scott budman has been tracking every step of the day, of every step of the way, including today. scott. hey, chris, what exactly happened inside the courtroom today? so today, lawyers for elizabeth holmes and her former partner at theranos, sunny balwani, each had this was kind of interesting up in san francisco, 15 minutes to state their case as to why their client should get another trial. trying to appeal the conviction and sentence that was given to each. in elizabeth holmes case, it was about 11 years she has, after knocking down a couple of years, been sentenced to prison and is set to stay there until august of 2032. and as of last month, it has been one year since holmes went to prison. wow! are you able to talk to a lawyer outside the court? what do you tell you? yeah, you know, he said, hey, he thinks. and this was a lawyer, actually, for sunny balwani. holmes lawyers declined to comment on camera, but they all felt, hey, this is just something we have to do because we feel the trial was wrong. we feel the evidence they accepted should not have been accepted. we feel the evidence that they rejected should have been allowed in court. this is not uncommon. i'm told by lawyers. but it is also rare that a federal trial verdict gets overturned and we don't know the success or failure of this there. by the way, some of elizabeth holmes family members, her parents were there. her partner, billy evans, was there before they left via uber and legal experts tell us it's not likely that she will get another trial. but even the judge who was listening today while in court, we heard her say, you know, you've made some good points. there is a case that can be made here for holmes, so they will take all of this into advisement and eventually let us know if indeed she will be released or kept there. what are the legal experts think about the timeline for getting an answer? they say it could take weeks or even a year, and that's a bit of a surprise. yeah, i mean, the case the trial lasted a long time. the sentence obviously, you know, stretches to nearly ten years. but they say that even the appeal decision could take quite some time. so we will have to stand by and wait to see if she gets another chance at another trial. and you'll be on it. absolutely. yes. scott. scott budman, thank you so much, sir. all right. shopping online, could it be a little less risky in the near future? well, california lawmakers are fast tracking a bill that would require online sellers to verify their identities. so here's the thing. the new rules would apply to frequent sellers on websites like ebay next door or facebook. berkeley state senator nancy skinner wrote the bill. it's part of a larger set of bills to fight retail theft. supporters say this could help shut down organized theft rings, but critics say the legal language here is just too broad, especially to collect sensitive info. nonetheless, the bill is moving quickly at the committee level, though to become law, it still needs a full vote in the legislature and the governor's approval. we'll keep an eye on it for you. immigration advocates on the peninsula are now pushing to keep a landmark program to help immigrants in legal trouble. nbc bay area's ian cull spoke with some members of the group today. i

>> yeah, so the way that traffic lights work today is they're often scheduled to be read for a certain period and then green for a certain period. sometimes they're a little bit more advanced and they will prioritize these busses or other types of transit. but the funny thing is, what we really need to prioritize is people. so what we developed is basically an ai driven method that controls the timing of traffic lights. so it prioritizes green, it provides green in directions of flow where there's vehicles with high occupancy. so say in a four way intersection, if there's a lot of busses or shuttles and there's high occupancy in them, then it'll stay green longer to move more people through the intersection, as opposed to east west, where there might be a lot of cars, with single occupancy vehicles. >> so just so i understand, an ai drives it, this is like algorithm at this point, right? no pilot has been done where, because i was kind of curious how it would know which direction has more high occupancy vehicles, busses, rideshare, for example. >> yeah. great question. so it turns out that vehicles are becoming increasingly more connected. we already have all sorts of infotainment features and vehicles. meanwhile while, you know, our coauthor, jane macfarlane, used to work for general motors, and she was commenting that all vehicles have airbag sensors and they know who's sitting in what seats. so the vehicles know how many people are in the vehicle, given that they're connected, we could actually leverage this data, send it to traffic signals , or send it into the cloud to the ai, and it can understand, you know, what vehicles are coming towards an intersection and have more people in the seats. >> can i just ask you then how does this reward individuals who make that, you know, difficult choice perhaps to say, okay, i'm going to ditch my car, i'm going to take transit because like the car next to you that may just have a solo driver when they also benefit from the additional green light time, even though they're still a solo driver. >> that's that's a really good question, to be honest. when we started this, what you described was a surprising outcome. i didn't expect this. okay. when we started this study, we thought, hey, it would make sense to prioritize how you occupancy vehicles. but then what we found is when we added a model that described people's preference to take a private car versus a bus, and the difference in travel time, we found that this reduces travel time a lot for people who are in busses, because those routes get green waves, whereas routes with a lot of private vehicles don't get green waves. and so more people might then start to take busses and shuttles, because they're prioritized. and they'd be less likely to take their private vehicle because because it will in fact, take longer. that's kind of the idea that we move more people quickly. >> and i apologize for jumping to the implementation stage when you're still at this very exciting idea stage. i imagine we'll have to do a follow up interview at some point, but i wonder what would the ai be trained on? >> yeah. excellent question. it would be trained on existing traffic, knowing, knowing how many people are in vehicles today and are moving from point a to point b and what types of vehicles they're in. so we could actually learn. how long does it take, for this vehicle with this occupancy to move from point a to point b with this existing traffic light timing, and then based on variations of traffic light timing and learning how people in a bus might go quicker from a to b or slower, it'll then start to learn, oh, here's the timing. we need to move more people quicker. >> all right. so we've got i'm going to ask you to do the impossible. we have about 40s two questions in one here for you. i wonder if you think there'll be support, because a lot of people are afraid of giving ai more control. and then the last question also is, just what would it take to make this actually happen in terms of coordination between cities, transportation agencies and car makers, trust is a big issue. >> i'll leave it at that, if it helps people move from point a to point b faster, then that's significant. what do we need to make this happen? scott budman scott, the state and silicon valley actually teaming up here. so. so how would this whole thing work? you know, the idea here, audrey, is to find a way that i can actually help us and provide some good information. and that is what's happening. so the state providing some funding to silicon valley companies to say, hey, take all of the data that caltrans has comes up with. and if you think about all the cameras that they have traffic cameras and cameras to try to see where accidents and traffic jams are, that's a whole lot for humans to compile and get some answers from. so the goal is to take machine learning. they can take all that data much more quickly and figure out why is there always traffic. say on the terra linda curve? or why are there often accidents at one place or another? the idea is that machines can help gather that data, find out why it's happening, at what times and under what conditions, and somehow say, hey, if we just move one lane there or try to slow traffic there, maybe there can be less traffic and fewer accidents. okay. but obviously, scott, there's a lot of skepticism, right? when it comes to ai, where it's going. but it seems like this is something a lot of people can get behind. a lot of people can get behind. but. right, i mean, i'm a professional ai skeptic. it's what i do for a living. and here are some of the problems i, by definition gets all of the information, good information, bad information. and as we know it makes mistakes and mistakes when it comes to traffic and speed and all that stuff can be concerning and even deadly and so that's what the skeptics are saying. it's like, hey, a, are these mistakes going to lead to more problems? and b what about the privacy factor? ai, after all, is gathering data on our cars, on our license plates, all of that stuff. and what caltrans is saying is, hey, we're going to do the best we can to make sure that this is not a personal thing, that none of this is personalized. it's just a whole bunch of cars in one area. and how can we make it fewer cars in an area at a time,

scott budman. scott, this has been going on for months now, and it seems like there's just no end in sight. right. and you and vienna were just talking about the high fire danger, audrey. and that's what a lot of this is about. state farm asking the state of california to raise rates on homeowners by 30. this would be the biggest rate hike for them in seven years. they claim they have to do it because they are just paying out too much money. when people have insurance claims, largely because of things like fires and floods, i know you got to speak with the senator about this. what's the senator saying? yeah, this is actually a senator who represents largely contra costa county and part of alameda county. so he deals with people who are in fire and flood danger. and he's saying there's really no two ways about it. everybody is worried about high costs. but he says the alternative is just not having insurance. so he's telling his constituents you got to pay up. meanwhile, he and other legislators and advocates are trying to fight back and lower insurance costs. but even state farm, which did respond to our story, saying our costs are just so high in parts of california that we have no recourse. and that's sort of the back and forth, each saying that they need to do this, and people are getting caught in the middle. homeowners and even renters. the rate would go up on renters even higher than 30% if this passes. sure. and it's a tough situation for everyone, for sure. i know you got to speak with at least one woman who's seen the costs go up, right? and she said, look, you know, she lives in the east bay. she makes a good amount of money. she's got a nice house, but just in the last six months, from $2000 to $3000 for policy went up. that's a big jump. and, you know, that's inflation, but sort of on a much larger scale than what we're seeing at the grocery store or even the gas pump and things like that. and state farm, one of many companies, we're singling them out today because it was this week that they made this large request. but there have been many other insurance companies recently are in our investigative unit, has done a lot of stories on this recently. all these insurance companies really targeting california for price hikes because they say it is just so expensive to insure people here got it. all right. are we going to be seeing a full story later on this evening scott. yeah, we'll have that at 6:00 okay. looking forward to that. thank you for that. appreciate it. well how do bay area home prices compare to a year ago? we do have new numbers. just came out. according to redfin, the median home price in cupertino is $2.4 million. now that's actually down 7% from last year. a median priced home in pleasanton will cost you 1.8 million this year. that's up 16. and san jose also had a big jump of 15% increase. their puts the average home at $1.5 million. prices in san francisco rose less than a percentage point to $1.4 million. happening now oakland city council is facing some tough decisions on how to balance its $177 million deficit and pass a mid cycle budget. that meeting started at around 130, where council members are discussing a couple options. we talked about these first includes the mayor's original proposed budget presented weeks ago with amendments from council that plan includes a contingency that if the coliseum sale isn't finalized by sept

scott budman. scott, how about the latest numbers and the impact here in the bay area? yeah. and terry, these numbers are really strong. once again, we continue to add jobs as a country. 272,000 jobs added in the month of may quite a bit above economists expectations. and that's good news. all in all, the jobless rate did tick up higher to 4. but here in the bay area it's a little bit lower than that for california in general, it's a little bit higher. but the country is still pretty steady. 4% unemployment and again adding hundreds of thousands of jobs a month. and that's really good news. sounds like a strong economy, which is sounds like great news. but there's also the problem with when it's really strong, the interest rates, they don't tend to be lowered. exactly. and that's part of what's still going on. our economy stays strong despite the federal reserve having raised interest rates. why do they raise interest rates to make money more expensive, to literally slow down the economy. and so we've seen these rising interest rates. and if you're out there trying to find a home that also kicks the mortgage rate higher, sometimes your college loan rate higher, your car payment rate higher, that's bad news. but still, throughout it all, our economy has stayed strong. wages up, job growth up. really no sign of slowing yet. and that's why economists say it's not all that likely that we'll see interest rates come down. also, what tends to go up when the economy is strong prices. and that's why you're still seeing high prices at grocery stores. that also is not as likely to come down if our economy stays so strong and consumers continue to shop. well, you were you were talking to shoppers today about inflation. what are they saying to you? they're saying that they and we all do this. you look at the receipt and you think about it from a week ago or a month ago or a year ago, and the prices are still higher. food is still higher. just about everything we buy is still higher. that's what happens when inflation kicks up. the fed wants to see inflation go down to 2. it's still around 2.72.8. terry and that's higher. and that's why we haven't seen the interest rates or mortgage rates come down. it's sort of like watch what you ask for. we want a strong economy. we want lots of jobs. we want higher wages. we got all of that. but because we're spending that money, prices stay high and because we haven't kicked inflation, interest rates are still high. all right. interesting stuff scott. thanks very much for that. well, in a controversial turnaround for stanford university will once again require standardized tests for undergraduate admission. today, the university announced that applicants must submit either the sat or the act, beginning with those applying to enter next fall. stanford stopped requiring the exam in 2020, as did hundreds of colleges across the country, as the pandemic made it difficult for applicants to take the test, university says. faculty studies have found test scores to be, quote, an important predictor of academic performance at stanford. well, it is a growing problem for home and business owners in san francisco. insurance companies are increasingly canceling or refusing to renew their home and business insurance policies with almost no explanation. in march, san francisco resident jeremy salterbeck got a notice from safeco, his insurance company, saying it will not be renewing his homeowner's policy. he hired a private home inspector to disp

if this open border is a disaster for our nation. these are preventable crimes, if and this could be fixed with policy which is the saddest thing. maria: well, i mean, why are we okay with not being able to ensure we understand who's coming in? i mean, obviously, we're not going to call somebody in venezuela and say, hey, do you have a rap sheet on the 10 people i just ap a rehended in oh, by the way, they were in prison many venezuela -- in venezuela? we have no idea. we know all that was needed was 19 people to take down the trade center and cause all of those chets. >> that that's a great question. and i hope americans are canning that. i hope -- asking that. i hope that comes up in these debates. we have a fundamental decision to make coming up. we have with two people, two presidential candidates that could not be more diametrically opposed on border security. one believes on putting america first and making sure we know who and what is entering our home, and the other one has made it very, very clear, or we'll let everybody in, and then we'll try to sort out the bad guys after the fact. well, as we're seeing with all cheese -- these crime, after the fact is too late. i'd rather protect my children by keeping people that shouldn't be here out of the country in the first place. maria: of course. >> we do that with good border security. maria: well,, we know what president biden is going to say now in his answer to the open border and its deadly implications, because this morning the white house released a memo. this memo claims illegal migrant entries are down more than 40% in the first three weeks of president biden's border executive action, rodney. he claims that this is a real crackdown, his new border security. >> people need to look at a the real numbers. they're on are cbp.gov. last month was, i think it was april was 247,000 illegal aaliens, and then may was 24is 1,000 -- 241,000. that's not a significant decrease. they're shoving a bunch of people through the ports of entry through this illegal parole program. they put the fingerprints, their fingers on the scanner, we take a picture of them, and we take their word that they're who they say they are because we have no way of validating their criminal history or their background and home countries. americans are really at risk. i'm glad that people are waking up and starting to look and see how important border security is, but look closely at the numbers. this administration is very misleading in how they release specific data points. maria: well, this is extraordinary. i mean, look, we -- you were there on 9/11. >> yeah. maria: i was there on 9/11. we know what happened. all of the people who lost their lyes. -- lives. how do you feel as a new yorker knowing that we don't even vet anybody? >> it's beyond frustrating to me and i would imagine to so many people. to your to point, they're not vetting anybody. they have no idea who's coming across the border, and the ones that they do catch, think of all the ones that they miss. maria: yeah. that's what rodney's saying. >> right. maria: immigration and the border crisis have become the leading issues for voters, but will it come up tomorrow during the cnn presidential debate?
