shapiro: there's no question congress has the power to address congressional elections under article one section four, it expressly gives congress the power to do so. congress has the power under the guarantee clause to guarantee a republican form of government has the obligation to do so. there is nothing in the constitution that suggests that the federal government cannot ensure that states operate federal elections properly but it is congress that has that power, not the federal courts taking away. rep. scanlon: thank you and i would defer to our constitutional expert but i believe my recollection is that it was some kind of misconduct in south carolina that led the framers of the constitution to insert that clause. >> i will take your word for it. i know the powers there and the purpose is clear. i'm going to ask a few more questions. the gentlelady yields back. under the extreme versions of this independent state legislature hypothesis, and i have not read the literature about it and would be interesting to know if there is a law review corpus around this, but are they asserting

can you, i think you raise that in your testimony, miss shapiro. can you talk about the impact of that theory and what we need to be concerned about? >> we need to be concerned about, among other things, all of these decisions that the state courts have made and all of the precedent that exists that the state courts rely on in a league that the legislature relies on, whether or not those will continue to be effective with respect to federal elections. you also need to be concerned about whether the rules might be different from federal elections versus state elections, regardless of whether or not the legislature passes different laws, because they might be interpreted differently or because to the extent of the state courts strikes down the with respect to federal court but with respect to federal elections. so there could be an enormous amount of chaos, to put it mildly. >> that has been one of the problems we have had to address, that there has been chaos with changing rules and impacting the electorate and people not being certain of what's goi

what we've seen is josh shapiro for governor going around saying that this is really a test about whethergoing forward in pennsylvania. and you his opponent say the exact opposite which is this is a ballot preservation of life. and these are the types of issues that have played out here. and we'll see it playing out on battleground states this year. >> the senate race between lieutenant governor john fetterman and mehmet oz is bitterly being fought. fetterman has had a stroke. he's recovering from that. he's talked about that. you're seeing that playing into the schedule. he's not as densely scheduled as he would otherwise. he's not doing as many interviews. what do voters think about that and the fact that he isn't, for instance, debating? >> well, i think dr. oz is trying to make hay with that issue and really make light of fetterman's health issues. what fetterman has said, yes, he suffer a stroke in may and he has opted to speak directly to voters and in fact has avoided those kind of heavy one-on-ones with supporters and voters. but he has said he's going to be making -- his doctor s

listen to part of my conversation this morning with josh shapiro, the democratic nominee for governoralked about these walking and chewing gum at the same time. take a listen. >> abortion really did seem to change the race for a lot of democratic candidates across the country. what are you finding voters are most interested in as you talk to voters across the state? >> pennsylvanians know how to walk and chew gum. they can think about multiple things at the same time. i'll protect a woman's right to choose. i'll protect people's right to vote. i think people across pennsylvania understand we have to do both. create opportunity and defend our freedoms. >> reporter: so andrea, that's quite a statement from a potential future pennsylvania governor when you know the history, as you know well in pennsylvania, of a former pennsylvania governor, bob casey, who was anti-abortion. even joe biden, of course, has had his position on abortion evolve over the years. that's one of the main reasons democrats feel like they have a fighting chance here. i spoke this morning with congressman conor lamb

they said this guy shapiro, who is a lightweight. they said he was going to win.was doing well and way up. they had a big base. they don't like that. what did they do? the one we really want to run again is doug mastriano. that's the one they say every time they have someone that is going to kick their ass, they say the one we want to run against. the one person they didn't want to run against was doug mastriano. disinformation. true. i kept hearing it. i would be out and see the people going crazy for doug, for his incredible wife. but it is true. it is true. he was right there from the beginning. day one. he had to fight the republicans and the democrats. he had to fight people. american elections should be determined only by the american people and that did not happen in 2020 and i'm just talking f.b.i. but there are many other things. won't go into it. the mar-a-lago raid was a desperate effort to distract from joe biden's record of misery and failure. the many disasters that our country and the world are now suffering would never ever have happened if i was i

josh shapiro leads by seven against republican doug mastriano.dex, the keystone is three points more republican that the country as a whole. joe biden beat donald trump by only one point there in 2020 less than his national margin of 4.5 points. a theme you're starting to hear a lot the republican candidates are problematic. let's start with mastriano, among other issues, he attended trump's january 6th insurrection, rally at the capitol. the issue may be an experiencing of making gaffes buying ingredients for crudites, not exactly the most relatable halftime snack. fivethirtyeight model thinks these races will tighten not enough to make them toss-up. fetterman, 75% favorite. and shapiro 85% favorite. for governor. so i'm buying this one. although it's far a sure thing, we have enough information to say the democrats are favored. >> our thanks to nate for that. >>> let's bring in the ronaldtable. political director rick klein, usa today washington bureau susan page, host of the run up podcast, astead herndon. and meredith mcgraw. welcome to all o

it's been interesting but getting very interesting with josh shapiro, who shapiro is a democratic nominee governor. he's running against doug mastriano. he's really using abortion and mastriano's stance there, and he dropped almost $17 million on the first ad of this fall campaign season focused on abortion rights and the impact he says it has on pennsylvania's economy. saying, you know, it's very clear that democrats feel this is the momentum from this and that is an effective way to run against a doug mastriano. >> i think that's exactly right, kaitlan. not only because doug mastriano represents this sort of extreme view that democrats can use to paint most of the republican party with in terms of wanting to take away a woman's right to choose, to have her be a second class citizen in her own country, which is how women feel, but i'm sure he's also seen how successful that tactic has been recently fordismes. new york 19, that's exactly what the gist of the whole campaign was. in kansas, the referendum was tremendously successful, not just among democrats. so i think this message about h

josh shapiro has said he's in favor of current state law which allows for abortions up to 24 weeks andg new restrictions. he's tried to make the case his views on abortion are quote, ir relevant to this race, but the state house and senate have been under republican control for a long time and if he were to win, he'd have the opportunity to sign new sweeping restrictions. he signalled he would be interested to signing new legislation similar to the bill he was discussing in 2019, a heart beat bill that would outlaw abortions in the range of six to seven weeks. >> we haven't heard from his campaign since this got published around 90 minutes ago. >> we have not. his campaign traditionally has not been very responsive toward more mainstream media outlets. >> what about josh shapiro's campaign? i would wonder how the democratic candidate might be looking at these comments. >> his campaign highlighted these remarks saying they are emblemmatic of the kind of abortion policies that mastriano stands for and how he would lead on this issue if he won the election this fall. >> alan, as always, t

both are trailing but mastriano is trailing josh shapiro by a lot. what is your read? quote you heard earlier red is better than blue there is an idea people see a real consequence to the senate. they understand the balance of the senate is meaningful to kind of the overall policies. i feel like governor is one of those roles where people are a little more thinking reich this is going to affect my life, my state, my topics. it still has at least a whiff of local politics to it and even in this age and so you can't sort of look at those numbers the same way. i think people are very capable of looking at a senate race and saying, as long as it's in our favor that's a good enough vote for me whereas for governor they might think differently. i'm from massachusetts. in the past there was a lot of sort of cross party voting for various reasons. so maybe i'm biased. but i do think there is a difference in how people look at this. >> interesting. we'll see how the numbers line up at the very end. >>> coming up allies of donald trump launch a new super pac to boost midterm can
