shimon, we'll get back to you. i want to get back to the breaking news that the fbi deputy director andrew mccabe is stepping down. rob acosta is joining me now. what are you hearing from the white house? >> reporter: we do expect sarah huckabee sanders to address this briefly, that's only natural. the president did not comment on this. we do understand from sources talking to us that he was notified of this earlier this morning. but wolf, i just talked to a source familiar with this matter who tells me this was a mutual decision, that andrew maccabe ws tired of being criticized and undermined with the president tweeting about him last september. but this was a mutual decision in that the white house was tired of andrew mccabe as well. according to a source i spoke to, people in the trump administration were not happy with andrew mccabe. it seems we have another shoe dropped on this russia matter. as you know, and you've been talking about this a few moments ago with shimon, they not only fired the counselor and wa

our crime and justice reporter, shimon prokupecz joins us now from washington. let's start with the latest from this op-ed of the founders of fusion gps, shimon. >> reporter: that's right. poppy and john, this was really their way of -- it's the first time we're really hearing from them in that they're defending their actions, fusion gps. they have taken a lot of hits, both from congress, both from the president and the president for their actions, for their work. and this is the first time we hear from them where they're defending some of their actions, some of the work, as you know, they hired a former mi6 agent, christopher steele, who helped compile this dossier. and in this op-ed, they talk about some of the contents, some of the credibility that was given to this dossier. here's one quote from it where they say, basically, that as we told -- this is in their testimony before the senate judiciary committee, that as we told the senate judiciary committee in august, our sources said the dossier was taken so seriously, because it corroborated reports the burea

first, to our crime and justice reporter shimon prokupecz. what do we know about sessions speaking to the mueller team? >> we have been told this interview, the meeting with mueller and his team happened last wednesday. lasted several hours. and presumably he was questioned about his knowledge concerning the firing of the fbi director and also the other key issue in this investigation, the contacts with russians. remember, jeff sessions was leading the foreign policy team for the trump campaign. members on that team have been questioned by the fbi. some have pleaded guilty, like george papadopoulos, george papadopoulos has talked about his conversations with the attorney general during the campaign. all of this undoubtedly something that sessions would have been questioned about. and just think about this, brianna, you have fbi agents who technically report to the attorney general, now assigned to the special counsel, who are presumably probably in this room, questioning the attorney general about his knowledge concerning the firing of the fb

shim mo shimon, what are you learning?> this took place last wednesday and as you said went on for hours. now what is important here is that sessions has been part of probably two of the central issues in this investigation. that is the russia contacts, also he was running the foreign policy team during the campaign and we know that much of that team is now under scrutiny, some of on that team, george papadopoulos, have pleaded guilty and are now cooperating with the fbi. he was also in on the comey firing, helped draft a memo that ultimately was used as justification to fire the fbi director. so there are two central issues here that presumably sessions would have been questioned about. so, the fact that he went in without a subpoena is not that kind of -- it is normal for that to happen. he is the attorney general still. and certainly mueller has had a lot of questions and has been looking into a lot of the issues that sessions has been part of. >> shimon, thank you for the reporting. stay with us if you would. let's go

shimon prokupecz. thank you. >> susan henry is with us. before we talk, i want you to hear what the president says? >> are you committed to doing that, sitting with mueller? >> just so you understand, there is no collusion. there is no crime. and in theory, everybody tells me i am not under investigation, maybe hillary is but i am not. there is been no collusion. there is been no crime. we have been very opened and we could have done it two ways, we could have done it very close and taken years. when you have done nothing wrong, lets be opened and get it over with. honestly, it is very bad for our country, it is making our country looks foolish. >> susan, lets be open and do nothing. >> so just because he's indicated a willingness to meet with robert mueller, we'll see whether or not that'll play out. it will be significant whether he's willing to sit down with mueller's team. it is a crime to lie for a federal investigator. that's not really the end of the story though, it is not just whether the president is willing to sit down with muel

. >> shimon broke pez with more. what are you learning? >> that story published by "the washington post" says that during an oval office meeting the president asked then acting fbi director andrew mccabe who is right now the deputy director, about who he voted for. mccabe went ahead and shared details about that conversation with some of his executive staff and in the conversation according to "the washington post" the president asked mccabe who he voted for. mccabe didn't feel comfortable, and didn't tell the president who he voted for. also apparently in that conversation the president was frustrated, sort of raised the issue about mccabe's wife receiving donations the democrats. she ran for a state office in virginia. remember now andrew mccabe has caught a lot of fire, has taken a lot of heat for his wife, for her running for office as a democrat. also, he led the hillary clinton e-mail investigation. there's been a lot of fire thrown his way, he's had to be a punching bag for the president in his attacks against the fbi. >> we're also

explain this to us, shimon says now they have in their back pocket still this subpoena before the grandy. but why was bannon subpoenaed when he seemed to work out what everyone else did, which was just having an interview with the counsel's team? >> i think that you see in mueller a view of people that he trusts and doesn't trust. so with manafort, for example, we asked, why did they have a no-knock entry into his apartment, why not knock on the door and come in? because he didn't trust manafort. the same thing is probably true with ban. doesn't trust him and wanted to send a message that this is serious stuff. you can't just be talking to attorney for the independent counsel staff and the same way you talk to wolf and fire and fury book. different environment. >> he's said he's invoked executive privilege as we understand when he's talking to house investigators up on capitol hill. he's not going to have that protection when he talks to robert mueller's team. but i do wonder, he has invoked executive privilege when he's talking to house investigators when it comes to his time on the tr

shi shimon, what exactly is devin nunes after and will he get it? >> reporter: so it appears that nunes, controversial a little bit, conducting in some ways his own investigation, and he's specifically been harping on, trying to get information from the department of justice and the fbi on some of the information that they have related to the steele sdossier. he wants, according to some people i've talked to, he wants information on some of the witnesses, some of the information that was used to compile the dossier. but a person i spoke to says they believe that they've given nunes everything they have, everything that is related to his request that they, at least have, that they can provide him. that's the department of justice. so they're not even sure exactly what more he wants, and whether it even exists, so this is in some ways, while these requests are coming often from nunes, they're making a lot of noise. it doesn't appear that there is anything else that they need to give him right now. >> all right. shimon prokupecz in washington, thank yo

we're joined by cnn's shimon prokupecz.et's start off with what the president's lawyers are now saying. no testimony? >> reporter: according to sources familiar with the on going negotiations between special counsel bob mueller and the president's lawyers, what we're being told is right now the lawyers intend -- the president's lawyers intend to push back and argue that the special counsel has not met the threshold they believe is ned to interview a president. now, as we all know, the president himself said he would love to meet with mueller, but has always maintained he was waiting for his lawyers to tell him what to do. as with everything, this is an ongoing negotiation, and with the white house, anything can change. but, john, ultimately the question becomes what does mueller do if the president says i'm not doing it? >> right. he has some legal options there, so does the president. there's also word that firing mueller, despite all the denials from the white house, from republicans saying mueller doesn't need protection

what's going on behind the scenes, shimon?'s right, john, this anticipation sort of, it's coming off a recent meeting the president's lawyers had with the special counsel and cnn is told that some of the options being considered by the lawyers, internal conversations by the president's lawyers, are, perhaps, where they would have the president testify under oath, maybe he would provide written answers to questions that the special counsel would provide, and then finally, whether trump's testimony should be recorded in some fashion, whether that would be a video recording or some other thing, and fed out to a -- to the special counsel, maybe they would record it for future use. it's unclear as to what that option really means. and what we're basically told is that this interview would be conducted by the fbi and prosecutors, attorneys, for the mueller team and keep in mind that no date has been set, but at the very least, the lawyers for the president right now are researching and preparing for all of these options. john and po

cnn crime and justice reporter shimon prokupecz with me now on this. the president says, yes, absolutely, shimon, his lawyers they might tap the brakes there. >> reporter: that's sort of the message that, you know, we keep getting from different people, certainly from the president and some of his attorneys. and then in private conversations that our reporters had with people close to the president. you know, we really don't know ultimately what the president is going to do. now, naturally his attorneys want to show that he's being cooperative, that he's willing to do it, but that is a key distinction, a key phrase here, you know, it will be up to the lawyers. he's going to take the advice of his attorneys. because keep in mind whether this happens under oath or not, talking to fbi agents, being interviewed by them and answering their questions, you have to be truthful because if not, you could be charged with a crime of -- for basically lying. that is definitely a concern. the other concern here, brianna, this is important, the president's lawyers rea

shimon has the details on this. what are you hearing? >> reporter: the interview of the former spokes person for the legal team, this was the initial legal team that worked for the trump lawyers when the special counsel was first appointed, mark corallo, we're now being told that he intends to meet with mueller in the coming weeks. he is important because he perhaps may have information surrounding that air force one meeting that involved some of the president's aides where they were figuring out how to respond "new york times" report about the russians, a russian lawyer specifically meeting with donald trump, jr., jared kushner during the campaign. a statement was crafted. mueller, the special counsel, has been looking into that meeting on air force one, how the decision came to give that statement and so he's one of the people who has some knowledge of that meeting and we're now told he's expected to appear before mueller in the next two weeks. now as to jeff sessions, what we're told is as part of his interview with the special counse

s shimon, what else are you learning? >> the relationship between the fbi and the department of justice is pretty much frayed here. there is a lot of problems. and just keep in mind, you know, what this must have been like on wednesday when sessions was interviewed. probably fbi agents asking him questions, technically attorney general is their boss. they were questioning their boss in an investigation that he is pretty much central on two issues. that is the firing of the former fbi director, and then also the contacts with russia and the foreign policy team during the campaign. and, you know, the former fbi director sort of alluded to something during the time that he testified on the hill about this investigation when he was -- when comey was still the fbi director. he never really wanted to publicly reveal some of what their investigation found as it related to sessions. remember, he did that in the closed door, some of it did come out, it was about some meetings potentially at a hotel here in washington, d.c. and als

shimon is here. one other key here, cnn reported overnight, unlike with the interview with congress, he will answer everything before the special counsel, his legal team says there. do you have any sense of what the areas of interest are that the special counsel has with steve bannon? >> anything to do with the transition and his time at the white house. they are still investigating the campaign. you have to think about michael wolf's book and that is no doubt a factor these prosecutors and investigators on the team probably read through this book and questions came to their mind. the comments about money laundering in the book, his comments about the comey firing, those are the types of things no doubt those investigators and prosecutors are going to want to know about and who was behind the comey firing. what was the thinking at the white house. so certainly all of those things will probably come up. also, you know, whatever he says isn't necessarily whatever bannon may tell investigators isn't nec

shimon, thank you very much. let's get more on all these major developments. i'm joined by the former special prosecutor during watergate. let's talk first of all about the pressure that the attorney general puts on the new fbi director, christopher wray, to fire his deputy. what's your reaction when you heard that? >> chris wray is a professional. he's got great respect in the legal community and at the fbi now. mccabe is very popular, very well respected among the rank and file at the fbi. and wray is simply not going to take direction about his own personnel decisions with respect to his deputy. so this appears to be sessions trying to curry favor with the president. he's been out of favor for such a long time and here this might seem to be an easy way to do it, but he's run into the resistance properly of the fbi director in saying, hands off, my deputy. >> how extraordinary is it that the special counsel robert mueller, a self-performer 12-year fbi director, has actually called the attorney general of the united states, jeff sessions, to come and answer q

shimon prokupecz is back with us now. what does that mean? >> we know that the three people we're told were involved in some of the pressuring of getting the attorney general not to recuse himself from the russia investigation, don mcgahn, reince priebus and sean spicer. it's not clear if there's anything criminal or perhaps how this would play into possible obstruction charge but politically we can't underestimate obviously the implications of this. but it is going to be part of anything perhaps that mueller and his team will be looking at to sort of try and look at a larger picture of what the white house was doing here, of what the people close to the president, the president's orbit were doing here and also questions surrounding the firing of the former fbi director, questions about the statement, the crafting of a statement that the president was directly involved in aboard air force i where they were responding to a the "new york times" story about the president's son meeting with a russian lawyer at trump tower. all of this just kind o
