megyn: back to our panel, steve hayes, juan williams, and our own court -- chris wallace, host of "foxtion as we were sitting here, he was asking her once again about the wise latina speech. she came out and said that i was the one in the speech that pointed out that it was nine white men who decided brown bears the board of education. in that -- groubrown versus board of education. she said the judge cedarbaum has pointed out to her that cases coming from judges of white males have been favorable for minorities. but she would argue that people that have changed the landscape for civil rights were largely people of color and women. is that directly contrary to what she said to the senate? >> absolutely. maybe it was white men that decided the case, but it was people of gender and color that argued the case. it gets back to the issue of identity politics. i have to say that in that area, especially in the ricci case, i felt that senator corn andn had nin had a missed opportunity. we had a better job of explaining it. a case that most americans can understand and sympathize with, the ric

steve hayes, juan williams, and chris wallace. juan, let me ask you about russ feingold. she said, i would hope that a wise latina come to a better conclusion that a white male. he came out and said a few lines taken out of context from the 2001 speech are not going to sink this nomination and it is not fair to judge her by those. is he downplaying what we are dealing with here too much? >> he is. what the democrats have to do here is to try to get this off the table. that is what the white house did after it was first disclosed that she made this comment. to not suggest that because of her hispanic descent that she is somehow better than any white male. what was subsequently disclosed is that she said this repeatedly. that is on the table. there is no getting away from the idea that this was a very strong racial comment, if not tucson, a racist comment. do you simply give for the benefit of the doubt and say, she did not quite mean what she was saying, she is simply suggesting that her experience growing up in the projects, growing up in the minority community gives her
