shan, can you hear us? he can't hear. all right, just your take on what we heard. >> i think it's important to know that people are saying there's a lack of corroboration. a lack of corroboration does not consist of finding people who know nothing of the allegation asking them about it and they say i don't know anything. that's not the right kind of corroboration you're seeking. they need to find people who know something about it, may have seen the people attending these different events before and after, and look at the evidence. each of the allegations needs to be scrutinized independently. i think the second allegation, we can't possibly sit here and know if it happened or didn't know, but what we do know is it's very serious and could be part of a pattern. if this was a criminal investigation, as a prosecutor, i would be looking for patterns in the judge's behavior. but for the purposes of the senate judiciary committee, they unquestionably need time to investigate. they need the fbi to investigate. and they need to

joining me to talk about this, legal analyst, former federal prosecutor shan wu. is it as simple as we tear it up, you return the money, we're good? >> definitely not, victor, although it is possible cohen could use that money to pay his mounting legal bills, i don't think that's the legal strategy at work here. this is part of a pattern that he is doing trying to drop some suits which could expose more information he doesn't want exposed. obviously having to go forward with the suit in a civil situation you're going to have what's called discovery, depositions, and with regard to the president there's some legal precedent dating back from clinton days that the deposition, civil suits may not be stayed. all of that is a can of worms that he will want to avoid. in addition to that, of course, cohen personally has the issues going on with the justice department investigation and his criminal liability. all of these types of issues where he would have to participate exposes him to further jeopardy. he may have to take the fifth amendment. it has become impractical to

joining me now, joining all of us right now is cnn legal analyst shan wu.ime, he served as an attorney for rick gates, the star witness in the first trial of paul manafort, and jeff toobin is here. does this surprise you? >> well, i mean, what surprises me is that he didn't do it earlier if he was going to do it. all of the benefit you get from cooperating is you don't force the government to go to trial. you get the benefit in sentencing of cooperation. he will get some benefit in sentencing from cooperation, but it's not -- it certainly wasn't as advantageous of him to go to trial and then cooperate. criminal defendants don't always act very rationally. they sometimes are angry. they're nervous. they think they can beat a case. he obviously didn't beat this case. but the real question now is, and the question that consumes the whole matter is, what is he telling mueller's office? what does he know about other people's criminality? and what does he know about any illegality, in particular, regarding the trump campaign in 2016? >> shan, what do you think, a
