steve brown is live in marquette, michigan. when did he make the decision? >> according to him this is part of his biannual deliberation. he and his son and wife get together and discuss whether or not to commit to another campaign. on the way down and back to the final four to watch michigan state they had time to talk and 440 miles both ways, and they came to the decision about 36 hours ago this wasn't something that he was ready to do. >> shepard: any idea what's behind this decision here? why now, aside from the obvious? >> there's a lot of attention paid to the pressure he was under from tea partiers but he said that's not a factor. he said his number one item on his legislative agenda when elected was getting affordable healthcare for all americans done. it took 18 years but he got that done. secondly he wanted to make sure democrats within the district had an opportunity to collect petition signatures and run if they wanted. another reason is the fatigue of doing this particular job in this particular district. it's an eight hour traveling process to

steve brown is in chicago where this trial would take place with more. e, steve. what happened? >> reporter: well, this is the motion as it was supposed to go out with red acted portions of it blacked out. somehow through the pacer system which is the federal court's document system that you can get things electronically, magically, all of this stuff appeared which included some pieces of information that both the government and the defense were told not to disclose to the public until the judge decides what's in and out in the blagojevich corruption case. so we haven't got an exact answer from the pacer folks as to how this happened, but it did happen. jon: so what do we know about why blagojevich wants the president to testify? >> reporter: it is believed that the president, in the defense's view, can hold up their version of accounts, that this seat, that the senate seat that the president gave up to become president was never really sold and that there was no account of any of this, and they point to a comment that the president made just a couple of
