> unfortunately, there is rampant sexism still in

let's begin with scott budman who's been inside that courtroom. what happened today and what comes next? >> reporter: well, i'll tell you, raj and jessica, things were a little chaotic outside when holmes and her family walked out. and we tried to get comment from her, still stonefaced. she did not want to talk to anybody. she, her partner, her family walked out after being in the courtroom and hearing the verdict. ki i can tell you that in a court case that has been tense for months there was nothing like this afternoon when the jury verdict was read. it bounced around. and we weren't quite sure how this was going to go. and i imagine elizabeth holmes and her family was not sure how this was going to go. shy sat stonefaced for most of the time as verdict was read. i noticed the jury did not make eye contact with her as they came in or went out. it was that way for most of the trial. she would try to make eye contact with the jury, but they did not look back. after the verdict was read, the jury was thanked by the judge. holmes turned around and h

our own scott budman learned that the prosecutors will drop those three wire fraud counts. the sentencing is in september. we mentioned the frustration about covid testing. here's the real frustration. do we have any solutions? most stores actually, are still sold out. you see those signs, we are sold out of testing kits, lines are long and appointments aren't available for days. covid experts knew the sturge surge was coming. this letter was sent to the white house. they acknowledge that the biden administration and they have surprised the administration for ordering 500 million tests back in december, however, they said much more must be done. here's what they're calling for now. one, more rapid tests, so that every one of us can take one or two rapid tests a week. that means more than 2 billion rapid tests are needed. more testing sites in our communities and number three, making it easier for people to get reimbursed for the at-home tests. joining us now, ro khanna, who represents the bulk of the silicon valley. from washington, d.c., thanks for joining us this evening.

in antioch, scott budman, "nbc bay area news". >>> omicron is flooding communities across the bay, and now it is hitting those we rely on to administer the covid tests. now, these four testing sites in san francisco have had to reduce their hours because of staff shortages caused by covid. today that wasn't the only issue. nbc bay area's stephanie maglione tells us about one center that had to shut down. >> reporter: several left the site frustrated after waiting all morning to get a covid-19 test. workers here tell me they have to close down because their computer system stopped working and they don't know when it will be up and running again. patient after patient turned away and a sign telling everyone else this testing center on golden gate avenue is unexpectedly closed today. >> my spouse told me that the covid system is down, so they asked me to come back tomorrow morning. >> reporter: a similar situation at alemany. both centers are run by color, a company that told me they had to close all six testing centers in the city today due to a computer system outage affecting the compa

scott budman joins us live with where the case stands now.ks for joining us. >> reporter: my pleasure. you mentioned the jurors will reconvene and they have not met since last wednesday when we broke here in downtown san josÉ. they were told they could not bring jury instructions homes, and as they have been reminded every day, they are told not to discuss this case with anybody, but even close family members. it had been a while since this has been discussed. this will be day seven of deliberations for the jury. the trial has gone on for nearly four months. it started back on september 8th. the jury heard from 29 prosecution witnesses and three witnesses for the defense, including holmes herself, about her relationship with fellow theranos executive, sunny balwani. they also heard from people that got false blood results and heard from investors. so far the jurors asked two questions of the judge, one of those related to evidence. they asked to rehear a phone call between elizabeth holmes and investors. holmes is facing nine counts of fraud
