the process has been that we recognized as you did that our procedures or not a good fit for sunshine issues and we all recognize that we needed to make changes several years ago. we developed a proposal, you reviewed it and make your changes. what came before is in november is that was meant to help the commissioners. the staff brought something forward, based on their experience, was an effort to incorporate our concerns and yours and we said, let's talk with you and see what we can do going forward. so, i appreciate looking at where we can go together and how we can get there as efficiently as possible, but i would like to put aside this sense that the staff is putting this in the affirmative to. the staff is helping us and by extension, all of us, in this place where we have rules that we think makes sense, and procedures that we don't keep wasting people's time or starting from scratch in a way that is not efficient. i appreciate the chair giving it this much thought. perhaps, your dog does, too. i would like to see where else we can find that kind of common ground. i agree with

sunshine cases are pretty complicated because of the statute. you are using the wrong regulations, this is not official misconduct. ultimately, the case was dismissed by the commission. they are very different in one respect. the staff has the right to review the complaint that it has filed. with it, the executive director analyzes the information that has been blamed by the members of the staff, and he writes a report to the commission which contains a recommendation of either probable cause or no probable cause. if two or more commissioners don't ask for a hearing, from the time to receive the report, it automatically is not hurt by the commission. it is a default type of arrangement. the case gives the dismissed under those regulations. >> let me stop you right there. >> you are jumping ahead of where the discussion is. at the moment, we are just discussing if we have the power to deal with it. we may get to, and i am sure we will, what might be suggested as a weighted deal with these things in the past. i agree with the jurisdictional issues

the sunshine ordinance does not say that complaints must be court sustainable. ethics is formulating a requirement that has no basis in law and is on known to anyone. in regard to the 123-page memo from ethics, this shows an attempt to avoid dealing with complaints by focusing on whether a violation was willful. there is an easier way to address this. there is a requirement of commissioners, department heads, and program managers, to take periodic training. people signed a declaration under penalty of perjury. thus, if an employee complaint against has signed that document, it is possible that they have been negligent in their retraining, and have committed perjury by signing it. its ethics simply looked at whether the sworn statements are filed, that is an easier way to establish whether there was negligence and culpability on the part of the respondent. ethics approach now is a hybrid legalistic and will discourage complaints from being filed. these observations are coming from the only person ever to serve on both the sunshine or dance task force and the ethi
