as scott mcfarland reports huge decisions remain. good morning, scott. >> reporter: good morning to you. it's a foggy morning here in washington. things will move quickly and clearly. first of all congress is to prevent a government shutdown and what to do with income tax cuts for tens of millions of americans. big stuff. and about 100 new members of congress arriving on capitol hill. they are not voting yet. it's the old congress making the big decision. they want to pass an emergency spending bill. you need to pay for the military and wars overseas. also what to do about the long ago past tax cut set to expire at the end of the year. >> i think when you have the worst unemployment since the great depression, that raising taxes on anybody is disstrucktive. i think our number one goal has to be to put people back to work. they hope they will extend the current tax level for everybody. >> reporter: the white house prefer to extend tax cuts to those earning no more than a quarter mall dollars a year. the president set the tone saying ov

scott mcfarland is live. good morning, scott. >> reporter: good morning to you. it's a sign that tea party is brewing here in washington both house and senate republican leaders say that vote to ban earmarks. and the white house will support that ban. the massive incoming class of freshmen members of congress almost all republicans. they are here this morning for training and orientation. that is a block of 60 republican votes that forces the hands of gop leaders to push forward with this ban on health traditions. i asked one of the freshman why this is a priority. >> we were wanting to shake things up. i don't care about the tradition. i'm trying to make something happen here. >> reporter: if it happens a lot of money for bay area projects would be in jeopardy. millions for work on oakland harbor. $1million for equipment for san francisco police. a half million for new programs and work at san jose state university. a lot of money at stake when senate republicans vote later today on this ban on earmarks. live in washington. >>> long-time new york democratic corn

scott mcfarland is in our washington newsroom to tell us why and what is at steak. >> reporter: this is the tea parties fingerprints all over it. after months of -- congress to poise the ban of earmarking. it's a long held tradition in thousands of local pet projects are stuffed into congressional spending bills. millions of dollars for road work, for college equipment, for police departments. but under pressure from this huge class of incoming congressional republicans the party is about to do away with earmarks. >> banning earmarks is another small but important step we can take to show we are serious. another step on the way to serioused and sustained cuts in spending. >> reporter: a lot of local money at stake. i reviewed the bay area earmarks. big, big programs. $350,000 for the oakland unified school district. $700,000 for the san francisco public health. a million for the police. and a decision on whether to continue with earmarks is expected today. >>> long-time new york democratic congressman walked out of his own ethics trial. >> with all due respect since i don't have coun
