strong proponent of the sexual assault training and oversight protection act which congressman jackie speier authored a couple of years ago. i feel very strongly that this tool is the only answer to changing how the adjudication investigation and victim care of process can be carried out by the military. >> john: let me bring susan burke into this. counselor, were you surprised by the numbers in the reports that surfaced today? >> no, not at all. the sad reality is that if year in, year out you fail to prosecute and incarcerate predators, rapists you will see an ever-growing number of rapes. it is fairly straightforward. the military continues to fail with just the basic justice. >> john: is there one branch of the service that has more problems with sexual assaults than other branches? >> no. they're all equally bad. you're really talking about a flawed and dysfunctionalled a jude ca tori system. they let all of the branches let the commanders, the day-to-day war fighters make the decision. a military jury convicted a fighter pilot of rape. they convicted him to a year. fairly modest penalt

joining me now, jackie speier is taking a leading role on speaking out about both women and men in theeen raped and sexually assaulted. first your reaction to this arrest. >> i was sick to my stomach when i heard about it. what does this say about the air force that their best and brightest, the person they put in the pentagon as a lieutenant colonel to run the sexual assault prevention and training office is someone who doesn't get it. someone who in the end will sexually assault someone in the civilian world and get charged with a sexual assault. i wonder what would have happened had it happened within the military? >> the pentagon released a statement saying, secretary hagel has expressed as you did, outrage and disgust over these troubling allegations and emphasize that's this matter will be dealt with swiftly and decisively. you've been on the forefront, the leading role in speaking out against these sexual assaults and the culture, if you will, that exists among some in the military. but going back to this arrest, might this be as folks in this town like to say, a game changer? m

congress wam jackie speier. >> the military culture has to be changed.f this attitude that boys will be boys. so you say you can't just say you can't feel this way. you need to legislate it. what would make things better? >> the criminal justice system within the military has to be reformed top to bottom. we're seeing minimal efforts to reform that system, but we need the senate to take leadership now, acknowledge that neither vick testimonies nor the accused are served well by the current system. there is not a system built on a fair and impartial process. right now it's commanding officers determining which criminal cases go forward. that's sex crimes as well as other crimes. we need trained attorneys and impartial judges overseeing a criminal justice system, whether it's in the military or the civilian world. we don't have that today in the military. >> another headline, an air force general decided to grant clemency to a convicted sex offender. lieutenant general susan helms nominated to the top spot in the air force command but her nomination has be

because in the last week or so, we know that the -- as senator kir city council jillibrand and jackie speierade us aware of a shocking level of sexual assaults against men but, also against women and particularly against women. and on top of that, we have the guy if charge of doing something about sexual assault for the air force arrested and charged with sexual assault. right? we've got a guy up at west point now who has been found to be secretly videotaping women cadets in the showers and in the bathroom. is this just something we have to learn to expect from the military, or are they ever going to get on top of it? >> you know, we have seen the numbers come out every year, you know, and they haven't improved that much in recent years despite the fact that the pentagon is paying more attention to this. the high-profiles of the people in charge sexually assaulting people. this doesn't give you faith in the effort. it will take a pretty huge cultural shift in the military around having women in the ranks. beyond making policies changes as well. that could take time. policy changes but i thin
