that's in south san jose next to sylvandale middle school. azenith smith reports. >> reporter: we aren't seeing many details at this point as it's a fluid investigation. you can see behind me there is a high volume of police cars all afternoon. currently gathering evidence and detectives are interviewing neighbors. we did have skyfox over the home where you can see san jose police's crime scene van, also a yellow tarp covering what appears to be a body under the front yard. it's near an elementary school. neighbors say they heard one gunshot go off around 1:30 this afternoon. when police arrived, they found a man inside the home who had been shot. we spoke to a vietnamese family who appeared visibly distraught talking to detectives. they believe their loved one is the victim. they describe him as a married man in his 50s with three children. they called him a good husband, a family man and they have no idea why anyone would shoot him. >> i can't believe it. i can't believe anything happened to him. i don't know. >> it's sad. i feel so sad for

: kristen and larry it's happening here at an outdoor community pool in the valley section of south san jose. 35 people in all were exposed to color even gas after someone mistakenly mixed two chemical agents used to sand advertise pool water. kids were in the water while parents were on the deck when a yellow cloud tormd and caused immediate distress. irritated eyes and difficulty breathg. two others began vomiting. a fire department spokesman said it's believed one in the pump room accidentally mixed color even in the muriatic acid. >> the bi product of that can be color even gas. and again, the symptoms people reported were inconsistent o consistent with that type of exposure. based on the potential for that exposure to the color even it was recommended anybody reporting a symptom associated with transported >> sky7 was overhead as the hazardous material response was initiated. swimmer and bystanders were evacuated and sprayed down with water before placed in ambulances. that's done to prevent reduce being transported by ambulance to the hospital where others could be exposed. michelle's

. >>> nbc bay area's kris sanchez at the scene at south san jose. bring us up to speed, kris. >> reporter: well, i can tell you this is starting as a bizarre story. we thought that there was an officer involved shooting inside this apartment complex from the 5200 block of camden avenue. when we arrived the sheriff's department said there was no officer involved shooting. that it was a suspect appeared to have taken his own life by gunshot and searched a search warrant by the santa clara sheriff's department connecting that man with a 1974 cold case. this was a 1974 murder of a 19-year-old woman. the wife of a stanford student. she was killed at stanford memorial church. her body left naked from the waist down. she had been molested or assaulted with an object and something was shoved up her shirt, as well. this case was cold for 40 years though the sheriff's department actively investigating it according to sheriff laurie smith. >> and the case that we were serving the search warrant on is an old homicide case from 1974. it was an extremely brutal h

a high school teachner san jose is accused of pulling out a noose to threaten a black student. it happened in april in santa theresa high school in southan jose. police allegedly made a noose-like structure and placed it around his own neck telling the student to stay away. police were made aware of this incident after receiving reports from community members and not the school district. >> it's disturbing we weren't contacted. >> the teacher has been placed on administrative leave. the district attorney is also considering whether to file criminal charges. it's the end of a long offseason for rue been foster. today, he pleaded no contest to a weapons charge. we have video from his last court appearance. this all stems from an alleged domestic violence incident earlier this year. his ex-girlfriend first claimed he abused her at their home but then recanted the story. as for the weapons charge, the judge sentenced foster today to 232 hours of community service anticipate two years probation. the nfl could also possibly suspend foster. >> new at 11:00 tonight, a diploma was granted to a former student who never finished a single week of

it happened noon at the swim club in south san jose. firefighters say a maintenance worker at the delete mixed tool pool chemicals creating a toxic yellow cloud. people started coughing and wheezing from the fumes. all 35 patients were taken to the hospital as a precaution. there injuries were described as minor. striking woman charged with murder for allegedly killing and dismembering her roommates body pleads not guilty today in a courtroom. prosecutors say the 47-year-old killed her between may 13 and june 2 at the apartment they shared. police conducting a welfare check found her body. it was stuffed inside a plastic container in a storage unit at the building. gonzalez told police she and the victim had gotten into an argument, but gonzales claimed she had no recollection of the event that occurred afterward. when pushed by investigators about what happened after the fight gonzales said probably nothing good. >>> a judge decided the trial of two men charged in the deadly warehouse fire will begin next month. they went before a judg

this morning, san jose police needed to use the jaws of life to rescue a via hit and -- the south san jose. police are still looking for the person responsible. ktvu's leigh martinez is right near the crash scene with what we know so far prickly? -- far. leigh? >> you can still see the glass shattered all of -- this is of two crash sites that are being investigated. this one here, again on vine and edwards. there was a second crash site about a half a block away. it took firefighters 15-20 minutes to cut the driver out of the car. they first responded to calls of a traffic accident before 1 am. when they arrived, they found one victim trapped in the car. he was licking -- later taken to a local trauma center. continue to travel off of the road and into the front yard of a nearby home. the truck collided into two parked vehicles. police the three occupants of the pickup truck fled the scene. two people were found not far from the accident scene. and they were taken to the hospital for injuries. one person from the truck is still standing. that was the last that we heard from san jose p

san jose. one of the things we did notice is the bay bridge got early -- busy early. here in the south bay, we are off to a nice, early start. if we go to 280 in san jose, traffic is moving well getting up to highway 17. the bay bridge looks normal for now but it started early. it is backed up to the maccarthur maze. the metering lights are on. not a lot of wind, at least as far for drivers on the bridge. >>> we have a warmer forecast, although there is still plenty of low clouds and fog from santa rosa to san jose. we still have a decent fog bank. yesterday was a little bit stronger and made a bigger push. there was a delta breeze that is still there. it is not as strong as it was. santa rosa 75 to 83, redwood city 77 to 80, livermore, those for this inland get the furthest job from 83 to 89. it is just a little above average for many, more so as you head inland. we do have a pretty good fog bank. that is making its push inland. there is still an onshore wind or breeze. it has come down a little bit for travis. still southwest at 20. west at vacaville, south at davis. there is no nort
