jackie, why south florida? >> well, this is really a statutory thing. of the crimes that trump is likely potentially going to be charged for actually occurred in florida. and so if you are looking through hypothetical charges, the removal of the documents could be charged in d.c. but wrongfully retaining documents which is sort of a charge that we have heard that prosecutors are discussing, that is better suited to charges in the jurisdiction where the crime was committed which is mar-a-lago. and so the process is that once the grand jury is done hearing evidence, then the appropriate magistrate and once an indictment a voted on, but there could be multiple jurors we've heard of, then once the indictment is voted on, it is assigned to a specific courthouse in south that. which is most likely going to be west palm beach. but this is sort of an in the weeds thing. but we did get sort of a tipoff this weekend once we found out that, yes, the grand jury in d.c. hasn't been empanelled for several weeks now, nearly a month, but the grand jury in miami is stil

you've got flood watches in effect for several counties of south florida.effect. this is the first named storm of the system. noaa's official forecast calls for 12 to 14 storms this season, one to four of those expected to be major hurricanes. colorado state calling for an average season this year. the key thing is they've upped their numbers since just a few months ago and part of the reason is how warm the water is not only in the gulf of mexico, but the caribbean and atlantic ocean. extremely warm for this time of year and that typically leads to the formation of more storms because that warm water is fuel for the storms. however, to counteract this, we are anticipating el nino this summer, and typically because of el nino that jet stream shifts a little bit farther south, increasing wind sheer. wind shear is not an ingredient that you want to have for hurricane formation. typically you see fewer storms or weaker storms, especially in this particular region here. the question is, guys, is whether or not those above normal sea surface temperatures can cou

we do understand the grand jury has at least one more witness, tim, from south florida.nvestigation is wrapping up. >> yeah. >> you don't think an indictment is merited. i want to stick to this question very specifically. do you think an indictment, if they're going to go there for donald trump, is going to come this week? >> i wouldn't think so, just because of the logistics of it, if they're opening a new grand jury down in south florida and going that direction, i think for it to be this week would be rather quick. plus, they had a meeting this morning where i'm sure that my former colleagues presented them with a lot of important information that they would have to follow up on. so, to actually bring it this week i think would be a little bit hasty. >> so you don't think it's coming that imminently. and you don't believe that trump is going to be indicted, at least -- or are you saying you don't believe he should be? >> based on the facts in the law, i don't think he should be indicted. that being said, i've made a career of representing people who probably shouldn't

point, this is a moment of real shifting politics in the state of florida, and particularly in south floridang was today, miami-dade county, in 2020, joe biden won that part of florida. just this past fall, ron desantis beat charlie crist by almost the same margin. things are changing, and that might have an impact. first of all, we don't actually know if it'll be miami day county that the jury will be picked from, it could be west palm beach, but things are changing in the part of that. >> and if it's the palm beach county, biden in the last election won by 13 points. that is a whole different venue. maybe there's a sense -- look, a lot of people thought this would be done in the district of columbia, the jury would've been easily to find, et cetera. there is a reason that the department of justice, i think, went to florida. the documents were in florida. they don't want to be challenged on the venue. it might make it more difficult for them to get a jury that they think they're going to like, but i think they figured that it's worth the risk because they did not want to waste time on a cha

that it would be faster to do this in south florida, that speed seem to be a part of. it so he is saying that it is possible, possible, that this could get through the system prior to the election. >> i think that's right, and before this point, if you were to ask me what is trump's strongest legal argument, i would have said venue. if they brought in d. c. , that would be the place that he could make an argument and a challenge that they brought in the wrong jurisdiction. which could also ultimately end up in the entire case being thrown. >> so the risk is it being thrown out, and even if you win, you just burned a lot of time. >> exactly. exactly. so, now they've taken it off the table. because in florida, the -- strongest legal argument that is exactly where it should be brought. there is no venue challenge that's gonna come up in bringing him in florida. >> and obviously, we know, we obviously haven't seen it, we know from jim trusty and from cnn reporting, you've got espionage to witness tampering and conspiracy, among what's reference in the summons that they got

does it speed it up enough, that this could get it before the election by doing it in south florida.> that's an excellent question. i know that's on everybody's mind. i think, you know, as we've talked over the course of the last year, this is -- this is right up against the line at which it is conceivable that it could get to trial before the election. i think had they waited until september or later, that would have been very difficult, but i think by a, bringing it in florida, b, limiting it to seven counts, which i think is, you know, very prosecutorial, very professional, very intelligent approach, unlike, you know, bringing 34 charges or however many were brought in new york. but having seven counts tied together, blending in the unlawful possession and use of the classified documents, along with the obstruction efforts that were made to prevent the archives and the justice department from receiving those documents, i think that's a smart approach. i think that also speeds things up. i think from the description that jim gave, and i appreciate his passion on that, but from the
