scott sanchez, planning department. i share the frustration that senior building inspector joe duffy expressed, as well as vice president swig. this process has not been followed by the project sponsor, the property owner. it was very frustrating for our staff, our enforcement staff, it was like pulling teeth to get plans that we believe accurately depicted to the best of your knowledge the existing -- best of our knowledge the existing conditions. the scope of work calls for the facade, the stucco to be replaced, otherwise maintains at it was before, with windows replaced, match those that were there previously. i think it's been frustrating for everyone, for the neighbors, up through this point. it's more frustrating when they don't engage with the board's process, follow what the board has asked them to do, show up at the hearings, file brief, i and i do have concerns that they will not follow the issues. but at least d.b.i. will have the enforcement process to compel compliance from for any owner or any future owner

scott sanchez, planning department. the subject permit proposes two dwelling units. the site permit was submitted in december 2015 after actually the previous owner had purchased the property and developed this application. it went through a neighborhood notice at the end of 2016. during that time, there was a discretionary review filed by the appellant, and i believe it was probably november or december of 2016. the schedule for hearing for discretionary hearing before the planning commission on february 26, 2017, then continued to march 16, 2017, then continued to april 27, 2017 and then continued again to july 13, 2017. at the final hearing, the planning commission heard the item and did not take discretionary review. at that time, it was noted some of the concerns raised by the appellant being the easement issue is not under the purview of the planning department or the planning commission. that's a private matter that they must resolve separately, given that their -- from all research that's been done, there is no easement that's recorded on the property. the pr

scott sanchez, planning department. a couple of points on the rehearing request. i don't believe that the standards necessary to justify granting a rehearing have been met by the appellant in this case. there were issues raised in the rehearing request regarding the d.r. reform effort which is the board may or may not be familiar with. a process that we have and that we had about 10 years ago that never was enacted. we never enacted the d.r. perform effort. but actually had we enacted the d.r. reform effort, the d.r. that was heard by the planning commission never would have been heard by the planning commission in this case because given the issues that were raised by the appellant in their d.r. request, it would not have met the threshold for us to take it to the planning commission. that is noted in our d.r. staff report that under the pending d.r. reform guideline, it would not have been fwrouth brought to the commission. the commission did hear as a discretionary review and considered the tree issues raised and in
