it involves the patriarch of viacom, sumner redstone.attle to control the future of the ailing media mogul's empire and that battle is escalating right now. two companies under billionaire sumner redstone's control, viacom, cbs, moving higher right now on a storycharlie will talk about in a moment. what is going on? how old is he first of all? >> he is 92. he had a couple caretakers, his girlfriends too. these are all court documents got released today. one of the girlfriend put in court documents basically said she was improperly fired a couple months ago. liz: how do you fire a girl friend? >> she was a girl taker. his new taker phillipe dumont, ceo of viacom. what is fascinating about this, it is confirming, if you believe her, a lot of what analysts and investors know, that sumner redstone is very old now. he is 92. he is less, and less capable to run the company if you believe this lawsuit. redstone's people are denying allegation, she basically says, he is losing it. he is crying uncontrollably at times. there was a couple choice q

sumner is incapacitated. even if he were to pass possible that -- >> why do you believe shari redstone will try to run the whole they are doing? >> she may. she may. but then what might happen is because, you know, sumner's decision-making now is no longer is relevant. previously you had a situation where sumner wouldn't sell or wouldn't be able to engaeng now you might have somebody like a liberty or time warner going in and engage for these assets. investment bankers in new york -- >> everybody is thrilled. everybody is playing this parlor game. >> we wrote a research report earlier this year talking about engage assets. >> everybody is shrilled that everybody is playing this parlor game about who is buying the company. we wrote a research report earlier this year about les moonves. les is now protecting himself, protecting cbs against a buy-out. there's no love lost between les and philipe doman. red stone controls the voting shares. >> what does it say that sumner red stone has given over control to felipe and not les? >> that's a legacy thing. as things move forward, the new trustees will become more power

redstone is going to die. i should add, sumner known for many years and i hope it is not true, that he's declined to this extent. but regardless, you know people on wall street are simply speculating as to what will happen to the companies when he does pass away. he is 92 or perhaps even older than that, actually. and yet, that remains something that is unclear. because as julia said, there is a trust, and irrevocable trust of which the beneficiaries are the youngest of his, great grandkids i think. and the trustees of the trust are not in a position where they are forced in some way to force the sell of the con strolling stake in viacom and cbs owned by national amusement and it does not appear based on reporting for some time there is a tax bill or something along those lines that forces some sort of a sale. that said, it still remains unclear exactly what the dynamic is going to be amongst the trustees. which includes sherry and her son tyler. and what their decisions may be. but that is what you are seeing, simply speculation.

this, of course, involves a former companion of sumner redstone, the chairman, she was his girlfriende's been kicked out of his mansion. she says she should be in charge of his health. he's 92 years old, and what do we have here? she has a lawsuit that she's filed to get back into his inner circle's good graces. she wants to be a part of that. she says he cannot have real mental capacity at the moment to run viacom, that he is -- and these are quotes -- he's a living ghost. he cannot converse them, he only grunts. he has crying spells and, quote, he wants steak and sex daily. does this hurt the stock? >> you gave me a lot of interesting, in quotes, page six type news. from my point of view, i've followed viacom since 1973 when it was spun off from cvs. the stock is selling at 50, you've got 12 billion in debt, and i think they need a jolt to overcome the notion -- liz: it's a jolt, mario. i don't know, is it a jolt in the wrong direction? if you had to pick between that and the spunoff cbs reason by les moonves, which would you pick? >> well, i'd pick them both. les has done a great j
