so far lisa murkowski is getting most of those votes.e in juneau, alaska where the ballot are being counted, dan springer is there. >> reporter: the miller camp made allegations and they are filing another lawsuit today. >> reporter: this is the election that will not end and end up being decided by judges. the lawsuit you mentioned today will be in state court. that is going to be an effort to get the voter rolls to match that up against the votes that were cast at the precinct. the other issue was the allegation of voter fraud. that happened midday yesterday during the count as the count continued to look good for lisa murkowski, a strategist for joe miller came here and said they received numerous complaints of voter fraud and intimidation. his goal seemed to be he's going fishing. he could not produce any evidence, we kept asking him for that. i announced the creation of a miller campaign voter fraud hotline number. the counters kept stacking up the votes for lisa murkowski leaving miller and his supporters with very few options. >>

lisa murkowski, as you said, she ran as a write-in candidate, a republican, where you had to write in her name. sove to physically count ballots and say, is lisa murkowski's name written in and an oval filled in next her name so that qualifies as a vote for her. but there's a little bit of drama about spellings and miss spelling, should a misspelling if one letter's off qualify for her? seeing something strange, man. we're seeing perfectly spelled ballots, that have her name spelled correctly, were being challenged there in juneau, over the week. the miller camp was say, maybe there's a smudge, maybe the handwriting wasn't quite clear. we're seeing that, too. >> wait, what is the challenge? you're trying to explain if it's spelled perfectly and there's a smudge? we're getting to smudges now? >> yeah, the miller campaign, i presses them and said, what you just said what is the complaint here? some of the ballots are being spelled perfectly correctly. and again, their contention is, you know, maybe there was a smudge, maybe the handwriting was written in cursive and we didn't under stand what one le

an overwhelming majority of those votes so far have been counted for lisa murkowski. 9 percen 89% counted in lisa murkowski's box. about 8% of all votes counted yesterday were counted for lisa murkowski but contested. that essentially means folks from the miller camp believe they shouldn't have been counted for her. these votes are going to be key ultimately if this goes to a court of law, because those contested ballots are going to be the ones that the court reviews and looks at first. the murkowski camp -- or the miller camp, rather, arguing all along any variation of lisa murkowski's name should not be counted at a valid ballot. the officials elections say it's their job to determine voter intent. if they can phonetically pronounce a name they're going to count it for lisa murkowski. we saw a lot of variations, murkowski spemed with an e or a y instead of an i at the end. by the end the day, some of murkowski's people were actually saying that the miller camp was rejecting some of the ballots on frugalous grounds. miller people disagree. here's what they both had to say about that. ta

this write-in, for example, leans too far left or runs the letters together so you'd never guess it says lisaright? challenge. this one, another one. this one leans too far right or something. this one can't be a write-in for lisa murkowski because i don't know what, joe miller is the true conservative leaning right or something? joe miller has filed suit in federal, mark that federal court to block alaska election officials from counting write-in votes in which lisa murkowski's name is misspelled even minorly. even if the election officials think the voter clearly intended to vote for lisa murkowski. mr. miller argues that alaska's state law prohibits any misspellings whatsoever from being counted. also, maybe people who cast write-in votes for lisa murkowski but misspelled her name didn't want their votes to count maybe they did it on purpose to protest her candidacy. can i note that a big part of miller's campaign appeal was states' right, states' rights this, states' rights that, let the states deal with unemployment insurance and social security. the minimum wage is a federal overreach.
