shannon bream on fox top story. she is live at the supreme court again for us tonight. annon, it sounded as if the justices were signaling anyway that they will move forward despite that old tax law. >> yeah, shep. because they would have to decide that the penalty attached to the mandate is a tax. they didn't sound convinced. listen to justice stephan breyer in his questioning today. >> congress has nowhere used the word tax. what it says is penalty. moreover, this is not in the internal revenue code but for purposes of collection. and so, why is this a tax? >> the attorney appointed by the court to answer that question wasn't in a way to do it which seemed to satisfy the justices. which seems to us they are ready to move to the merits of the case. >> shepard: that leads us to the core of what will be tackled tomorrow. tell us what they are delving into. >> tomorrow is all about the individual mandate. the biggest fire cracker in the middle of this law. the biggest part of the debate. whether or not the government can compel folks starting in o2014 to buy insurance have

shannon bream is live at the supreme court tonight. stices appear to be leaning one way or 00 other, shannon? >> well, shepard, many of them seemed to be sympathetic to the government's argument which all along is these twins simply don't meet the definition of a child under the statute. drafted way back in 1939, of course, lawmakers couldn't have foreseen the circumstances that are facing the court today. the government has argued all along these twins could be beneficiaries because the surviving parent brought them into being knowing that her deceased husband wouldn't be alive, wouldn't be around to pay into the wages and funding for social security benefits, shep. >> shepard: it's my understanding that the mother's attorney seemed pretty confident, too shannon. >> he did. he said a will the of times the court is asked to interpret statutes that are decades old that are part of his job. this is something they have to get used to considering. here is a bit of what he told us today. >> it's often the case, congress writes a statute and

shannon bream covers the court for us. she is live there the legal experts are saying just as anthony kennedy the key in all of this and was he giving up signs of his thoughts on it all today? >> well, we got some clues. it started off when he very early on in the questioning said "you can create commerce just so you can regulate it?" which seemed to resonate with conservatives challenging this law saying the government is trying to force people into a stream of commerce to buy something they don't want to buy. here is a little bit more of what he had to say today. >> here the government is saying that the federal government has a duty to tell the individual citizen that it must act and that is different from what we have in previous. that changes the relationship of the federal government to the individual. very fundamental way. >> but it's important to note along with those concerns he also did express during the end of the arguments today that he has concerns about not moving forward with the law. the fact that some peo

i'm shannon bream, live in washington. o live to the supreme court. >> reporter: good morning, shannon. three days of arguments start tomorrow morning in the health care case. it is being watched closely on both sides with all americans interested for one reason or another because it could affect your health care and costs. there is so much interest that there are people in line, many of them are professional line standers, holding a place so some members of the public can go and watch the arguments, starting in the morning. a couple of dozen people here who have been here since friday morning. i talked to supreme court police officers. they say they have never seen crowds, line sitters or other who is want to witness the proceedings, to form that early, three days, three and-a-half days in advance of the arguments. so tomorrow, we are going to be -- we are going to have the question of the anti-injunction act and whether or not a tax can be challenged before it's actually paid. the administration is confident that the law

shannon bream live in richmond. what's happening there. >> it's interesting because you mentioned for a long time we have seen the polls be very wide. huge gap between romney and poll. either they were staying home they weren't going to vote or those who didn't have their primary pick on the ballot a santorum or gingrich, a lot of them were talking about mobilizing, trying to get out and get the vote for ron paul. they wanted to try to make sure that they could keep mitt romney from gaining any more delegates than they expected him to get here in virginia. based on congressional districts. some of them are based on the statewide vote and three super delegates as well there are things in play here. it's possible for ron paul to pick up delegates. he has always known that since he is only going head to head, only one with romney here. the fact is he may have been helped by gingrich and santorum supporters who didn't have a choice on the ballot. they don't allow for wright -- write ins here. >> shepard: nine minutes un

shannon bream has the most to gain and lose in dixie. >> i believe that mississippi really matters next tuesday. >> shannon: gingrich campaign is publicly acknowledging that the former house speaker needs to win in mississippi but also in alabama to remain competitive for the g.o.p. nomination. one new poll shows the southern surge gingrich has been predicting is not a lock. latest poll puts mitt romney at the top. with gingrich five points behind santorum back four points in third and ron paul a distant fourth. right now there are nor no polls because polling has been limited. but some voters say they are undecided, roughly 25%. the calls for gingrich to exit the race are growing. santorum stopped short of joining the color us. >> if he wants to get out it, to get out. i wish everybody would get out. i wish president obama is going to hand it to me but that is not going to happen. >> shannon: the more you call for a candidate to bail out, less likely it will happen. >> people in politics tend to be stubborn, you lost, get out, the response is stiffen their spine, i'm not getting out. >

shannon bream outside the court. what happens today, shannon. a doubleheader. >> reporter: they get to the issue of severability. does the law stand if the rest of the justice strike down the mandate. they have three different attorneys arguing that case. bill: on the issue of the mandate and what we heard yesterday what clues are we now getting from the justices and the arguments and questions they pose? >> reporter: everybody is looking what justice kennedy had to say considered the swing vote. he had tough questions for both sides. it is clear some of the justice staked out where they will probably vote. justice kagan seemed especially open to the government's excuse or excuse me, argument if you don't want to get into health care you still have an impact on the economic stream of commerce. here is a little bit of what justice kagan had to say. >> aggregate of all uninsured people are increasing the normal family premium congress says by $1,000 a year. those people, are in commerce. they're making decisions. >> reporter: doesn't seem like her

shannon bream live in washington. shannon, what is the core of the challenge to what some call obamacare? >> well, jon, this is going to be three days, six hours worth of arguments. at the core of all the issues the court will consider is the individual mandate that says every american has to buy health insurance or pay a penalty. supporters of the law say they have have got a winning strategy. here it is. >> the constitution says congress has the power to regulate commerce among the several states. there is just no question that allawi regulates 1/6 of the national economy is commercial. >> reporter: they're convinced they're going to win but most americans are still unconvinced about this law. "fox news poll" shows 52 disapprove the way the president handled issue of health care. just 43% approve. another poll shows majority of the americans, some 67% thinks the supreme court should strike down the individual mandate or throw out the law all together. jon, we'll have to wait until at least late june to find out what

shannon bream is live from warbgsz covering that. shannon. >> reporter: hi john jon.aring two companion cases today, both involve 14-year-old convicted murderer and sentenced to life without any chance of parole. i stepped out of the first case, that involves evan miller, he and another juvenile convicted of robbing a neighbor, beating him with a baseball bat and setting that man's trailer on fire, leaving the man to burn to death. they ruled it's no chance to send him off for the crime. the justices have decided recent relevant cases that first of all, one, bans the death penalty for juveniles and life without parole in most cases but not specifically when the case involves murder as it does in these cases. stephen briar expressed concern about where to draw the line asking attorneys could you send a 12-year-old to prison for life, what about a ten-year-old or eight-year-old? justice scalia pointed out that 39 states do allow juveniles to face life without parole and in a few minutes, family members of the victims are going speak out on the steps of the supreme court

shannon bream has been following all this every step of the way. she is live today on this momentous part of this proceeding outside the supreme court. shannon what is the challenger's best argument that the mandate is unconstitutional today? >> reporter:, well, martha, first of all you may hear a little crowd noise. we have triple the number of protesters out here yesterday. it is a big day for the court. for the opponents who brought this law to the highest court, they say listen, congress went beyond any powers enumerated into the court or any precedent. a former solicitor general who argueds dos of cases before the people dozens of cases before the supreme court. here is his strategy convincing the judges. how will you win this case? >> i think we'll win this case by emphasizing two related principles. one this is completely unprecedented exercise of congressional power, and, relate he hadly, the government and they have been asked many, many times. doesn't have a limiting principle for their argument. >> reporter: all right. he argued many more
