to the sfmta board and the board of supervisors that all policy based discounts on the sustainability be less than 100%. as we understand it now, the idea is that for things like affordable housing and units of housing where there are no units attached that there would be no paying into the sustainability. -- the sustainability fee. we are not suggesting a number that it should be scaled down to, but we think it should be something nonzero, because there are obviously some commendable goals for having more housing that is not accompanied by parking. these do generate transit trips, and this is something that has to be paid for, so if we look at the fiscal sustainability of the agency, we think it is important to look at charging something for this, for these developments. also, i have an item pertaining, a recommendation pertaining to item 11 on the agenda today. we have a discussion about the america's cup, and we recommend that the board take measures to ensure that the sfmta budget is protected from unexpected losses related to the 34th america's cup and that the day-to-day service

we presented at the planning commission, at the sfmta board, at the transportation authority and now we're before your commission. our goal is to have a final ordinance in environment review beginning next month. it will take about a year and a half and we expect to have environment review end in -- summer of 2013 and then we will hope that the ordinance moves to a full board for a vote in the fall of 2013. so as you can tell, we're here a little bit early, but that's the point, we want to get your feedback and do know that this ordinance will be introduced, but it will be parked at committee at land use committee for some time until we have the environmental review done and we can actually then ask the planning commission and others to take action. so with that long presentation behind me, i'm open to any questions, concerns, and ideas. thank you. president o'brien: questions, commissioner o'brien. thank you, president, the first thing was to disclose among many of the hats they wear in the city, i do a little bit of development work in the city and i wish to disclose for the record

sfmta for proper maintenance of their transit vehicles. i have a 23% disability because i got injured a muni bus. something has to be done here. the mta has to answer to this board as far as the responsibility of making sure they have adequate funding to take care of the needs of the riding public. the public is in danger on the muni vehicles, and these issues need to be addressed. as an end result, i come before you, mr. campos, and show you pictures of muni vehicles with defective tires. i was retaliated against. i was terminated because i spoke out to cal osha, highway patrol, places that could help us. it is your jurisdiction to make sure that the public -- as a supervisor, it is your obligation to your constituents to make sure they have save transit vehicles in your district. but do you do that? no, you sit here and you pass b.s. litigation for the big businesses, you have got to be able to take care of your own infrastructure before you can enhance it. if you cannot do that, if you cannot make a basic decision on making sure your constituents have safe, reliable transportation, there is no need to expand it. commissioner campos: thank you very much. next
