scott budman, nbc bay area news. >> scott, thank you. >> also tonight are we fully back in business? the job rate here in california and specifically the bay area suggests that we're seeing a sturdy economic recovery. let's show you the latest numbers here this that came out today. the bay area added more than 22,000 jobs in february. that's compared to just 9,000 jobs added in january. over the past year the bay area jobs rate increased by more than 6%. let's take a look at the state level. unemployment fell to 5.4% in february. the leisure and hospitality sectors posting biggest gains adding more than 30,000 jobs. again this is statewide. the state regained nearly 90% of the jobs lost at the start of the pandemic. >>> that leads us to the question of the day. we know this. it's expensive to live around here. how are you coping with the rising cost of living? this one posted overtime, only spending on basic necessity and staying home. >> it's sivrp move out of the bay area. i did it, the best thing i ever did. >>> here is a compelling story. all about a photograph and the photograph

scott budman was there and he told us that the judge started by giving instructions to potential jurors and then proceeded by asking if jurors had seen any of the news coverage of the holmes trial. this was the first question the judge asked of the holmes jurors as well. balwani faces the same charges as elizabeth holmes. wire fraud and conspiracy to defraud investors, doctors and patients. it was supposed to detect many diseases with a single drop of blood. in january, holmes was convicted on four fraud and conspiracy counts but only related to in57ors. our legal analysts say prosecutors may go harder on the charges related to patients and doctors but we're unlike to see any evidence related to holmes' allegations that he abused her both mentally and physically because they believe he is unlike will to take the stand. >> holmes took the stand. she is by everyone's account a very charismatic and appealing character. and that worked well for her to take the stand. sunny balwani doesn't have that kind of charismatic appeal. >> reporter: and they believe this trial will be shorter because

scott budman from the federal court thousands in san jose. scott, you covered the elizabeth holmes part of this trial extensively. how different will this one be? >> reporter: i tell you, raj, it will be as different as sunny balwani's lawyers can make it this. balwani, the former ceo, chief operator officer of theranos, in his own trial and from the jump this morning his attorneys tried everything they could to put some distance between balwani and holmes in the minds of the jurors. telling the jury that had just been seated balwani was merely an employee and a stockholder when it came to theranos and that the company was run by holmes. the prosecution wants the jury to see them as very connected. they want to see them as co-conspirators and they'll get help by the guilty verdict against holmes amount the damaging things she said about balwani when she testified. >> and i thought the defense did a good job of humanizing mr. balwani after elizabeth holmes got on the stand and tarnished his reputation under oath. so they have a lot of work to

scott budman, nbc bay area news. >>> well for the first time the contra costa sheriff's deputy sentenced to prison in connection with an on duty shooting. andrew hall sentenced to six years in prison today. hall found guilty of assault with deadly weapon for shooting and pd laudemer arborleda as he ran from police. police cam video from the 2018 shooting show officers trying arborleda to pull over and hall fire into the moving car. today before handing down the sentence the judge noted that arborleda who had a history of mental illness did not deserve to die from running. for running from police. >> prayed that he would get jail time and he did. although six years. it's state prison jail time. >> deputy hall's actions were dangerous, unreasonable, and excessive. >> the district attorney's office is also investigating a second shooting involving deputy hall from last march. that's when hall shot tie are wilson a homeless man with mental issues. the camera shows wilsons with holding a pocket knife when hall shot opheim him. the a d.a. is investigates that shooting. >>> the maverick doesn't

scott budman is headed up from san jose. this is, again, the area of san felipe and huntington drive. what we know at this point is that there was one, perhaps two maintenance vehicles that were hit by that train. the train service is definitely going to be impacted for some time. the fire, though, appears to be out as firefighters are starting to make entry into that train as part of their work and of course the ensuing investigation. >> we're getting a closer look to see one of those vehicles that was a part of that collision there with that train. it's on its side. but then just a few feet back, it's past it now, but a few feet back you could also see another one. we did hear from our producer that there were two maintenance vehicles that were involved in this crash right now, but of course this is a scary situation. we saw one tweet from a guy who said it was the craziest train ride ever so it seems that some people were on the train at the time of this collision. no reports of any damage -- no reports of any injuries at
