federal court, and that's now largely in the hands of northern district of georgia federal judge steve jones. he's got all of the briefs and the parties's arguments. but while he's considering that removal issue, state proceedings can go forward. in fact, there could even be a trial extremely unlikely that will happen here, but a trial could take place before he makes a decision because state court proceedings continue. and so the issue is some defendants have made speedy trial requests. legally in georgia, they now must have their trials commence by the next term of court after the one that's currently in session, that means a fall trial for that group. other defendants say, no, that's too fast. and there are due process reasons and constitutional reasons where they should be given more time to prepare, especially because we know fani willis has asked all of the defendants to provide two terabyte hard drives to receive their discovery. that means there's a lot of material, plenty of rationale for those folks to slow things down. so two groups for trial, perhaps more the judge will have to w

federal judge, when you see non federal judges, you know, judge back with down in georgia, judge steve jones there, the 11th circuit. they are all moving with alacrity, it does make the layman, me being the layman, scratch my head and, say what is going on here? mark, when we talk about the decision that judge cannon made here. how much room is there for trump to appeal this? or to otherwise further slowdown the discovery process? >> so very different things, appeal this, not really. the fact is, this is a very routine productive order that has been put in place. there was nothing in this order that was unusual in anyway. it was a bad day for donald trump, because he didn't get what he had asked for. so in that sense, i guess one can say it was a victory for the prosecution. but it was standardized, most of those provisions i never would have thought about in one of my cases because i would've expected it to be that way. now, whether he can slow the process down by way of discovery, yes, and that is a concern with respect to the pace of this court. i agree with me wholeheartedly, i cannot de

meadows did not succeed in this effort, in his ruling, judge steve jones wrote, the court concludes that meadows has not met even the quite low threshold for removal. that judge went on to essentially wave away meadows claims that he is simply carrying out his duties as chief of staff. take this example. during his testimony, again, last month, mr. meadows was asked about a text message he sent to a georgia elections official, in which he essentially offered to have the trump campaign pay for part of the georgia recount effort. meadows wrote in that text, is there a way to speed up fulton county's signature verification in order to have results before january 6th, if the trump campaign assists financially? now remember, mr. meadows was trying to claim here that he was acting as white house chief of staff, not as a member of the trump campaign, when he sent that. on the stand, mr. meadows explained that text was in keeping of me trying to ask a person who should know whether it's a financial resource issue, you know, manpower issue, or whatever. so i wasn't speaking on behalf of the campa

this is the second time that judge steve jones is hearing a case like this, because mark meadows, trump'sf of staff, went through the same process and the outcome, meadows did not get his case moved to federal court because of a very specific job of what meadows was doing in his job. he was chief of staff at the white house, not chief of staff to the trump campaign. and that is specifically related to what's happening with the election here in georgia. there is going to be some help from both sides here. former attorney general ed neese wrote a memo that he just put in the docket over the weekend in support of jeffrey clark moving to federal court. the d.a.'s office for their part has julie hunt, head of the civil division, during the trump administration that, no, in fact, they did not have do deal with the election in that specific gob. >> gary, thank you very much for your reporting. and as gary pointed out, the judge rejected a similar motion by mark meadows. what would need to be different in clark's case for this to go his way? >> well, i think he's going to have to convince the jud

our reporter in the room telling that you say judge steve jones was visibly frustrated and annoyed with clark's argument. used the word disdain to describe the judge's reaction. and this led trump's lawyer to lean into clark's attorney and whisper those words "this is not good." and this hearing comes as another trump codefendant today filed a claim in the georgia court. kenneth chesebro's attorneys writing, the republican presidential electors were qualified and elected by the republican party. well, chesebro is the attorney accused of being the architect behind the fake elector scheme that. excuse just, quite simply, doesn't add up. it doesn't matter who the republican party wants as electors. when it comes to the electors are for a state, what matters was voters want. only the electors of the winning candidate based on popular support are supposed to show up the certified election, which are the electors. trump lost it by 11,779 votes in georgia. and the fake electors then went and signed a document that falsely. so, to quote trump's lawyer today, that is not good. and these are far

judge steve jones wrote, in parts, the court concludes that meadows has not shown that the actions that trigger the states prosecution related to his federal office. meadows has filed a notice of appeal to the 11th circuit. meanwhile, the charges careful to note this ruling would not impact the four other codefendants with pending removal bids. that former president trump has also notified the court he may file to remove his case as well. he has until the end of this month to decide. this week, we also got a little bit more insight into how the trial will proceed. judge scott mcafee expressed concern about the logistics of trying all codefendants together and he gave a statement to state to submit their argument for trying all 19 at once. starting october 23rd. that is when kenneth chesebro and sidney powell will be tried together, despite their lawyer's best efforts to sever the case. powell has moved to sever their trial from the other codefendants immediately and chesebro has filed to dismiss the r.i.c.o. charge against him. on one state, prosecutors set that trying the codefendants

. >> so on that, federal judge steve jones he could be ruling anytime now on the request from mark meadowshave his case moved. the judge's latest question and obviously the responses are in from the da and meadows' legal team, the latest question was specifically on if the court found that any one action described in the racketeering case, if the court found that it had to do with meadows' conduct by meadows in the course of doing his job, a federal position, does that mean that the whole says should then be moved to federal court. the da says obviously no. meadows' team says obviously yes. what do you think of this? >> the judge's question was very insightful and shows the kind of careful consideration analysis he is giving out of fairness to meadows' former position. honestly, kate, had a lot of legal analysts scratching their heads trying to dig out what the right answer should be. i think the da has the better argument here because it's not the actions that are being charged individually as crimes, it's what they all add up to. so it's the charges that he's facing. also in an indictmen

forthcoming issue of -- supremacy clause immunity is one of the best approach for district judge steve jones. this is a provocative position, in part because there's so much anxiety about the perceived disadvantages to the prosecution if the case is removed and quote. i really am very interested in this. i've always wondered, if he moved to federal court, there's still a trial, there's still a case about the underlying things that he's proposed. tell me why you thought it might be an interesting proposition to do that. >> look, i want to clarify that the reason that we saw that it might be the right approach is because of this kind of policy really that maybe federal officials and the scope of their duties, which is what is being raised here in mark meadows so federal defense. he's raised the question of supremacy clause immunity, and that requires the judge to decide what's in the scope of a federal official duties. and the scope of the presidency. our argument was that maybe that is a question of a federal judge that should decide, rather than a state judge. that's going to be great. howev
