in the past 10 years records show there were 49 officer-related shootings in st louis county - 14 of them fatal. among all of those cases not one led to an officer indictment. the man who holds that power - bob mcculloch. st louis county's prosecutor for almost 24 years. he comes from a family of police his father killed in the line of duty by a black man. all factors that many say make mcculloch too close to those in uniform. one of the most controversial cases under his time has been what became known as the jack-in-the-box case. in 2000, two unarmed black men earl murray and ronald beasley were fatally shot at least 20 times during a drug bust. the officers who opened fire said they felt threatened when the men's car moved towards them - mcculloch took the case to a grand jury. >> he refused for months to release key details such as the names of the police officers who did the shooting and the number of shots fired. he called the two dead men "bums" he refused all but the most cursory contact with the african american community which was understandably upset by the police shooting

st. louis county, we have representatives from st. louis county and ferguson and had a two day session on a pleasant bias. -- implicit bias. the colors right. we should learn where these biases come from and understand the results are still disparate outcomes and can feel like to discrimination to the person receiving them and by knowledge and that implicit bias, it is not wholesale racism and law enforcement. it does not question the officers integrity and it is saying we are human and we have these implicit viruses -- biases and that we have these biases and we need to understand to take those steps to prevent them. host: ron davis has been running the community policing service offices since being appointed by attorney general eric holder. he is with us for the next 10 minutes or so. on our line for independents. caller: first of all, let me say i have deep admiration for your profession. i myself have a city degree in criminal justice. i did end up going into for personal reasons. i have family members. one more samples and prism.

st. louis county circuit judge maura mcshane requesting an investigation into the grand jury proceedingsled to the decision not to indict wilson. we go to kansas city where we're joined by tony rothert, the legal director of the american civil liberties union of missouri. he is the attorney for the grand juror who is challenging missouri's grand jury secrecy law. welcome to democracy now! can you lay out for us the law in missouri that dictates what a grand juror can or cannot do especially in light of the fact the prosecutor can speak out all he wants, talking about bob mcculloch? >> right. the law in missouri is the same as it is in most states. grand jurors are not allowed to speak at all -- not about the evidence that they heard there are opinions about the evidence, or the legal counsel the received from the state. and usually prosecutors don't speak about what happens in a grand jury either. at least, not in great detail. this is an unusual case in that the prosecutor purports to have been transparent, to have released all the evidence, and to have really saw the transcripts of the

st. louis city and st. louis county. we're still waiting for that change to happen and frankly that's why the protests continue to happen. >> on to you, paul. eric holder said that the bar is high for federal civil rights cases so is it a surprise that no civil rights violations will be be levied against officer wilson? >> not a surprise to me and seeing the facts so closely. the one thing that you had in the ferguson case was michael brown was struggling with an armed police officer and the gun went off in the car. i've never seen an officer indicted. what i was surprised about was the aggressive nature by the justice department which hinted that something was being done improperly by the locals and that a federal grand jury would make everything right. they came in and did their own autopsy. they independently interviewed their own witnesses. they created the idea that the justice department was going to save the day on a white horse. we have a federal grand jury and they reach the same decision no basis for criminal c

st. louis a metro area of under 2 million people, 214 municipalities. 100 of them in st. louis county alone. and the third point i would make is that the -- the consequence of this in greater st. louis and elsewhere is most starkly the gap between black and white wealth. so here from the consumer finance we see the difference between black and white income. the difference between wealth is much starker. and through the civil rights era we've made some gains on wages and income but the wealth gap is growing. and that is all about housing. and if you combine stark segregation of uneven and fragmented governance and the wealth gap, you generate the story, i think, of an inner suburb like ferguson. what i show here is a pattern of this uneven development and annexation and the development and so the red -- i've just mapped single family homes as they are built in greater st. louis. the yellow are the areas as they are incorporated and here is ferguson, incorporated in 1894. but you can see we get a pattern of private development really out in the corn fields, that precedes incorporation.

st. louis county is saying we're trying to redouble our efforts. across the country. we're seeing soul searching. i talked to the diversity recruiter for st. louis county who said he just hired four new black police officers. they're using the story of ferguson to say if you think you're disturbed by this come join us and help us in this fight. let's look at the widest gaps stat wise. detroit has 82% of the population being black. 51% of the police force is black. buffalo, 37%. 5% in the same stats. cleveland, 52% and 25%. at what point do you think they'll be able to achieve this goal of reflecting diversity. how high a task is that? >> it's a high task. mainly because the country is changing so much. we're talking about black residents and police officers. you have to think about asians as a really fast growing population. hispanics are growing really really quickly. police departments don't change as quickly. you have people sitting the there for 30 years. close to 30 years. . you have to think they have to hire recruit and train these people. it

"the times" cites three law enforcement sources and says this, "justice department lawyers will recommend that no civil rights charges be brought against former ferguson police officer darren wilson after an fbi investigation found no evidence to support charges." anticipating wide interest in this decision, "the times" reports that the justice department lawyers "are working on a legal memo explaining their recommendation." joining us now is michael schmidt, who helped break this story tonight. thank you very much for being with us.
