we'll give a short presentation summarizing the rate order with an updated sequa exemption for the board's consideration today. so as a quick recap, so proposition f allows anyone affected by the rates or proposed rates to file a written objection to the refuse rates. administrator order. there were 220 written objections filed with our office and were considered and address at the last refuse rate board hearing on july 24th, 2023. because of some technical issues, some ratepayers were unable to comment on the objection remotely. so this agenda item continues in part was continued in part to give those ratepayers another opportunity to make comment. so as a recap, some of the major themes from the objections included and objections to the two rate increases in general, 75.9% of response respondents objected to any rate increase. the most cited reason was the fact that recology had already raised rates in january 2023. 9.5% of responses commented on the service issues. the most common reason was related to missed pickups or consistency of pickups. and lastly, 8.5% of responses supported som

however there is flexibility built in within the sequa document itself and within the process.o for example, there could be changes. many minimal changes i would say in between. now and final approval to some of those as land uses. and there proposed like the proposed areas where those land uses would be. but i would say that the proposed increase number of units is within the elasticity permitted by our existing technical studies plus additional memos that we did to show that we're not exacerbating or resulting in a new significant impact. i did want to point out, though, that, you know, sequa is also fluid, so there are a lot of mechanisms post project approval to increase units to change land uses. you know, this is a programmatic eir, it can be used for the next ten, 20 years to tear off of it. but there's a lot out there that allows the applicant and other developers to come in and make changes to accommodate market conditions or people's needs and things like that. so there's lots of different mechanisms out there. we're laying down the groundwork for the 3500 units. yeah

we didn't identify any additional impacts under sequa that would require anything beyond that, but we have committed to and in fact will be introducing that as part of our resolution at our commission meeting on october 10th to continue that work and take a look at that after the project has been completed to determine if there is some other action that needs to happen and that it would require its own environmental review. okay. so i just want to make sure i understand that there would be conversation to figure out this entry exiting thing. and then if it was a signal or some other intervention, would that be a separate reviewed as a not as part of this project or its own project environmentally? okay um, i think i would just reiterate just to say, yeah, there's a way to get in the zoo under the current project design, but it's, i think less than desirable, to put it mildly. and so i would certainly hope that the puc rec park planning, to the extent that we are related to it, really do take seriously the need to engage with the zoo a very proactively and i hope the zoo folks are stil

but the project is clearly not exempt from sequa. it's located in a state park, a state park that was founded to support environmental justice. it's the centers within 1000ft of residences, including alice griffith, and it has no power and it's not going to have as as blah noted, as a supervisor noted, it's not going to have power for the rest of the league . so how is it going to get power, diesel engine? that's what they've been using for a year to date. they've emitted hundreds of pounds of diesel particulate matter into a neighborhood that has the worst diesel pollution burden in the entire state. so it's if the city had done review when this project was unlawfully approved, two years ago, all of this would have come to light. it would have been it would have been public knowledge that the site doesn't have power and is not going to have power. making matters even worse, the parking lot is located directly on top of soil, contaminated with toxic chemicals, and that's extremely problematic because the city is again unlawfully cond
