officer slager shot scott in the back five times and claims he was coming at him when he fired and the cell phone video which is key evidence here which boris sanchezesn't tell the whole story. when you see scott running away from the cop and not towards him does overs slager's defense makes sense to you? >> simply doesn't. that's all he's got. the only thing that he can say is i acted that way because i was in his mind reasonable fear of great podly injury. that's the only way that an officer can discharge his weapon, a deadly force event. he has to be in reasonable fear of imminent great bodily injury. it simply cannot exist when sun has their back to you unless they are armed with a firearm themselves and when they are running away. it's literally all he has. we have to understand that cops in these cases are often given the benefit of the doubt, however. we can look at the tensing case up in cincinnati where a hung jury just happened, and it's difficult, but in this case if there wasn't a video, then we know that walter scott was the enormous aggressor about to turn on him. only four feet away when the shot happened, and that videotape actually

sanchez joins us from san jose. the time of day, kris, makes this particularly worrisome. >> reporter: scott, it was just after 6:30 in the evening. you know what a neighborhood is like that time of night, fairly light, kids outside. in this particular neighborhood, capital park is right near the intersection of bambi lane and peter pan avenue where the shooting was reported. so this is a concerning time of day because there were so many people around, out and about in that neighborhood. police say both the victims are men, one died at the scene. the other was rushed to the hospital but will survive those injuries. police have not said whether the victim who survived was able to identify the gunman nor give them a reason for the shooting. the victim who died has not been identified or the identity has not been released. we can tell you that he is now the city's 41st homicide victim this year. this time last year there were 30 feet who were killed at the hands of another perp. if you know anything about this crime, you can report it to the police anonymously. in san jose, kris sanchez, "today in the bay." >>> at 6:0

sanchez brought us this story live early yesterday. kris, still an active search right now? >> reporter: it is still an active search, scott and laura. this time yesterday we couldn't get this close to the main jail because this was part of the perimeter being actively searched for the two escaped inmates. we showed you video yesterday of officers on foot with dogs, a helicopter overhead searching for those two inmates who were able to do a jailbreak, and that was around 9:30 yesterday morning when they called off the perimeter. that's because surveillance video revealed those two inmates might have breached the perimeter and got away a little further. the search area is all of santa clara county. the duo did manage to cut through the bars of their second story cell. they repelled down on clothes and bed sheets found together. two other inmates were caught shortly after. more than 24 hours after rogelio chavez of san jose and laron campbell of palo alto escaped, they're still on the run. >> the fact that the bars were cut the way they were, it wasn't something that probably took some previous planning. >> reporter: nbc bay area was i

sanchez was the first reporter out there. she joins us with more information on the search efforts that are going on right now. kris? >> reporter: good morning, laura and scott. we are way closer to the main jail than we were yesterday. yesterday the perimeter extended all the way around the jail. we were kept at bay as well. now we know those two escaped inmates managed to make it out, so there were more than 40 officers searching for them on foot with dogs, with the helicopter overhead, the light streaming down, and they did that until about 9:30 yesterday morning. that's when they lifted the perimeter because deputies discovered surveillance video put the two outside this area. investigators say that now the search area is all of santa clara county. they tied clothing and sheets and repelled down to the ground. two other inmates who were with them, who made the escape at the same time, they were caught as the deputy was on routine patrol outside the jail. now more than 24 hours after rogelio chavez of san jose and laron campbell of palo alto escaped, they are still on the run. >> the fact that these bars were cut the way they were, it wasn't something the
