scott sanchez, planning department. unfortunately, i do have to say i share the concerns of the appellant in this case and think that the plans were not properly reviewed by the planning department. subject is in an rh-1 zoning district. it has a required side yard as noted by the appellant of 4 feet each on all sides of the building, rear yard requirement when most of this work was done, 25% or 25 feet, which has since been increased to 35 feet. the issue here is back in 2007, the sun room was added without permit. they sought a permit to legalize that, and there was another permit to also legalize the storage area which is now in question on this permit, which they're seeking to build a roof deck on. it is true that that was reviewed and approved by planning department staff and underwent section 311 neighborhood notification for all the work that was being done here that was being sought to be legalized. but that was approved under section 136, which is permitted obstructions in the rear yard or the side yard. it was

scott sanchez, planning department.i appreciate the discussion on the comments that the board has had here tonight. because at the end of the day, i think we are all agreed that there are violations on the property. i mean, that's not in dispute and shouldn't be in dispute by any other parties. there are certain building issues which the department of building inspection outlined their concerns, and they initiated the revocation which is before you on appeal. i just want to discuss some of the planning-related concerns. i first become of this matter when the appeal was filed. and then at that point, it was brought to my attention that the property was actually listed for sale. a couple of the issues that have come up with planning code compliance, it is an rh3 zoning district. it's a category a historic resource. there have been modifications made. there was one plan set which had the facade changes, the garage door widening, some of the changes in the front of the facade. that was reviewed with the preservation staff.
