shafer >> pelley: tonight, we're hearing for the first time from members of the florida a & m band accusedting a drum major to death in a hazing ritual. major to death in a hazing ritual. how did it happen? investigators made some of their interviews member today. >> reporter: at least 18 band members present during robert champion's hazing ritual last november gave recorded sworn statements to investigators, three of them, including keon hollis, told them champion was willingly hazed. band members described what happened next, a violent chaotic hazing ritual called crossing bus c. a band bus was parked behind an orlando hotel after a football game last november. champion had to push his way from the front of the bus to the back, roughly 20 people punched and kicked him and hit him with drum mallets. halfway down the aisle he goffs what was called the hot seat. band members sat him down, covered him in a blanket and continued beating him. drum major jonathan boyce claimed he tried to protect champion but was later charged with felony hazing. >> reporter: some band members carried champion

and scott shafer host for kqed radio. scott, president obama made history on wednesday by announcing that he now supports gay marriage. what has been the fallout from that? >> well, the fallout, if you want to call it that, so far there's been mostly up side for the president in the short term. he had a big fundraiser. george clooney digs in hollywood. he was treated like a rock star. that hollywood group supportive of gay marriage so the fundraising has ticked up. that's been good. there's also sort of an enthusiasm among the base liberals, students, young people who generally are very supportive of same-sex marriage. that's the short-term fallout. the same things could be said of mitt romney. his fundraising ticked upwards. evangelicals, not base but the base he's trying to get that have been a little suspicious of him, gives them another reason to support romney if they needed one. longer term impact remains to be seen. this election, like all elections, national elections, will be decided in the swing states. there ar

we're on the phone now with radio reporter margie shafer, and updating the story from east oakland. >> good morning. police say that shots were fired at the suspect after he fled from a car armed with a gun. shots were fired by either one or two officers. the suspect is not believed to be hit. the gunman is one of several auctions of a car stopped in the 7900 block in east oakland last night just after 7:00. the police lieutenant said they have a good idea who he is. the have a person of interest but investigators are still looking into things before the can release his name. the gunman then ditched his weapon which has been recovered, a several block area was cordoned off and scoured throughout the night. police believe the wanted man was able to get out of the perimeter before was completely set up, so the investigation continues. reporting live in east oakland, cbs 5. >> thank you. >> a massive fire in santa clara burns down three town homes under construction and right now neighbors are out of their homes and smoke is still coming out of some of that debris. ann mackovic is here w
