i'm shannon bream in for bret baier. today was cutoff day for consumers to sign up for obamacare if they want their health care coverage to start on january 1st. however the website glitches struck again. ed henry reports sh the president is making the deadline, sort of, but then or . >> reporter: president obama liked his health plan and he is going to keep it, period. a white house official put out a statement today revealing that as a symbolic gesture over the weekend, in between golf and watching college basketball, the president enrolled in the d.c. health insurance exchange. he was pleased to participate in a plan as a show of support for these market places which are providing quality, affordable health care options to more than a million people and he selected a bronze plan. but he will not have a bronze plan. since like past presidents, he will get his health care by the military. and then he added another caveat, the president did not sign up himself, the staff did it. after all, the president was in hawaii. an

correspondent shannon bream is here with that story. tell us about this latest challenge. >> reporter: today in federal court in washington this is a lawsuit about the text of an irs regulation stemming from the overall health care law. the plaintiffs in this case say the text of the law says those subsidies that go out to help people buy insurance are only supposed to be given out in states that have set up their own state exchanges and not into states where the federal government is the one operating the exchange. the irs says not. so according to the agency's interpretation those subsidies go to applicants in every state. that is a huge distinction. it's very important. because where the subsidies are awarded, that triggers massive costly mandates for the employers. they wouldn't have otherwise. that's why they're suing. they say the costs will force them to cut employee hours, stop hiring, maybe even go out of business. they say this is just another example of overreach by the federal government. they say it primarily stems from the

i'm shannon bream. >>> several cars on the metro north commuter train went careening off the track when the train went around a corner. >> reporter: good morning -- good afternoon. it happened just after 7:00 this morning on the southbound hudson line train. it was apparently coming in what some passengers saying faster than normal. around a curve and it happened just yards away from the station as it was approaching. we'll show you what it looks like from the air. one passenger told reporters, again, it appeared to be going a lot faster than usual, which was 100 yards away from that station. the train was headed eventually to grand central station in manhattan. this morning the national transportation safety board has dispatched its go team and that's who we are waiting to see. it will be those investigators who will be able to pin down exactly what happened once the black boxes are recovered. we have been told there are black boxes on this train, and that, of course, will give all that pertinent information of how fast the train was going. there were over 100 passengers on board at th

shannon bream live from washington with more. >> most of the pending regulations not surprisingly comeervices says the regulatory plans are framed strengthening health care for americans. according to the competitive enterprise institute, the new regulatory plan from hhs comes with a price tag of nearly $190 billion. wayne cruise says the overall prize of for regulatory agenda for the administration will top $1.8 trillion a year. >> back in the '90s the federal budget itself was not even 1.8 trillion. now we have this entire $1.8 trillion hidden tax you could say of government compliance and intervention costs imposed in the economy. like anything else, that, you know, any tax that businesses pay often gets passed down to the consumers. that is certainly the case with regulatory costs. what it does it makes, it makes, prices higher for the things that consumers want. >> reporter: the epa is also one of the top regulation producers. it is facing a major lawsuit before the supreme court in february. by the way regulatory agenda we got from the administration, it includes this disclaimer.
