"eyewitness news" reporter david spunt is live in center city following this news. david, what do we know. >> reporter: jan, this happened three years ago, incident, it was supposed to go to trial this morning. that did not happen, case was settled for 4.4 million-dollar , and i'm outside of the attorney's office. phil holland wakes up, lives his life but according to his attorney his quality of life will never be the same. the it happened april between the second, 2014, 20 year-old till up holland who goes by phil was delivering food when he noticed a suspicious unmark car following him. it turnout to be two plainclothes police officers, kevin handby and mitchell ferrell who responded to a call of shots fired in the area. they spotted holland and fired shots in his car. since the shooting, holland's attorney tom kline says he suffered seizures and multiple other medical issues. kline sued on who will an's behalf, and this is the car holland was drive, it was supposed to be exhibit number one as a trial today but the case settled. kline told me today's settlement is

david spunt has severe the is. >> reporter: north penn is charged with institutional sexual assault afterlocal authorities tell "eyewitness news" he had sex with a student. the female student was 18. and authorities say the sex was consensual. major miller is facing jail time because he was a teacher at the time of the alleged incidents. down the street, to authorities say this marriott courtyard was the site of one of the sexual encounters. detectives say they have both miller and the 18-year-old on surveillance tape at the hotel. according to this affidavit, miller and the student had sex at the lansdale business park in his car. the alleged incidents did not happen on school property. but the district did release this statement to "eyewitness news." charges such as these against miller are contrary to the core values that educators hold true and will never be tolerated in the school district. as always, north penn high school has the staff and resources in place for students who may need extra support during this time. students safety is a top priority of the north penn school district

allegation has shock students and parents, "eyewitness news" reporter david spunt is live at north penn high school with more, david in. >> reporter: jessica and ukee this is after tait major hashing miller was an employee at north penn high school for several years, tonight he is out of the job here at the school. authorities say that they have evidence the and proof that he had sex with one of his students on multiple occasions north penn r ot c instructor major hashing miller is accused of having sex with one of his students. now he is facing a charge of sexual assault. according to an affidavit obtained by "eyewitness news" authorities say miller had consensual sex with the 18 year-old student in his car at land dale business park, and at a hotel in land dale. authorities used surveillance footage of miller allegedly inside of the land dale marriott. the alleged victim is also on the tape, according to authorities. miller's charged with institutional sexual assault, because of his position as a teacher. in december, the affidavit says that another student came forward, and said that
