of directors in advance of a joint meeting of the small business commission and sfmta board of directors on december 9, 2013. this is a discussion and possible action item. >> so, commissioners, we have our joint meeting with the sfmta scheduled for december 9th. so, i wanted to take the opportunity to review with you -- to get some of your goals and objectives of what you would like to accomplish with the hearing. we did have the one meeting in may 6 with sfmta director ed russ kin. so, outlined in your packet ~ are a list of those recommendations. we've color-coded them. there's been other recommendations that have been put forward. the yellow are the recommendations. and then in listening to the small businesses in other meetings, there's additional recommendations that are listed after the blue section which are some questions. so, i wanted to find out from you -- we have the list of recommendations. the one that aren't at the top of the page, are you interested in moving them to the top of the page to present to the sfmta board, some of the reasonings for the recommendation

a joint hearing with sfmta board and small business commission. majority of boards generally have some sort of -- they provide governance and direction to a regulatory agency so they have very specific things they work with like with the planning department, the planning code, the sfmta has their plan, the [inaudible] policy. there's thing they work with that govern themselves by. the small business commission, you're an advisory body and so we don't necessarily have those kind of things delineated out so what i would like to do is take the opportunity for this commission to help us help you in preparation for the joint hearing on information that you may need, things that we might help formulate that we want to present to the sfmta board. this is just kind of a beginning structure of what to think and then we have our outreach committee meeting, which they can help work on some of these or start formulating and flushing and then we have our november meet /-ging and then a potential proposed date for a joint hearing is early december. unfortunately

state legislation, but, you know, i think part of the thing that we may want to present to the sfmta board is we would like to see some creative ideas and staff work on some solutions to help all of our small businesses. does the sfmta do an assessment or analysis of green zone use and the impact of removing the green zones when designing a project area. does there need to be an economic impact report where impact will create a significant change. using polk street as an example, how do certain areas of a city get factor /spwaod a plan especially when you have both sides of an area which will have significant dedication to bicycle lanes. sometimes these things seem to be in conflict and we have other initiatives that also utilize that space and so -- >> loading zones. >> yeah. and i'd like to also note from you what information you may need ahead of the hearing to review the sfmta's strategic plan for 2013, '18, get information on that are transit first policy, information on their current plans, bicycle plans, roll and function of the bicycle advisory, pedestrian advisory committee, if th

we talked about the joint hearing with sfmta board. i wanted to highlight in the dashboard one of the things we are particularly proud of is the business of [inaudible]. came to our office in 2010 and we connected them with la cacina and the opportunity fund. they started out with just a cart in justin her man plaza and now they have a store front. they're going to be opening their second store front. they're not a recipient of the revolving loan fund and they have plans in which they want to franchise. anyway, they're one of our -- i wanted to bring to your attention -- one of the businesses we've helped that's taking off and started out from a food cart, you know. that concludes my report. >> thank you. >> next item please. >> i'm number nine, the president's report, this is a discussion item. >> in november we only have one meeting on november 18, a 2 o'clock meeting. i decided since we have veteran's day on the 11th and thanks giving is at the end of the month i figured one meeting next month because i didn't think you guys wanted

>> deputy city attorney, john gibner, no, it doesn't bind the sfmta to the allocation. the board through this contract approval cannot bind the mta's decision about where to place the meters but the whereas clause reflects the director's statements about the mta's expectations about how these meters will be used. >> okay. that's not very reassuring. i do have a couple of questions for the director though. so, i just wanted to clarify again, 25 thousand meters is the number of meters we currently have in the city today? >> yeah, i don't know the exact number, it's roughly 25 thousand and that's the base contract. >> and when you said to supervisor cohen that this 5 thousand allotment would allow us to make -- to address small meters requests, when you say small meters requests, how many are you talking? >> well, i think the way we laid out in our outreach process, we had three different levels, 1 to 50, 51 to 100 and more than 100, we wouldn't be able to do -- we would be able to do very few of the small and we couldn't do probably any even as much as 50 meters if we only have a 5

>> so the amendment will be to require additional action by the sfmta board of directors, prior to the expenditure for the on board devices after february one, 2014. >> okay. >> and i would like to get a motion and a second and then i would like to open it up for public comment on the amendment only. >> could i have a motion? >> move to approve. >> second. >> and i would like to open it up for public comment on the amendment and if you like to comment on it please line up and you will have two minutes. >> directors, thanks for making that amendment and i do want to point out clearly that you are giving a contract to a company despite what they said have never facilitated it and never put a dispatch system in the fleet and it is very suspect from this industry, and as a matter of fact, i feel very strongly, that this vendor wants to put in equipment so that they are, and we are beholding to them in terms of services and equipment that they control in the future. i just want to make that clear and put it on the record. i suspect this company wants to use a cloud based meter system and ma

this fall and winter we will be seeking support from the sfmta board, and that date is november 19. in the meantime the sfmta is taking steps to implement items that are under local control including new blue zones and increased enforcement. if approved to move forward we would seek a state sponsor and a state bill could be introduced in 2014 and go into effect in 2015. this is long timeline we're on. today we are here asking the small business commission to support the committee's recommendations to reduce disabled parking placard misuse and increase access for people with disabilities. we have quite a bit of information at our website if you want to delve into our all research, it's sfmta [inaudible] you want to send via email, parking access as sfmta.com. if you have any questions or comments. >> we have any commissioner comments? >> presentation to the council district merchants we were of our group was henry from that group so that we've already done some outreach to small business and just wanted you to be aware of that too for however you respond to this issue. >> commissioner

. >> and then are there things that you would like to ensure that we present to the sfmta board -- i mean, sometimes i do think we live with this on a day-to-day basis, but it is important for other entitleies to understand sort its to understand the cumulative effect a business incurs doing business with the city from all the permitting, you know, sidewalk, having to repair sidewalks ~, graffiti, you know, the various -- cumulative sort of impacts of different city agencies interfacing with them, regulating them. and, so, to understand that that is the view of which this commission does come from when it's taking a look at the lens and deciding to address issues that are affecting small business. >> i'm particularly happy to see you mentioning the small business should have an equal place at the table along with the bicycle advisory board because we don't at present. i feel like we are really an afterthought and, you know, we are a huge economic driver in the city and we need to be at that table. >> everybody says we're pro small business, but when it comes to this they're not. this

and enhanced that reached process that was informed by your office that is we formally had the sfmta board of directors adopt last week and also reduce the option that -- the option of 10 thousand meters was really a high end projection over the next 7 years of what we thought we would need for the port meters, for maintenance, for repair and replacement, for kind of routine additions as we've done over the years and this was looking back on historical data and then a pretty sizable acknowledged sizable contingency. bringing this number down to 5 thousand will really leave us room primarily only for maintenance, repair and replacement and a reserve for the port and again, these are options to be exercised. if we were to get as we sometimes do very small scale requests for a couple of meters for a commercial establishment, i think we would have room within that 5 thousand going pursuant to the new process that we have outlined and had adopted by the board of directors to accommodate some very small new meter requests, but we certainly wouldn't be able to do anything on the scale of what we

sfmta's money. >> good afternoon, mr. lazar >> good afternoon, commissioners, board members, how are you? my name is john lazar, president of luxor company. sorry to say, we oppose this contract, either you reject the contract or table the item for future consideration. staff has proposed a $6 million contract that is both unnecessary and unwise. this would not provide sfmta the tools to better regulate the industry. the contract will give a las vegas transportation company a virtual monopoly over taxi operations in the city, cannibalize existing taxi brands and cause companies like luxor to consider legal remedies. we at luxor have cooperated at every level, every step to advance the goal and purpose of the sfmta, including this attempt to create the eta, in fact we provided our data to fti in early may and signed a letter sent to the sfmta that gave permission to the sfmta and sei work with our vendors. we have acted with good faith and yet we face another expenditure of public funds that would be insbrues intrusive of our business prrp fti has never provided to us or our vendors precis

this is my way of saying sfmta and the entire board and everyone on our camera team the drivers and inspectsluded and thanks to the officers behind me but all the officers working in every station day to day. they're doing their best we know whether it's market street or in the bayview they're all the rates are coming down because everyone is much more aware and we're helping each other. so congratulations but let's talk about eyes up and phones down. let's put that million dollars in the event in the city. thank you very much and congratulations (clapping.) thank you very much many mr. maybe mayor, i think you can hear the passion and the commitment to the issue in comfortably the situation were we certainly share that compassion. our number one goal is safety. our number two is implementing the policy that was put in place thirty years by the board of supervisors it's making transit an attractive option for people to take. we need to make minnesota attractive it has to be resemble and save. we don't want people making a calculus how to get from point a to b by unsafe feeling. our trait goa

sfmta. certainly not the board of the directors, but between me and my team, we have a lot of work to do. the key things that we'll address taking out of this are the ones shown on this slide. we have shared this information with the employees and they're putting together a team of staff that's vertically and horizontally diverse to do something with this information to make it meaningful, to take what people said and identify specific actions that we can take to try to change this, so we'll be working on that over the next few months and the year and we'll survey again and we'll see how we're able to do. i thought because we didn't have this really to include in the annual report because it came after the end of the fiscal year, that it was important. that's the core of goal four. for that, i know it took time, but i think it was important to go through. i want to thank staff for the great work and we will be bringing these reports to you every year from this point forward. >> thank you very much. i really like the way the strategic goals are list and i think the calendar which shows the
