district judge robert shelby denied the state's request to halt issuances while they appeal the recent ruling that banning gay marriage is unconstitutional. >> not only can the same marriages continue but the counties where the clerks seerj refuse to issue the licenses or close their doors have now gotten a clarified ruling as to what the law in utah is and those county clerks should be starting to issue additional licenses. >> in 2004, 66% of utah voters passed amendment three which defines marriage as between a man and a woman. >> yeah, the state is disappointed in the ruling. >> the assistant attorney general told the judge, for this state marriage is about responsible pro-creation and child rearing. >> the state's interest in fostering and encouraging marriage between a man and a woman is to provide the environment that is preferred, to have children raised by their biological mother and father. >> in one of the most conservative states and home to the church of jesus christ of latter day saints which said it stands behind the traditional marriage, reaction was mixed. >> i'm okay w

. >> you know, holly and shelby -- were strong in their faith, and their family and their friends, and there are some people in life that are givers and takers, and they were truly givers. >> it is so difficult to watch. i get chokeed up. let's bring on the host of a show and a criminal defense attorney to get legal perspective on this case. that's part of the difficulty here. there's a lot of emotions tied up in this. let me ask you, mo, what do you think of this defense? >> i couldn't believe it when i heard it. i've heard the term before used in a satirical way, as commentary to what happened to overprivileged children but never as a defense that actually works. i think the lawyer was fabulous in this case. they figured out a way to do this and make it effective, but it's just -- it's a shame on the law for allowing this kind of result based on that presentation. now, if this would have been about not sending a child to jail, i think a lot of people could have taken it differently, but this in itself i think is egregious. >> who's at fault here actually? the defense came up with a c

>> i believe it is a distinction without much of a difference and i believe shelby made that, the windsordecision turned on the individual rights of two people to marry two people of the same sex to marry and that seems to be something that's going to prevail here, whether it's the state's trying to interfere or whether the federal government is trying to interfere. >> i wonder if you are in utah and thinking about getting married and you're a same sex couple and you are considering this now, is there a bit of a risk? are you thinking about this carefully now because there could be a situation where the appeals court does uphold the ban. it may be a small possibility, but there's a possibility isn't there? >> yes, i think there probably is something that is in the minds of same-sex couples that maybe their marriage will not be ultimately ratified. but i think a lot of people are anxious to move forward. >> you think this is settled all? >> i'm not saying it's settled all. >> jennifer do you believe this is settled law or not? >> i believe it should be settled law. i think it eventually sh
