shannon bream is live tonight at the supreme court. and shannon, truth is, there is more to this thing than just the individual mandated within. >> absolutely. even if the justices decide to strike down the mandate, they have to get to the next issue, which is servelt. this court will have to decide whether or not the law, the rest of it is stand on its own if the mandate is taken out. folks reporting to arguments in one those lower federal courts in which obama attorneys admitted if you take the mandate away it will be tough for the law to survive on its own, shep. >> shepard: they are going to devote an unprecedented amount of time to this case. >> normally if your case is granted here, you get one hour of argument time. each side gets 30 minutes. rare occasions 90 minutes, maybe two hours. today the justices said they are allotting five and a half hours on arguments stemming from the health care law. we haven't seen anything like it in modern times. maybe a record, shep. >> shepard: calls for two justices on the court to recuse thems

i'm shannon bream live in washington. molly henneberg has all the details. hi, molly. >> shannon, the timing is getting tricky for the super committee. here's why. they have to vote on any deal by the last tick of the clock wednesday night. but before they can vote, two things have to happen. number one, they have to get the proposal to the congressional budget committee or cbo with enough time for the number crunchers there to estimate the deal's effect on the deficit and then number two, the super committee by law has to have 48 hours to go over the cbo's calculations. that means that the super committee has to get its proposals to the cbo by tonight or tomorrow morning depending who you ask on capitol hill in order to get it back by monday night and get the 48-hour clock ticking. all that is moot, though, if they can't reach a deal in the first place. based on what lawmakers say this morning, they don't seem very close. >> if we're not able to reach that, then we at least thought maybe there could be a coalescence around the savings we had pretty much agre

shannon bream is live at the supreme court where all the action went down today. shannon?ll, and, jenna, we think that the court may have made modern history in the way they're tackling this health care issue. they're going to hear four different issues over a period of five-and-a-half hours' worth of arguments. normally, you get one hour to argue it. it is going to be a blockbuster. that's coming up in the spring. this whole issue emanates, this particular group of issues, from that lawsuit headed up out of florida but including 26 different states challenging the individual mandate. texas is one of those states. i've spoke with their attorney general, greg abbott, he sounds very confident about whether or not this court is going to find that the mandate which would make every american have insurance or pay a penalty is unconstitutional. >> never before has the commerce clause been stretched so far as to force americans to purchase a product. we believe the supreme court will not expand the commerce clause to include that mandate on americans and infringe upon their liber
