shannon i would like to go to you first on this. an interesting exchange to watch. i want to know what you of the town hall debate in how that might affect mitt romney going into the debate tonight? the format of being with the public, questions being asked of him by members of, you know, by american voters as opposed to moderators and in your experience debating with him does that get into mitt's head? >> i think it actually favors him. given what we've seen in this campaign and given what we've seen in past debates. he's a fabulous fabricator and i think when you see that from that exchange he's pointing at me, looking at me and basically i look bad because i'm saying you're not telling the truth, i was right, but in the middle of the debate it's hard to pin someone down who is so convincingly not telling the truth. we've seen so many etch a sketch moments in this campaign. he's getting good at it. i think this format unless candy crowley as she says she may interject herself a little bit, i think it perhaps favors mitt romney because if he's going to consistently

shannon bream in d.c. shannon, thanks. new accusations tonight that the justice department is spying on a lot more americans these days. that's according to the american civil liberties union. the aclu reports that from 2009 to 2011 orders for warrantless telephone surveillance went up 60%. emails and network data increased by 361%. this kind of surveillance doesn't involve monitoring the content of conversations they tell us. that is the government is keeping tabs on to whom people are talking but not what they are saying still an aclu representative says a rise in surveillance is some cause for concern. >> the people have a right to know how these extremely invasive surveillance powers are being used and if there is nothing to hide, if they're not being abused where is the harm in letting us know. >> shepard: federal judge authorized every instance of surveillance and a smokesmanned as as criminals use more and new sophisticated technology the use of orders issued by a judge and explicitly authorized by congress to obtai

shannon bream just outside d.c., arlington, virginia tonight. what kind of damage there shannon? a couple of miles out from washington, d.c. it's a scene we have seen repeated over and over again in this neighborhood. this is a house that i talked to the owner, he is the childhood owner of this home. grew up here. now owns the home. a tree that he says has been here since the civil war fell from its neighborhood's yards into his house. they were actually there in the bottom floor where the tree fell. they just finished dinner, were clearing the dishes when this tree came crashing in last night. can you see into their home, into their ait particular, into the bedroom. clothe hanging there suitcases, all kinds of personal items. i talked to him today. he was very upbeat saying the crews will get out here and work when they can. they did start tonight on tree removal. may give us a chance to rebuild our house the way we have wanted to. is he looking on the bright side. many neighbors coming to help each other out. all across the neighborhood there are trees just like that one down.

lou: shannon, this is remarkable.the 60 minutes piece last night, it is really a compelling story. but it does look to be peculiar in its timing, given the presidential election as it approaches and the fact that we have such a expensive relationship with china. what is going on here? >> well, what's interesting is that question was actually posed to these lawmakers today as they were rolling out the report. i can tell you that there are politics now being played with it. for example, the obama campaign sent out an e-mail and video late today, attempting to win governor romney who's supposed to thousand seven deal between bain capital and one of the companies that was the subject of this congressional investigation. the obama campaign says romney stood to benefit from that potential deal, that was publicly called out by republicans in congress to speak out against it -- he refused to do that. at that time, romney's spokesman said that the governor was not involved in bain capital or any of their investment decisions.
