. >> scott mcgrew, donald trump says that he will be there as well?e there, marcus, and he won't be testifying. so being there is certainly totally voluntary. it's an important case, though. trump's lawyers claim federal prosecutors can't charge trump with the four charges of conspiracy against him in washington related to january 6th because he was president when he did it. that sitting presidents are immune from prosecution, they'll say, and when the alleged crimes took place, trump was indeed president. he's making the same argument in georgia in the criminal case there. prosecutors say presidents may be immune from some things like civil cases, but they're not immune from everything, pointing to richard nixon, who was pardoned for crimes committed when he was president. why would nixon need a pardon if presidents can't commit crimes? trump's lawyers argue this is double-jeopardy. they say trump had already been found innocent during his second impeachment trial where he was accused of many of the same things following the january 6th attacks. but

i'm scott mcgrew. marcus and laura are off. we begin with breaking news. a big scare for b.a.r.t. riders, a derailment has left service on the antioch line completely shut down. this is a look at the scene from our nbc bay area skyranger. let's get out to nbc bay area's bob redell. he's on that scene of this disabled train. everybody is okay? >> reporter: that's our understanding. we're along eastbound highway 24, that derailed train is still here on the tracks along the freeway. the fire department says b.a.r.t. was able to deelectrify the rails after the derailment and their staff escorted passengers on foot back to the orinda b.a.r.t. station, about a half-mile away. here's the view from earlier, nbc bay area's skyranger. this was a yellow b.a.r.t. train heading in the eastbound direction along the tracks on highway 24. it partially derailed around 9:00 this morning. b.a.r.t. says two cars came off the tracks. there was also a fire in the undercarriage of one of the cars and possibly a second car which the fire department was able to put out. three people sustained minor injuri

now, scott mcgrew continues our coverage now. scott, nikki haley in second place here. that poll quite the move for her there. you say this might be a good night for her no matter what. >> if polls are right, if she comes in second for the nomination in iowa, that's great for momentum for new hampshire. if she's third, she's just meeting expectations they were setting earlier, so she kind of can't lose. winning or losing in iowa doesn't mean you win or lose the nomination. trump lost iowa in 2016 to ted cruz but still won the republican nomination. joe biden, who lost iowa and new hampshire in 2020, still, obviously, won the democratic nomination. so, iowa is not an end-all be-all. video from the last iowa caucus, there will be some changes this year for the republicans. instead of voting with bodies like everybody in favor of hailey move to this corner, everybody for trump move to that corner as it used to be the republicans will do the vote by secret ballot, pieces of paper gathered from everybody in the room. a bit more like other states and their ballots. but still,

. >> scott mcgrew joins us now. the judges sounded doubtful. >> very doubtful. they asked very hard questions, laura, of donald trump's lawyers. as you know, there are three judges on the federal appeals court. one of those judges pointed out it would be strange to make a president take an oath to enforce the laws then allow him to break the laws with no consequence. trump says he's immune from charges of felony conspiracy connected to his attempts to reverse the american presidential election, or, for that matter, any other criminal charges because he was president at the time he did it. he's making the same argument in georgia in the criminal case there. one of the judges was so doubtful that a president could claim immunity from criminal charges she took it to its logical extreme. she asked, can a president order someone's murder and get away with it? and mr. trump's lawyers said, yeah, if he's not impeached for it first. he would have immunity from the crime in criminal court. i'm going to play this for you. there are no cameras allowed. you'll hear audio in

. >> as scott mcgrew tells us, the president has a busy court schedule this week. >> good morning.top of all that, the former president will appear on fox news tonight in a town hall. trump says the courts are forcing him to leave the campaign trail, but that's not entirely accurate. it's understandable a defendant would like to be in court when important matters are decided, trump did not have to be in the washington appellate court nor the civil court in new york city. he will have to appear in criminal court dates scheduled for later this year. as for that town hall skenl you know what i meaned for fox, its runs counter to the last republican debate before the iowa caucuses. this video is trump's town hall on cnn last may, where he dominated the stage with fabrications and inaccurate statements. we'll see how fox handles it. trump is on fox, no doubt, because nikki haley and ron desantis will be on cnn tonight, the last debate before those caucuses. those are next week. while trump will likely win the iowa caucuses, who comes in second will tell us a lot about the road ahead. ha

scott mcgrew has the latest on a new child tax credit. >> reporter: the deal made between one republican, one democrat, both of whom wield a lot of power in congress, apparently does have the votes to go through. and if it goes through soon enough, this month, you could see that new tax credit on the taxes you're filing this spring. child tax credits return money to families. an earlier version passed during the pandemic all but wiped out child poverty in the u.s. the tentative new deal also reinstates some tax breaks for businesses that we saw in the trump tax cut, breaks that had expired. that proposed bill would bring them back assuming congress can keep the government open. that's the top priority. the two sides say they have an agreement on a continuing resolution that would delay the shutdown, but they have said that before and been wrong. >>> the richest man in the world, elon musk, has written to the board at tesla saying he wants more power, more voting shares, and more money. he wants 25% of the vote, enough to influence, he says, but not enough to do anything unchallenged. he

scott mcgrew has been following this. the desantis campaign knew they'd struggle there. >> they were all on iowa, the first contest in the nation, oversized in importance, and ron desantis went all in, ended up in a decent second place. but in new hampshire, this latest poll conducted by suffolk university, our sister station in boston, and "the boston globe" shows desantis in third place with just 5%. again, the florida governor just did not pay very much attention to new hampshire. his response is slightly above -- above the margin of error there. now, new hampshire famously hard to measure. they're proud of that. most of the voters there identify as independents, which mean they can vote in the upcoming primary or skip it. we have no idea what they're going to do. nikki haley did pretty well in the latest poll, 34%. she and desantis have been warning voters, if you nominate donald trump and he runs against joe biden, he will lose, just like last time. here's desantis. >> here's how we're going to turn it around. i thin

. >> and scott mcgrew joins us now. there are now two republican candidates after ron desantis dropped out over the weekend. >> yes. good morning to you. donald trump and nikki haley. the big question, if there is no ron desantis, who will haley get tomorrow as far as voters? will voters in new hampshire, who were going to vote for ron desantis, move to donald trump, or will they still want a trump alternative? desantis doesn't really have a lot to offer as far as the number of voters. he was running a distant third in new hampshire. and even if haley picked up every single one of them, she'd. still be behind donald trump in new hampshire. but it will give us some idea of haley's potential ahead. you can lose the first two contests, iowa and new hampshire, and still get the nomination, but it's rare. bill clinton lost both but won his party's nomination and of course the presidency. haley needs a really strong performance tomorrow. she was in concord, new hampshire, this morning, one of five campaign stops as the hours

scott mcgrew explains why. >> good morning. the national democratic party wants the first primary to be held in south carolina. new hampshire, which had been the first primary in the nation for nearly 100 years, wants to keep its status as first, so democrats in that state are going ahead with their vote, much to the disapproval of the national democratic party. so, national party said fine, take your vote, but it won't count. president biden is not on today's new hampshire primary ballot. democrats are free to write him in if they want. parties are free to put people on ballots or take them off all they want because they get to choose who they run. they are private entities. it's very different than the fight over whether a state can bar somebody from the ballot, particularly in the general election, and that's what we're seeing with the fight over colorado and maine. meantime, the primary for the republicans moving forward as normal. the first vote was overnight in dixville notch, new hampshire, the six registered voters all

. >> scott mcgrew is here. this is quite a story. >> impeaching the cabinet secretary has only happened one time before in american history. the secretary of war under president ulysses s. grant, accused of corruption. mayorkas is not facing those kinds of charges. critics are asking what exactly are the charges he's facing. house republicans offered nothing specific other than accusing him of, quote, lax policies by allowing immigrants awaiting court hearings to enter the u.s., something all secretaries of homeland security have had to do when they ran out of room at detention centers. so, the accusation remains vague. here's part of the charge written up by congresswoman marjorie taylor greene. >> secretary mayorkas' actions and decisions clearly make the standard necessary for initiating impeachment proceedings. this historical evidence is overwhelming that the founding fathers intended impeachment to be used to deal with the commission of indictable crimes and the abuse of power. >>> there are several step

scott mcgrew has the details. >> the investigation conducted by a third party found employees of cruise knew its car had seriously hurt a woman, but then most of its efforts were focused on reminding the media and investigators it was another car that hit her first. it also found that many cruise executives were kept in the dark about the true nature of the accident and that at one point cruise employees showed regulators video of the accident, but a poor internet connection prevented regulators from seeing the full truth. those cruise employees didn't point it out. the report says cruise's strategy was to let the regulators figure out what the cruise car did from the video. "cruise assumed that by playing the video for regulators, they would ask questions and cruise would provide further information about the pedestrian dragging." cruise lost its permit to operate driverless cars but still faces a multitude of investigations. the national highway traffic safety administration, department of justice, the sec, as well as the state of california. back to you. >> thanks, scott. >>> a drama
