shaq, good morning. thanks for being with us this morning. this is all coming amid heightened security and measures. set the scene. >> reporter: new measures. you see some of the old measures, fencing and barbed wire. that's been in place since jury selection. this week we'll see prosecutors begin to make their case against the ex-officer accused of killing george floyd. we'll see opening statements and witnesses coming along this week. i mentioned the jury was set. let's take a look at what we know about the jurors 156789 were selected. the 15th juror will be dismissed once those 14 others show up on monday. so it will be 14 jurors hearing the case. of those 14, we know that 9 are women, the others are men. i spoke to a defense attorney here and he is not connected to this case at all but he has argued in this court in front of the same judge. listen to what he told me about the makeup of this jury. >> minnesota's not the most diverse state but we are in the most diverse county and so it's definitely unusual for jurors to be all white. not s

shaq, as usual, just a reminder for our viewers.in live so we don't unintentionally identify any potential jurors. that being said, my understanding is that they are on break right now. what are you hearing? >> reporter: that's right. a quick break right now right after that additional juror was added. something that we are seeing this morning in the proceedings is that that civil settlement between the city and family of george floyd is making its way into the criminal proceedings. among the attorneys, the judges and even among potential jurors. the first potential juror that was questioned this morning was dismissed after she said she heard the headline of the $27 million settlement. she guessed when she heard it -- she said it shifted her opinions that would not allow her to sit impartially. they raised the complaint with the judge about news of the headline. i want to take you into the courtroom for that moment. look at this. >> i am concerned with the news that broke on friday relevant to the civil settlement in this case. by m

shaq, we will start with you. what do we know about the fourth juror?ow? >> reporter: jeff, the jury selection process is anonymous. we won't have our eyes on the juror. we are pulling out clues from the questioning phase that we are listening to. we know this fourth juror, he is a man. he is from central minnesota. we know he has a wedding coming up in the beginning of may, which can conflict with jury deliberations. don't worry. the judge said they will make sure he makes it to his wedding. he will be joining three other jurors seated yesterday. two of them are white men, an auditor and chemist. another is a biracial woman in her 20s or 30s. you have both sides asking interesting questions to these potential jurors. one thing that the prosecution is making clear about is that they are keeping a close eye on the racial makeup of the potential jury. i want you to listen to an exchange we saw in the court yesterday that showed exactly how much they are paying attention to this. >> i draw the parallel between juror number four, who is hispanic, and juror

shaq, let me start with you.t have we seen from the court today and how is this being received by those where you are in minneapolis who are focused on these proceedings, focused on justice here? >> reporter: we saw pretty sizable demonstration on the first day of this trial. it started at the courthouse. it remaped peaceful. it was a coalition of group. you had students, religious leaders all trying to put support behind george floyd and when you talk to people in the crowd, the people coming out to demonstrate, you get a big sense of nervousness about what is going to happen with the proceedings. they say it was the protest they believe led to the charges for derek chauvin and the three other minneapolis police officers, now ex-police officers and they believe it's their demonstration that will keep the pressure as the trial continues. there's pause right now on the trial. we expected today to be the start of jury selection. all the potential jurors have been sent home already for the day. the judge is saying t

shaq, good morning. >> reporter: good morning.led to the city of minneapolis yesterday for the announcement of that settlement, $27 million, a record payout by the city of minneapolis and one that was approved by the city council unanimously. and what we heard from the family is the same thing that we heard when they first launched this federal civil lawsuit -- they want this to be a wake-up call, a message to other police departments in other cities across the country. in other words, they want there to be a financial cost, the consequence for what they consider police misconduct, and that was the message you heard repeated yesterday with the family here and the family attorney, benjamin crump. now, 500,000 of those dollars will go to the exact community where george floyd was killed. that was a place that you saw the family visit after the announcement. they laid flowers. they got on their knee in a silent prayer and joined members of the community. i want you to listen to a little bit of what we heard from the family attorney y

shaq, let me start with you. we're still having witnesses that are -- what i would call sort of firsthand eyewitnesss to what happened that day how many more witnesses, eyewitnesss from the day do we expect and when do we expect them to move to expert >> that remains to be seen, chuck. the prosecution has not given us, certainly, any preview of what they are going to do, or at least any schedule we got a preview in those opening statements, but we don't know when the different witnesses will testify but i think something that is clear from this morning is, we just don't know how much more is out there in terms of this video. the video surveillance from inside the cup foods, it helps paint a fuller picture it gives us an idea of what george floyd was doing in the moments before this incident started. how he handed off the counterfeit bill and you heard a key thing from that witness there, in part of the interaction. this is part of the cross-examination with eric nelson he said that the reason why -- he said, firs

shaq brewster is in minneapolis with us. and also melissa madmurray is w us. >> reporter: and we're now down to seven juries. we started with nine. the judge asked them if they knew or heard about the record settlement, the $27 million from the city to the family of mr. floyd. most of the jurors did hear that headline, i mean this is something that was on the front page of the star tribune, but two admitted that it affected how they viewed derek chauvin. one said that it made him feel more negatively about chauvin and the other said that they were shocked by the sticker price and swayed by the number, that $27 million figure. so what happens now? jury selection will continue in a few minutes court is out of session for about ten minutes, and so jury selection will continue and they will work to rebuild that jury panel. one thing that we also heard the judge mention at the beginning of that motions hearing when he went through and requestioned the jurors, he said on the motion from the defense to continue or delay this trial

shaq? >> reporter: hi there, nicole, i'm looking at notes from the courtroom and what just happened. it looks like the judge just sort of reprimanded the witness there, saying that the counsel has a right to ask the question. your job is to answer. when the court counsel is asking you a question, you don't volunteer extra information. i think one thing that i noticed, as you're watching through today's proceedings, these are regular people. i mean, this is a firefighter who was off duty who went down and was going on a walk and encountered this situation. we talked about mr. williams from earlier today, who went fishing earlier in the day that george floyd was killed and was at cup foods getting a soda. and the rules that you have in a courtroom, how questions are asked, the tone and what things are said, there are specific rules that you can tell some of these witnesses are getting frustrated by, and that is the case with this witness right here. i think before this instance, though, you s

shaq, we have been waiting for a final ruling on the third degree charge for about a week.for the defense? what does it mean for the prosecution? >> reporter: this is by definition a win for the prosecution. let's just take a step back at how we got here. that third degree murder charge, that was the first charge against the former minneapolis police department officer derek chauvin in the summer in the weeks after george floyd was killed. that charge was initially upgraded to second degree murder and second degree manslaughter. in the fall, the trial judge, the one who we showed live pictures of, he dismissed this third degree murder charge. after a long and lengthy appeals process that wrapped up last night, it was this morning he reinstated that third degree murder charge. bottom line is, we know there will be no delay in the trial, at least not one based on that third degree murder charge. the jury selection process that we are watching, that will continue. the time line that we know of will continue as we know it. what we are seeing in the jury selection process, you m

shaq, i understand that the other bit of breaking news is that we have our 13th juror, who has just been what more can you tell me about that? >> reporter: that's right, craig. in the past couple of second literally, we got our 13th juror. the court just needs one more to complete the jury panel in the trial of derek chauvin, the officer accused of killing george floyd. this has been a significant news day in terms of the trial. the judge this morning denied motions from the defense, from the attorneys of former officer chauvin, to delay the trial and to move it out of the city of minneapolis. i want to play you a little of the judge explaining why he decided to make this decision. before we do that, i want to set it up by making the point, the reason why the defense was asking this is it goes back to the settlement between the city of minneapolis and the family of george floyd. that was something that got a lot of attention over the course of the weekend. the defense asked for the judge to delay this to let things calm down a little bit. this is what the judge said today. >> i do not th

shaq, you have been in that city for weeks. tell us what is it like there and what is the plan today when the trial resumes, what are you watching for? >> stephanie, the trial will resume at 9:00 a.m. local time. the jush will be brought in 30 minutes later at 10:30 eastern time and then we expect to hear testimony from donald williams, the state's third witness in this case. he is -- when you watch that video, he's one of the more vocal bystanders as george floyd is under the knee of ex-officer derek chauvin for 9:29 period of time. as he was testifying yesterday, he talked about his mixed martial arts experience. in that video you hear him say get off with him, you hear him pleading with officers saying he's not moving or resisting. he talks about the different choke hold he believes derek chauvin was using in that incident. based on the reporters in the room, there are only two reporters allowed in that courtroom, they reported back the jury was listening to him more intensely than the other two witnesses, saying that the ju

shaq, thank you.e challenge for the defense and prosecution is basically finding jurors who likely have seen that video but can still be impartial. >>> i want to bring in someone who has experience on both sides. david henderson is a civil rights attorney. he is also a former prosecutor. before we get to that, i do want to ask you really quickly, just got this email from the deputy chief of staff for the attorney general here. i will read part of it. we can talk about what it means. basically the state fully ready to go to trial, according to the ag. the trial must be conducted in accordance with the rules of the law. now that mr. chauvin stated his intention to appeal friday's ruling to the minnesota supreme court as is his right, the district court does not have jurisdiction to conduct jury selection or rule on other matters in the trial. what does that mean? >> let's talk about this two different ways. let's talk about it in terms of what the law literally says and what it means in terms of trial p

we just don't know how that will turn out yet. >> shaq, you will be on this as long as this trial takes>>> joining me me now is janai nelson and associate director for the naacp defense fund. first of all, the importance of a third degree murder count issue, how big of a deal is this for the prosecution to try to rescue it? >> it's quite significant. we want to make sure in a case this serious every possible charge is being levied and offered for the jury to consider, considering the facts of this case that are so incredibly egregious. the jury deserves to consider every possible avenue for third degree conviction and the third degree murder charge allows for yet another opportunity to hold derek chauvin accountable if they believe the prosecution met its burden. and that's critically important. we don't want to see justice denies because of the incorrect charges were brought or because not sufficient charges were brought. so it's very important to get it right and to take the time to get it right. there's so much riding on this particular trial in terms of the integrity of it, in terms

shaq, what's the latest? >> reporter: we'll see prosecutors begin to lay out their case against ex-officer derek chauvin, accused of killing george floyd. we know that court will gavel into session about 9:00 a.m. central time. the judge will come, make a quick statement and then he'll swear in the jury of about 14 jurors. we know that 15 were selected over the course of jury selection. that one jury will be dismissed if the other 14 show up. we know nine are women, the others are men. we know that eight of them that will be seated in the 14-panel pool or 14-member pool will be white. four are white and two identify as mixed race. once that jury panel is officially seated, then we'll hear opening statements from the prosecution. and what lawyers and attorneys who have argued in this county before warn me is that you won't see that law and order, that dramatic emotional moment in the opening statements, or at least that's not what is expected. instead this will be somewhat of a road map for the jury and lay ou

shaq, talk about the makeup of the jury. >> reporter: what we know, it's 15 jurors who were selected through jury selection. 14 of them will be in the courtroom for the beginning of opening statements. nine are women, the others are men. when you look at the 14 who will be in the room, eight are white, four are black, and two identify as mixed race. they'll remain anonymous through the process but we learned a lot about them through jury selection. let's meet a few of them. the first person seated, juror number 2, a white man in his 20s who works as a chemist. during questioning he said he's into ultimate frisbee and backpacking and hasn't seen the video that ignited a social justice movement. >> you have not seen any of the social media videos or news stories with clips of the video or anything? >> no. i've seen the still -- there's a still image that was pretty common. that's the most i've seen. >> reporter: then there's juror 55, a while single mother of two in her 50s. she's an executive assistant at a health clinic. >> i strongly believe all lives matter, they all matter. >> rep

shaq, you've been on this story since the beginning. when i arrived in minneapolis at the end of may last year, you had already been here and you have been covering it since from both inside and now it's going to be outside the court house and now inside. what are you expecting? >> reporter: well, what we're expecting is prosecutors starting tomorrow to begin making the case against that ex-officer, derek chauvin. we know that court will be in session at 9:00 a.m. local time. we'll hear from the judge initially. he'll then swear in that 14-member jury panel and then we'll hear the opening statement from the prosecution. attorneys here warn the opening statement is not going to be that law and order moment that we're so used to, that emotional argument. it's a statement. it's going to be them laying out what we will hear over the course of the trial. they'll preview some of that evidence. that's what we'll watch take place in the courtroom tomorrow and then eventually we'll get to witnesses. all of that is happening as you're seeing outs
