state assembly state 19, michael brior and phil tim. >> they will answer questions that you in the audience submit as well as the questions submitted to the league of women voters. in addition, the viewers from the senior center may submit questions on-line. the time keepers will hold up a yellow card to signify to the candidates that they have 15 seconds remaining and hold up a red card when it is time to stop. >> both have asked the supporters to be respectful of the candidate and the audience and to maintain the quiet during the forum, i also ask you to respect this commitment, please. >> you all have many important decision to make on november 6th, and today's forum will give you the opportunity to ask questions to help you make your decisions. now, let's begin. >> our first question is a very general... actually i want to start with one here that is from the richmond senior center sent in on-line. >> the census data, and we are going to start with mr. brire >> data shows that many are adults with disabilities or seniors it is expected to grow to 25 percent by 2020, do you feel that you understand the needs and challenges of seniors and adults with disabilities in district 19? what do you think we worry about and how will you help us to stop worrying? >> so, absolutely, while i am a young person, i do believe that we really have an obligation to protect our seniors. and when you see services to seniors being cut, you have to realize that they have contribute to the system their entire life and this is a time that they need services even more than other moments. and when you look at what is going on, you also have to say that there is the statistic that you gave is actually the start of the baby booming population, as she growing older. so we actually need more and more services, we need to actually have people trained to provide those services as well. and so, i think, of my great aunt, who is 94 years old, who is i speak to as much as i can, when i think about what the senior population is going through and really care about their children and their future as well. >> thank you, mr. bryer. >> first off, thank you to the league of women voters and jr. voters for hosting this discussion tonight very glad to be here. i think of my grandmother and the amount of work that it took to take care of. we had an enormous amount of support from inhost services and i think about the california budget which has a $20,000 budget gap and the inhome services was one of those services that was cut where it was decided that we could not provide seniors care at home. instead, they are now going to the emergency room and seeking much more expensive healthcare. we need to do a whole list tick approach and cut back the safety net that we have been cutting. and we need to make sure that we honor or seniors by making sure that they are taken care of during their later years in life. >> so a related question starting you mr. ting. >> retirees are faced with threats from their benefits from under funded pension funds what would you do to stop this from happening in the future and how do you make them live up to their obligations >> that is a great question, someone who is a fiscal question who has been working hard to make sure that the city and county of san francisco does everything possible to leave up responsibilities my office help to bring in above the budget due to the hard work of our office. pensions are a major issue not only in san francisco and the state. part of the work that we did last year where we worked with labor unions and unix to debate and discuss and dialogue and we found a pension proposal that we could bring forward to the voters in the city and county of san francisco which was passed and we know that that is not the final step that the first of many things that we are going to have to do to make sure that we have a balanced budget. the worst thing that we can do is to make sure that we need to make sure that pensions are going to be there for people when they retire and we need to do everything possible to make sure that we live up to the obligations that we promised people when they started working. >> mr. bryer. >> pension is something that is critically important for the state. and we have huge obligations in the pension funds that have been unfunded and right now we are assuming something like a 7 and a half percent on pension returns when the private sector the returns are, you know, anticipated around 4 percent. a

>> i don't think it'd hurt their faith. when you talk about an event that hasn't happened in 130 years, investors and the markets don't like surprises. were a bit in unknown territory. look at friday's close, really wasn't energy in the market in the u.s. negative or positive. unless something really happens in the next day or two in europe or in asia, i don't think is a real big deal. cheryl: i have to wonder about volatility. we have had several big names delaying their numbers until later on in the week and we will probably see more companies to the same so if we open for business wednesday morning, will it be kind of a wild ride? >> it certainly means he will be concentrating all the bow bubblf news into the first period we will have a bit of a volatile open that point in time, but making sure the press releases, announcements reaching as many people as possible to be in compliance with full disclosure. certainly the longer that the exchanges are closed, the greater uncertainty they will have. cheryl: a few sectors may cross hairs. financial insurance companies selling off because of sandy in this country. retail, the shipping countries, the refiners, is a huge question marks for wednesday morning. >> we will probably see a bit of a volatile opening, but things will shake out pretty quickly and retailers in particular that you brought up had a particularly great weekend last weekend, that's jus not just thd staples, but clothing and so forth as well. i think people anticipated this problem and actually overspent. i think we just have to wait and see how this all shakes out after the financial market reopens. cheryl: thank you very much, appreciate it. dennis: were moments away from president obama statement on hurricane sandy. dennischeryl: and we heading to long island that triggered the biggest hit from sandy. do not move, we will be right back. >> i'm liz macdonald with your fox business brief. hurricane sandy's wrath is already being felt on the u.s. market. your stock exchange, nasdaq exchanges are all closed today. the futures have been halted at the cme group, but commodities continue to trade. and commodities rescheduled the earning report as result of hurricane sandy. and nick's third-quarter resul results, td ameritrade moved up its results this afternoon from tomorrow while pfizer has moved the webcast to thursday. personal spending rose more than expected in september climbing 0.8% from august. then come right in line with expectations. but his latest from the fox business network giving you the power to prosper. cheryl: breaking news continues. live pictures right now coming out of the white house to the right of your screen the storm, we're watching a statement from the president on the impact of hurricane sandy. they've actually learned in the last few moments that the press corps that was following the obama campaign did not fall the president back to washington because of the storm, so basically the press corps is stuck in florida, the president is in washington. expect to hear from the president at any moment and we will bring those comments to you live. statey declared in connecticut, district of claudia, new york, rhode island, virginia, maine, delaware. we have a lot to watch for. dennis: the chief meteorologist, are we facing a dangerous situation in that? state assembly candidate and another for a republican running for the state senate. >> ifill: president obama and mitt romney rescheduled their wisconsin events for later this week. want to examine the fallout no matter who wins? you can explore every electoral college scenario in our vote 2012 map center. >> woodruff: is an alert from a drug-sniffing dog enough to justify police searching a home or a car? that's the question the supreme court explored today in two cases. marcia coyle of the "national law journal" was in the courtroom this morning to hear the arguments. and she's here with us tonight. welcome back. >> pelley: thanks, judy. >> woodruff: i imagine it's not all that often the court hears a case about a dog much less two cases. >> it is a little unusual. in a sense we've gone from high-tech questions under the forth amendment, like the attachment of g.p.s. devices to cars, to low tech questions under the fourth amendment. these two cases come in two very different factual situations. the first case that was argueded this morning, a police officer was acting on an anonymous tip that marijuana was being grown in a house. he took his narcotics-trained dog up the driveway to the front door of the house. after a time the dog alerted by sitting at the base of the front door. the police officer left the dog with another officer to go get a search warrant. the question for the supreme court is, should he have had a search warrant with him before he allowed the dog to sniff? was the dog's sniff a search under the fourth amendment? the second case doesn't involve a house, it involves a pickup truck. a police officer stopped the pickup truck for a traffic violation, noticed that the driver was sweaty and very nervous and when he went to check the driver's license he brought out his dog, aldo, a german shepherd, and had him do a sniff around the truck. the dog alertedded on the handle of the door and the police officer used that to search the truck. the question for the court is whether the dog sniff itself gave the police probable cause in order to search the truck. the florida court ruled against law enforcement in both cases so it was the stateflorida that brought the cases to the supreme court today. >> woodruff: so the justices heard these separately. and what kinds of questions were they asking. the first about the case involving the house? >> well, the state of florida was represented by the same lawyer in both cases, former solicitor general gregory gar and he told the justices that in prior cases of the supreme court the court found that drug-sniffing dogs were rather unique and they could search luggage, open containers because we don't have a reasonable expectation of privacy in contraband. and he said this was really no different here but he ran into trouble across the bench from justices. the home, it appears, the difference in the eyes of the court. justice ginsburg said, for example, "under your theory of the case, couldn't police take drug sniffing dogs into neighborhoods that have drug problems and go door by door having the dog sniff or t front door? or into an apartment building and go door by door?" justice

state assemblies and legislative bodies within each individual state and county. these are the people who really affect our daily lives. and as we all know, the president only has a certain amount of power. congress has the real power and those are the places where it is extremely important to vote. guest: in my article actually look at a study that was done in 2001. not only in presidential races, but in dandala races and -- but to the down-ballot races. it was a very comprehensive study. they found that one race was probably decided by local vote. it was in 1910. congressional representation is very important. congress is very powerful. you are right about that, but that is still not a good reason to vote. your impulse is very common and it is absolutely understandable. we want people to be invested in the enterprise of america. and we want people to expand some effort, possibly some money, you know, miss a day of work or whatever it is, to show that we are in this together. it is a good way for us to be able to quickly judge other people. that said, the actual act of voting is not the best way to do that. i think you are absolutely right that we need to be cynically in gauge. -- pacifically -- civically engaged. we need voter education. the get-out-the-vote campaigns intended to lower the quality of the voting pool. uber people tend to be less informed. -- no. people tend to be less informed. -- shutting young people o shoving young people into the ballot boxes, most of them do not know what they are doing. they will launch influence the outcome of the election, but it will put them in the position to think that they are. host: mary in st. louis. caller: i don't agree with her. their vote does count. i have an 18-year-old. he would love to vote. it is wrong for her to say that your vote doesn't count. that is why so many people are confused on whether to vote or not. guest: i think is great that you are taking your 18-year-old to see how the process works. that is valuable. at the same time, you raised something that i would like to highlight from the peace. there is a good reason to vote. there is a 1983 book which is kind of a seminal book on this. they say, look, one reason you might vote is as an expressive measure. voting is fun. election day is kind of cool. you go to the polls, and you get to savor their. you see kids with their grandmothers. it is great. that is cool. voting is fun. have a great time with that. but i do think you do 18-year- old's everywhere a disservice to tell them that their vote will influence the outcome of a presidential election. it is not. there are lots of good reasons to vote, because you like voting. but that is not the same thing as saying my vote will be the decisive vote. it will not. host: our guest is the managing editor of reason magazine. we're looking at her piece "your vote doesn't count." you mentioned you do not vote in the presidential elections. guest: i actually don't vote in statelocal elections, either. again, because the margins are too big. but like i say in the peace, if we wind up in a to georgia where no one else is voting -- and this is the idea that if you start to do it and no one starts -- and no one votes, that would be terrible. i would vote in a pga election were only five people show up. i do vote in -- pta election where only five people show up. i do vote in the polling in my office. my official position is by having on negligible chance in influencing the outcome of the election, -- if i have a non- negligible chance in influencing the outcome of the election, that is when i vote. host: here is a tweet to where you are saying. what would be the outcome of the vote if no one voted? guest: this would be the alternate opportunity for the write-in ballot. if we wind up with a situation where we have -- where i am the only voter, you better believe i will be president catherine mangu-ward. host: next caller. caller: i tend to agree with what she is

states, particularly states whether democratic leaders incentives and assemblies, and democratic governors, teacher unions were involved in these conversations. and they were stepping up to the plate, i would argue, with more than just what mike mentioned about in wisconsin where they were offering wage concessions and benefit concessions. offering to go down some path that they had not been willing to go down in the past. issues like teacher evaluations that some component tied to student performance. issues like greater public school choice. even some issues which had been sort of the holy grail about tenure and what it means to earn tenure in places. so this is sort of the backdrop that was playing out in many states around the country two years ago at a time when the wisconsin legislature went overwhelmingly to the republicans in the election, and governor scott walker was elected. at a time when governor walker took office and the republicans controlled both the house and the senate in wisconsin, it was common knowledge, everybody understood that elections matter, and what you saw from the wisconsin education association council were what appeared to be, like on the outside, initial overtures to start going down some of these paths about dealing with teacher evaluations, dealing with performance pay, and a few weeks prior to the legislation that was introduced by governor walker, yet we saw the state union in wisconsin through the largest city in the state under the bus. they supported discussions about breaking up the milwaukee public school district into smaller unions which is something that had been on the table for the last 25, 30 years in wisconsin. and was generally posed by teacher union
