i'm joined by republican strategist and msnbc contributor steve schmidt, as well as jennifer daskell, associate professor of law at american university. i want to go to steve on this on the politics of this thing and your general sense. i mean, there is a background here. trump has called one judge, a mexican-american guy unreliable because he might have a prejudice against him. this case, he refers to a so-called judge. i'm going to ask the professor whether that's going to make some of these judges a little bit less happy to go along with the government position here. what do you make of this challenging the court, sort of andy jackson sort of thing going on here? >> i think it's totally inappropriate, chris. look, less than three weeks ago donald trump stood on the west front of the capitol, raised his hand, swore to preserve, protect and defend the constitution of the united states. we have an independent judiciary in this country. he's not a so-called judge. he was nominated by a president of the united states. he was confirmed by the united states senate. he's a judge. period. e

joining me now, republican strategist steve schmidt and msnbc contributor. steve, what do you make of the world view of bannon and miller specifically as it sort of forms itself into policy as we see expressed in the executive order. >> well, it's an absolutely radical world view, chris, and it's a departure from the bipartisan consensus that existed from harry truman through barack obama about the centrality importance of the united states as the anchor nation in a liberal global pluralistic world order that was ilt after the catastrophe of the second world war where 80 million people were killed and steve bannon is hostile to that global order. david petraeus was testifying today on capitol hill and he talked about the necessity of preserving that global order, that it's not self-sustaining, that it maintains itself through american commitment and so the notion that you saw with president trump saying things like "mexico has beaten us to a pulp," it's an absurdity. of course when you give consideration to those words. but when you look at the inaugural addr

and steve schmidt is right. a lot of what it has done has been sort of stumbling and fumbling. clearly, there are a lot of people in key positions never done anything like this before. and so if you -- if you're going to write an executive order that fulfills your muslim ban promise and do that for your base, you know, you should at least do it right. you should do it in a sort of competent way. and the administration failed to do t the mixed messages that come out of the administration on a given day, you know, general flynn has -- the president has full confidence in general flynn an hour before the president is still mulling it over, an hour before general flynn is fired. this sort of thing happens. steve right that it's like no other administration. but watch out for this health care fight. watch out for what's happening out there right now. this could set a tone for the administration, at least for its first year. >> its theme of our broadcast, at least. and that is there is something happening here. eugene, steve, thanks. we'll be coming back to you. we'll get our first b

steve: rob schmidt joins us now with what this means for millions of people who smoke the pot. >> notartment to crackdown on states that allow recreational marijuana. this is an about face from former president obama's stance from staying that the federal government wouldn't interfere in states where it's legal. yesterday white house press secretary sean spicer says he expects president trump won't be ann as lenient as the previous administration. >> there is still a federal law that we need to abide by in terms of the medical -- when it comes to recreational marijuana. i do believe that you will see greater enforcement of it. >> well, this could undercut the growing number of jurisdictions trying to legalize pot. the white house says president trump does believe medical marijuana can comfort people suffering from debilitating diseases. 8 states and washington, d.c. have legalized the recreational use of pot at this point. now it's up to attorney general jeff sessions to decide exactly how to enforce this law. steve: so those 8 states they say it's okay if you are caught with pot, but
