scott sanchez' explanation was spot on. >> commissioner richards: we had a case here probably three or four units where essex trust legalized live-work units, but at the time, live-work was still live-work. it was still illegal to use it as dwelling units or student housing, so what would that do to the units if we included bloxom. >> it would increase it by 33 numbers, which is the number in 575 harrison that they're retaining. in regards to the live-work issue, for -- this has been going on for a while, so for about a decade, it's been the position of the department that since they're in compliance with the notice of restrictions of live-work units, which does not prohibit artists from living in live-work units, even if they're students, that wouldn't prohibit that. the academy must maintain the status of the units that existed at that time, and maybe they can explain the status of their live-work buildings. >> president melgar: okay. commissioner johnson? >> commissioner richards: i was going to ask that. >> president melgar: oh, i'm sorry. >> commissioner richards: yeah, how they c

. >> good afternoon commissioners scott sanchez, planning department. we are pleased to bring you this package to resolve the long-standing enforcement issue. this dates back to 2006 when we first got our first draft of an into douche -- institutional master plan. during our review of that document we found there were numerous properties that were in violation of the planning code and subsequently proceeded to have enforcement action on those properties beginning in 2007. it was a lengthy process that resulted in environmental impact report as well as an existing memorandum, which we are -- which was reviewed in 2016. the existing technical memorandum is a unique document. the commissioner who -- [indiscernible] also in 2016, the city attorney 's office initiated a lawsuit against the academy of art university. we entered into settlement discussions. during the course of those discussions, which lasted several months, it resulted in the term sheet for goal resolution, which the commission reviewed back in late 2016 or early 2017. that set forth signific

sanchez. is there any public comment on this item? this matter is submitted. >> scott, you won't say anything i will complement you go to mexico for a week and you come back with a beard. [laughter] >> does anybody want to start? >> sure. as our city attorney has noted, the planning commission denied this permit based on a settlement agreement between the project sponsor and the neighbors from the 2011 agreement. i don't see in the file any evidence that the terms of the settlement were incorporated into any city approval or recorded as a restriction on the property. as you know we have advised and passed the enforcement of private contractual agreement is outside the board's purview. if the board is inclined to uphold this denial, it would reduce the risk that -- you know , as i mentioned in the last hearing, this is a noble hearing and the department has stated that the project was correct. at which point i don't feel that a private agreement should be upheld by this department. considering that you could wait a year to resubmit new guidelines -- new guidelines have

i know there was a gentleman who work used to work at planning scott sanchez, he's no longer around. all of the neighborhood groups worked with and we were already getting ready to change it. and then it went away. so that's something if we can tie those two together. >> absolutely. >> that was like -- that's -- i think that would help a lot. >> i think it's -- it's a challenging one. it's one that oewd wants to embark on. i think we need to work closely with our elected supervisors and the mayor and the communities to make sure that we do it in a thoughtful way, that addresses all of the various concerns from the various stakeholders. >> oh, absolutely. >> we're ready. so what are we pursuing with our sister departments? i talked earlier about how talking to our customers was step one. now we need to work with our colleagues on step two. we're spending this year doing a deep dive into actualizing real solutions for our businesses. how can we simplify process? what are the ways to reduce referrals between departments, are there opportunities for coordinating inspections, how as we de

scott sanchez, planning department. unfortunately, i do have to say i share the concerns of the appellant in this case and think that the plans were not properly reviewed by the planning department. subject is in an rh-1 zoning district. it has a required side yard as noted by the appellant of 4 feet each on all sides of the building, rear yard requirement when most of this work was done, 25% or 25 feet, which has since been increased to 35 feet. the issue here is back in 2007, the sun room was added without permit. they sought a permit to legalize that, and there was another permit to also legalize the storage area which is now in question on this permit, which they're seeking to build a roof deck on. it is true that that was reviewed and approved by planning department staff and underwent section 311 neighborhood notification for all the work that was being done here that was being sought to be legalized. but that was approved under section 136, which is permitted obstructions in the rear yard or the side yard. it was

scott sanchez, planning department.i appreciate the discussion on the comments that the board has had here tonight. because at the end of the day, i think we are all agreed that there are violations on the property. i mean, that's not in dispute and shouldn't be in dispute by any other parties. there are certain building issues which the department of building inspection outlined their concerns, and they initiated the revocation which is before you on appeal. i just want to discuss some of the planning-related concerns. i first become of this matter when the appeal was filed. and then at that point, it was brought to my attention that the property was actually listed for sale. a couple of the issues that have come up with planning code compliance, it is an rh3 zoning district. it's a category a historic resource. there have been modifications made. there was one plan set which had the facade changes, the garage door widening, some of the changes in the front of the facade. that was reviewed with the preservation staff.
