i'm sam brock, in for scott mcgrew. >> i'm kris sanchez. the santa clara supervisor is finding out his punishment for sending out a phony election mailer. >> nannette miranda joining us live from outside the courthouse in san jose and there's going to be a punishment but no jail time for collins. >> that's what it looks like the judge is leaning towards. the court is in break right now. but in an effort to get leniency former county supervisor santa clara county supervisor apologized in open court for his actions in connection to the 2010 campaign mailer. and in open court, he admitted to the judge he failed to protect and serve his community by creating flyers that helped get his political ally elected to the san jose city council. he painted the then candidate as a compnist sympathizer and she lost the election by 20 votes. he pleaded no contest to one felony count of false impersonation. the judge in his speech within the last few minutes said that other people in other cases with the same charges have been sentenced to community service
