he shared that senate judiciary committee subcommittee hearing today. nk you very much for joining us tonight. in your crusade to try to bring some ethics oversight to the supreme court, what did you learn today in that hearing about what has been happening with clarence thomas and, possibly, others in financial disclosure forms? >> the most important thing to understand is that these allegations about -- and jet travel from the same right wing billionaire were actually raised first back in 2011. and that was sent for its disposition to the judicial conference and within the judicial conference to its financial disclosure committee, which is the exact same thing that has been done with the current allegations regarding justice thomas. so, what they did then is very important to understand regarding what they're likely to do now. and what they did then, a judge was on the judicial conference at the time explained, was to basically ask and answer the wrong question, and to use a procedure that prevented any of this from becoming public. so, as we look forw

the senate judiciary committee is holding a hearing on all these ethics concerns tomorrow morning.w by melissa murray, professor at in the new york university school of la, who clerked for justice sonia -- on the court of appeals for the second circuit. professor mary, it is so great to see. thank you so much for making time for us. your reaction to this news about chief justice roberts's wife, is it in the same category as the issues surrounding thomas and gorsuch? >> let me just say i think we have to be really careful here. i don't like the idea suggesting that supreme court spouse can't have a career. mrs. roberts had been a lawyer before her husband became the chief justice. she took this job as a legal recruiter, ostensibly to avoid any conflict, or the appearance of any conflicts by being a legal recruiter instead of a practicing lawyer. but it seems from the testimony provided by her former colleague that it may be the case that her association with the chief justice and her closeness to the chief justice is actually very attractive to law firms trying to recruit new talent

it is a challenge in the senate judiciary committee to do our business.or example, you raise the question of a subpoena. i haven't reached any conclusion on that. but if we go down that path we need a majority on the committee. right now with her absence it is a 10-10 committee and the majority is not there. a proxy vote doesn't count in that circumstance. so it is a complicated situation. i hope she does what is best for her and her family and the state of california and makes a decision soon as to whether she is coming back. >> i mean, all due respect, sir. you and your fellow democrats were very ginger and polite when it came to justice ruth bader ginsburg and not pushing her to retire when you had a democratic majority in the senate. how did that work out for you? how did it work out for roe v. wade? >> well, i can tell you that you can play these out and try to guess what the court opinions resulting from it will be. the bottom line is, though, we have in the past had members of the senate, i can think of a handful as i sit here, democrats and republ

the senate judiciary committee held a hearing to consider changes to the court.opublica published information last month about the relationship between justice clarence thomas and conservative billionaire harlan crow. the article detailed that justice thomas took extravagant trips funded by mr crow. now, senatejudiciary committee chair dick durbin is caling for change. i think it's pretty clear to most objective people, this is not the ordinary course of business, norshould not the ordinary course of business, nor should be a standard for those of us in public service. we would not tolerate this from a city council member or an older man. it falls short of the ethical standards we expect of any public servant in america, and yet the supreme court will not even acknowledge it as a problem. some republicans believe the hearing was a distraction and an intimidation tactic. today's hearing is an excuse to sling more mud at an institution that some democrats do not like because they cannot control it 100% of the time. earlier, i spoke with bbc�*s anthony zurcher about

the senate judiciary committee has the responsibility to exercise oversight over the federal judiciary. we take it seriously. we have held two ethics reform hearings this year, and soon will consider legislation to restore trust in the high court. when billionaires and other people with interest before the court try to make friends with the justices through gifts and luxury giveaways, and obtain special private access to these justices for themselves and their other friends, it's a serious problem. at minimum, it creates an appearance of undue influence that erodes the public's trust in court impartiality. we don't yet know the full extent of the benefits that crowe and his company gave to justice thomas and his family. nor do we know how many other people and companies with interests before the court may have gotten special, private access to justice thomas or some other justice through trips and lodging that people like harlan crowe have sponsored. my democratic colleagues on the senate judiciary committee and i sent a letter to mr. crowe and the three companies that we think sponsor

are the republicans in the senate going to block our ability to have a majority on the senate judiciary committee. and the only way around that without triggering that rule is to have senator -- return. which i hope she does soon and healthy. >> i think to your point, senator, the committee was not able to advance a number of traditional nominees at your last markup on thursday. was that due to attendance issues or could his presence have changed thin? >> i think that her attendance could have changed it. and as our statement said, there were others who will move forward in the future when she does return. but do remember that the fundamental problem here is obstruction by the republican senators who will not allow a replacement for her temporarily. it is not clear that they would allow a replacement for her permanently on the committee. or even allow someone new on to the committee where she has the senate. that problem of republican obstruction persists across all of these different scenarios, except if the senator returns to the work scenario. >> before i let you go i want to -- with president

let's take a look at the senate judiciary committee hearing room. democrats on the committee are pushing for ethics reform for the supreme court. chief justice john roberts declined to testify before the panel and says the justices are following ethics principles and practices that have long guided the court saying i'm not aware of any instance in which a justice and the committee. given the history of resolving such issues i'm not aware of penalties imposed of justices for failure to abide by principles and practices recited in the statement. the committee chair is justifying the effort based on report about justice clarence thomas. >> cannot excuse what has been reported already about justice clarence thomas. how does the justice explain that this billionaire decided to buy his mother's home as a gift to him, $1 hundred thousand plus he put into his home and never reported it? never reported it. this sort of thing is unacceptable at every branch of our government, at every level of the courts. >> a key republican says the committee is getting into

the status quo must change. >> that was senator dick durbin, chair of the senate judiciary committee.his argument, and that the justices can just police themselves, i think there's a lot of people that will say, it seems laughable. but what enforceable measures could congress impose on the supreme court, if any? >> yes, that's a real question. the supreme -- court like, the last time this issue came up in 2011, the last time it was reported that harlan crow was giving all these gifts to clarence thomas, the chief justice put out a sort of petulant annual report where, among other things, he suggested that it would be unconstitutional for congress to impose an ethics code on them. so, we can potentially have a constitutional crisis where congress passes a law saying, hey guys, you have to be ethical. the supreme court then turns around and strikes it down. what i hope happens, eventually, is that the court realizes that it needs to voluntarily install its own code. it needs to appoint some kind of independent wandered to make sure that they are dealing with that code. and i suspect the

and that's partly why we're watching this senate judiciary committee or democrats from that committeeard in trying to make the court be more transparent in things of this nature. so what they're asking for from harlan crow in this instance is everything from an itemized list of all transportation and lodging to real estate transactions to the more obvious, gifts and donations. all of those sort of run afoul of the ethics that this committee thinks the supreme court should uphold, but doesn't actually have to according to the rules that are on the books right now. on the books now. that's why the supreme court is saying they're asking for this as part of their efforts to help the court monitor itself. there are republicans on the same committee that say this is not the senate's job and that these are two separate branches of government. never the less, we are watching the senate judiciary and democrats writ large here in washington try to talk more about the things from an ethics perspective that the supreme court needs to be doing but isn't currently. >> ali vitali, thank you for that
