shannon bream our supreme court correspondent who is live there tonight. shannon, details, please. >> all right. this is how it went down, shepard. supporters of this law often fought and often argued that it would be upheld under the commerce clause. the congress had the power to create this mandate under that vehicle. but today the chief justice john roberts joined the liberal wing of the supreme court and said you can do it but not under the commerce clause. you can do this through congressional power to tax. here is part of what he said toward the close of his opinion, quote: the framers created a federal government of limited powers and assigned to this court of duty of enforcing those limits of the court does so today. they reigned in congress when it came to the commerce clause but said taxing power allows you to do what you have done in this healthcare law. >> shepard: the court ruled on massive expansion of medicaid. give us the details of that please. >> interesting. 26 states had sued. challenging the law as a whole. put millions of new people on to state medicaid rules under the it healthcare law. they couldn't afford it and law became a threat that the secretary of human services could scrap all of the existing money any didn't take the new people on to the roles that medicaid expansion can move forward. here is the caveat from the chief justice writing quote what congress is not free to do choose states not participate in new program by taking away their existing medicaid funding. some folks asked will the states say they won't participate since there is no threat now of them losing that funding? i put that to pam bondi who led the 26 states and paul clement who represented them here at the high court. bonnie said to me that florida officials are going to weigh that before they make any decision. clement said there are enough incentives built in this law that a number of states may go ahead and take the medicaid funding and medicaid folks even if they aren't happy about having to do it. shep? >> shepard: shannonream outside the court for us this evening. so now what? much more coming on today's healthcare decision. including reports from ed henry at the white house and carl cammeron on how governor romney is reacting and what he is promising. that's minutes away. first, the republic controlled house of representatives voted to hold the attorney general of the united states in criminal contempt of our congress. that has never before happened in the 236 year history of this nation. it all has to do with that federal gun sting operation called fast and furious. it was, of course, designed to track weapons to high level arms traffickers. but the feds did not track a large number of guns they tell us, many of which ended up in the hands of mexican drug cartels. two of those guns ended up at the scene of a shootout that ended in the death of border patrol agent brian terry. the republic congressman in charge of the investigation claims the justice department intentionally lost track of the guns. an

shannon bream is live at the supreme court with a closer look at this ruling. good evening, shannon. >> reporter: hello, bret. following the decision, both sides are claiming victory. although they disagree on what it means for future of the arizona immigration law, they agree the legal fight over it isn't over. opponents and supporters of the law sb-1070 got the supreme court decision they have been waiting for. split decision with justice anthony kennedy writing the three key provisions were pre-empted by federal law. a critical provision was upheld. >> the day is a day the key component of the effort to protect citizens of arizona, to take up the fight against illegal immigration, in a balanced and constitutional way has unanimously been vindicated by the highest court in the land. >> the law surviving provisions direct police to inquire in someone's status if the officer has reasonable suspicion to believe the person is in the u.s. illegally or for anyone placed under arrest regardless if there are suspicions about the person's legal status. arizona shouldn't expect help from the feds, though, in many of the cases. custom enforcement is rescinding agreement with the state and local law enforcement in arizona with respect to federal immigration law. president obamap and homeland security secretary janet napolitano issued statements saying they were pleased with the decision. one to make at it state crime not to complete paperwork for or carry alien registration document. another would have criminalized solicitation or performance of any work in arizona by someone not authorized to work in the u.s.. the court blocked provision that would have allowed state law enforcement officers to make some arrests without a warrant. attorney general eric holder said the opinion confirms the government exclusive authority to regulate in the area of immigration. in his opinion, justice scalia said that is what the feds are not doing. he mentioned the president's recent policy directive with deportation against hundreds of thousands of young illegal ill grants and asked -- immigrants and asked is this at the refusal tone force the immigration law? today, governor brewer said she believes the remaining portion of sb-1070 can legally go nefect immediately. acknowledging there are lawsuit against it waiting in the wings. >> bret: shannonam live from the supreme court. thank you. latino voters are a key demographic from president obama and governor romney. so as one would expect, each poised with reaction to the immigration ruling. here is chief political correspondent carl cameron. >> reporter: at a new hampshire high school, president obama made no mention of the supreme court ruling. inted, he issued a written statement to point fingers at capitol hill. what the decision made unmistakenly clear is congress must act on the comprehensive immigration reform. patchwork of state laws is not solution to the broken immigration system. it's part of the problem. the court upheld the controversial provision, allowing law enforcement to check immigration status of individuals stopped for another reason if they are suspected of being undocumented. mitt romney was in arizona, issued a paper statement, too.
