scott mcgrew for us.tensions are growing in san francisco, this is as the city gets closer to a new permit policy for sidewalk planters. the debate over the planters really has sparked a lot of controversy. some believe that they're actually being installed to deter the unhoused. the association says the new program will be a big step backwards. >> personally, i don't think you should have to get a permit to love your neighborhood. i think it would be nice if the city showed us a little more love and responded to the issues we have. >> we did reach out to the department of public works, but did not hear back last night. in an email to the group, a department spokesperson said that the permit is free, but they want planters to be registered so they know who to contact if there's a problem, adding the permit will cover many types of projects, including planters, benches and small libraries. the city says the new rules and regulations are close to being finalized. >>> another bay area athlete punches her tic

democrats scott mcgrew continues our coverage. and, scott, we saw some democrats vote uncommitted in recent primaries. they want to send a message that they're displeased with how president. exactly. right. particularly in michigan, ginger, where we saw that sort of vote. they have a larger muslim electorate in michigan compared to other states. we've seen protests and sit ins on all kinds of college campuses. you saw chris run through all those california campuses, mostly peaceful until the universities bring in force to move the students. columbia in new york has given students until 2 p.m. their time. so that's right. now to move their tents off the campus lawn. all this protest, some democrats fear, could spread to the democratic convention this summer. democrats, well aware of their own history and the debate within their own party over the vietnam war in the 60s, led by young people. and the attack on those protesters in chicago at the convention of 1968. this year's democratic national convention will also be in chicago. the

scott mcgrew has more on what unfolded in the courtroom. >> reporter: the prosecution and defense presented their opening statements this morning in a shortened court day with the court shutting down at 9:30 hour time this morning, 12:30 in new york, in observance of passover. there will be a shortened day tomorrow, as well. in the opening statements, the prosecution said it would provide the jury with trump's own voice, recordings of the former president participating in a plan to hide evidence of hush money to stormy daniels who claimed she had a sexual affair with trump. trump acknowledges the payments but denies they had a relationship. the defense in its opening simply said that they were following the advice of attorneys in the hush money plan. now, that's a defense the judge in the case specifically said he would not allow, what they call an advice of counsel defense. the judge had earlier ruled trump can't both claim a client-attorney privilege in hiding some of he has communications with his lawyers while, at the same time, claiming he was just doing what those lawyers told him to

scott mcgrew said trump's top lawyer faced a very skeptical court. >> they lost twice before, both at federal district level with the judge sitting on trump's election interference trial and then in the court above her, the federal appellate court. so this is the final push for trump's immunity argument. trump's lawyers are trying to get that election interference case thrown out claiming that what trump did to overturn the election was part of his official duties as president and official duties they say, are not reviewable by courts that the president must be allowed to make decisions without fear of prosecution always. here's trump attorney john saw err. >> is that going to dampen the ardor of that president to do what our constitutional structure demands of him or her which is bold and fearless action in the face of controversy? >> some of the questions we heard from justices this morning are requests we heard from lower courts including what if the president ordered someone murdered? is that legal? sauer said what he has in the past it depends. sauer's argument rests on the idea

scott mcgrew says the timing is terrible. >> the timing, the optics on this is brutal, because most people aren't aware, this is money in the form of tesla stock that musk was promised back a few years ago. long before the most recent layoffs. it was taken away from him after investors sued the company saying the deal was not negotiating properly, and the delaware court agreed, ruling the arrangement was excessive and deeply flawed. the court found that tesla board worked side by side with musk on the details of that bonus, almost advising him instead of negotiating with him on behalf of the shareholders. now, musk is going straight to those shareholders to get his money back. the company is asking shareholders to vote up or down, should those shares be returned to musk. cybertruck owners are worried about their accelerator medals. this points out the decorative cover can get caught in such a way it gets stuck at full throttle. many of those who ordered them say the delivery dates have been delayed, but tesla has not said whether these are related. the national traffic highway safety admin

. >> scott mcgrew, the latest development is out of arizona.he race for the white house. >> it is. and arizonans who favor abortion rights are pushing to get abortion on the november ballot. an amendment to the state constitution, like we did here in california. as we have discussed before, abortion on the ballot brings out democratic voters. the state supreme court in arizona yesterday ruled a centuries old law banning abortion was valid now that rowe has been overturned. the decision seemed to come out of nowhere. politicians not watching for it. not expecting arizona to join the fray. it came just a day after republican candidate president donald trump tried to put the abortion issue behind him with an announcement he wanted the issue decided by states and not on the national level. well, it is being decided by states. just last week, the florida supreme court decided a six-week ban there was valid, but that the question of abortion could go on the ballot in florida in november. florida, arizona, two key states in any presidential election,
