[inaudible conversations] >> good afternoon. thank you for staying here. we are going to have our last keynote address and then we will break for lunch which will be held upstairs in the second floor. our final speaker of the day is the attorney general from oklahoma scott pruitt. he holds the merit, he holds the distinction of seeing the merit in this litigation before any other attorney general. he was the first to challenge the irs disputed tax spending way back in september of 2012 and last month fairly slowly it seems seems a federal district court in oklahoma ruled for general pruitt's and against federal government, the obama administration the obama administration not surprise the obama administration not suppressing his appeal that ruling to the tenth circuit which we will hear oral arguments in january. scott pruett was elected attorney general of oklahoma in 2010. his official bio

we have just gotten word that oklahoma attorney general scott pruitt also promises a lawsuit. in a statement if the president takes an executive action that violates his constitutional duty to faithfully immigration immigration laws by congress we will take action to hold him accountable. before we get to the panel one more excerpt of the president's speech which has just been handed to it quote the actions i'm taking are not only lawful they are the kind of actions taken by every single republican president and democratic president by for the past half century. those members of congress who question my authority to make our immigration system work better or question the wisdom of me acting where congress has failed. i have one answer, pass a bill. judge? you think it's unconstitutional? >> the president's power is profoundly unconstitutional. here is why. the president has the prosecutorial. ratchet up or ratchet town what the. take on the president's executive order for illegals but a republican oklahoma attorney general scott pruitt is not smileling, he is suing. over what? >> i think what we are focused upon is this executive amnesty, the executive branch doing that which only the legislative branch can do. the president said, pass a bill. but the legislative prerogative is to pass a bill or not pass a bill and because congress has not eighted it didn't give him license to fill in the void. with this executive action it put the states in a very adversarial position. we trigger state benefits now because they're lawfully present in the state of oklahoma and state medicaid, state welfare benefits. this is injuring the state and states all over the ken tribecause of the unlawful action of the president. >> that's really the backbone of this suit. it's costing your state as it is a lot of cities and municipalities directly affected by this n fries of deportation of illegals. it's a costly issue, not political. >> that's right exactly right. these individuals are subject to deportation today and the president has sus

i saw attorney general greg abbott in texas and scott pruitt in oklahoma have said they're going to file a lawsuit. i would i guess, although i don't know, that that lawsuit will be based on sort of anti-commandeering concept of the refusal to force immigration laws has now imposed a huge additional cost on the states. standing will be difficult there as well. there's of course, the lawsuit senator sessions referred to by the i.c.e. agent filed by secretary of kansas. although the district judge said he believed the president had acted unlawfully, that case was dismissed on standing ground but this had argument before the circuit court of appeals. i heard some talk union workers or other workers saying we can't find jobs precisely because these work permits are given out to illegal immigrants. i don't want to prejudge merit but standing is going to be a tough issue with respect to any of those. when you add in traditional argument about really this is just an exercise of prosecutorial discretion, that will make it a little tougher. >> can i just concur in that. i'm not overly optimistic
